No Broker — Delayed Interior and denial of correct compensation

No Broker : Interiors = Unprofessional Execution, unethical business practice and causing Mental and Physical harassment to Customer and Cheating of legitimatate delayed penalty.;; Langston Kharadi, Pune flat
1. The timelines as promised by the marketing team Mr Mohit Madurwar ( Mob [protected] ) and Mr Mihir ( mob [protected]) was to complete the work in 45 days from date of payment . My requirement was to complete by 30 Oct 2022, so that the flat could be rented wef 01 Nov 2022. This was clearly conveyed to No Broker Sales/marketing team Mohit and Mihir . They assured me they will fast track the project and complete the project by 30 Oct 2022 ( plus may be 3 or 4 days more )
2. Believing the No Broker team I made advance payment on 20 Sep 2022. The design activities started in right earnest . The timelines as mentioned by No Broker in their Onboarding document was, a) Design time : 10 days, b) Execution time : 35 days . meaning work would be over by 4 /5 Nov 2022.
3. However after the design was finalised on 04 Oct 2022, the project manager Mr Umang Shah said, he will need 45 days to complete the project from 04 Oct 2022. Thereby confirming that the Sales/marketing team of Mohit and Mihir knowing fully well that, execution can NOT be fast tracked Wilfully Mislead me to believe the completion by 30 Oct 2022 or latest by 4 or 5 Nov 2022.
4. Well No Broker could complete the interior work and remove all the surplus wood etc by 15 Dec 2022 only . after rigorous follow up and personal supervision by me personally for about 20 days .
5. The loss of Rental income to me from 5 Nov till 15 Dec would be about Rs 40, 000.00 . Though the fitments of the interior was done by 07 Dec 2022, the cleaning and surplus items were collected by 15 Dec 2022.
6. Mr Umang mentioned to me that the Company has agreed to compensate my rental loss due to inordinate delay by paying me Rs 17000.00, by end of Dec 2022, provided I clear my balance payment towards the interior work of Rs 63028.0 quickly . Believing him I paid the full balance amount on 16 Dec 2022.
7. My Complaint :
a) The Sales and Marketting team of No Broker willfully mislead me to believe that work would be completed by 30 Oct or latest by 05 Nov 2022 – where as the work could be completed only by 15 Dec 2022 ;; thereby committing a Criminal Breach of Trust ( Sec 406 ) . ( Ref para 3 above for details )
b) The Project Manager Mr Umang Shah, mislead and Cheated ( Sec 420 ) me of Rs 17000.00, by misrepresenting the fact that No Broker would pay compensation of Rs 17000.00 by end of Dec 2022, while he knew all along that No Broker would not do that. ( Ref para 6 above )
8 . My Prayer :
a) No Broker be asked to pay me full compensation of Rs 40000.00, towards my rental loss for 40 days – due to delays from their original commitment of 45 days from 20 Sep 2022.
b) Necessary Criminal or penal action be taken against No Broker executives for Criminal breach of trust and business ethics, thereby causing mental and physical harassment to the Customer.
