Subject: Refund of Rs. 40, 000/- paid as consultancy charges for getting Ireland Work Permit and termination of Agreement entered between Oceans Outsourcing and my Client.

Respected Sir/Madam,

I am concerned for my Client Mr. Rinit Chudasama having address at Rajshiv CHS, Flat No-202, A Wing, Near Maruti Nagar, Ashok Van, Dahisar – East. Mumbai -400068 on whose behalf and instructions I am stating you as under: -
1] My Client states Addresses No.1 is the Company having address as mentioned above and Registered in ROC Delhi and Addresses No.2, 3, 4 and 5 are the directors of the Company having office address as mentioned above.
2] My Client states that in the month of February, 2020 he came across an advertisement on Facebook and that Addresses No.1 had published on Facebook that the Addresses No.1 is offering job for Canada, Ireland, Dubai and Singapore.
3] My Client further states that he had received an introductory mail dated -11/02/2020 from Ms. Priyanka Mallik, working as HR Specialist in Oceans Outsourcing and giving brief introduction of the Company and also informing about in which country they are providing Job in various countries like Canada, Ireland, Singapore and Dubai.
4] My Client states that accordingly my Client had forwarded his resume and Ms. Priyanka Mallik had informed through mail date 14/02/2020 to my Client that his profile is selected for 3 countries i.e Canada, Ireland and Singapore and he is eligible to apply for the post of Relationship Manager or Sales Manager. My Client further states that in the same mail the job profile for Relationship Manager and Sales Manager was explained in detailed. My Client states that in the same mail Consultancy fees for Canada and Ireland was mentioned as Rs. 80, 000/- plus 18 % GST and for Singapore Rs. 60, 000/- plus 18% GST and in the same mail Salary description for Canada and Ireland was mentioned Rs. 3, 50, 000/- to Rs. 5, 00, 000/- negotiable. My Client further states that for Singapore salary package was mentioned as Rs. 3, 50, 000/- and both the packages included Food and accommodation. My Client further states that in the same mail Ms. Priyanka had mentioned the payment schedule.
5] My Client states that as per the mail dated – 14/02/2020, my Client had decided to choose Relationship Manager Job as his last job profile was of Relationship Manager and my Client confirmed job for Ireland Country. My Client further states that accordingly he had mailed through mail dated 16/02/2020 to Ms. Priyanka, HR specialist that he had chosen job for Ireland Country for Relationship Manager and had clearly mentioned in the mail that he needed some references who has got jobs in foreign Country with visa details.
6] My Client further states that thereafter he had transferred the first instalment of Rs.40, 000/- ( Rupees Forty Thousand only ) via Google Pay on Ms. Deepika Gupta’s – HR Manager - Contact no - [protected] which was mentioned in the mail dated 14/02/2020.My Client states that after the first instalment of Rs. 40, 000/- was paid thereafter Ms. Ritika – Documentation Officer had sent mail dated 19/02/2020 that they had received payment of Rs. 40, 000/- and confirmed the same in the mail dated – 19/02/2020.
7] My Client further states my Client had received mail dated – 19/02/2020 from accounts department that they had received payment and attached the invoice copy no -830 dated – 19/02/2020 for payment received for Rs. 40, 000/-.
8] My Client further states that my Client had received mail from Immigration Department as on 19/02/2020 and through this mail my Client had received Agreement copy. My Client further states that my Client had sent scanned and signed copy of Agreement to Immigration Department through mail dated – 20/02/2020 and Copy was marked to Ms. Priyanka also.
9] My Client further states that as on 20/02/2020 my Client states that he had received mail from Ms. Ritika – Documentation officer and she had informed my Client regarding the document checklist and informed my Client that he had to send all the documents within stipulated time.
10] My Client further states accordingly my Client had couriered the required documents as per the checklist as on 27/02/2020 on the company address which is mentioned above. My Client further states that the courier was delivered as on 29/02/2020 and the same was acknowledged by Mr. Jai Rahi – Documentation Executive and my Client had also dispatched through Sangai University transcript of degree and that also Mr. Jai Rahi had acknowledged the receipt of the same.
11] My Client further states that my Client had to send Transcript of Diploma which was required for Ireland work permit. My Client further states that he was unable to arrange the same as the College from where my Client had obtained diploma was shut down. My Client had informed Ms.Ritika about the same and had also told her to further ask the recruiters that can they start the Interview process. My Client further states that Ms. Ritika had informed the recruiters and recruiters had given time extension for submitting the Transcripts of Diploma and also had informed my Client that they will require complete documents before starting with the Interview process.
12] My Client further states that various mails which were exchanged between Ms. Ritika and my Client. My Client further states that thereafter due to Covid-19 outbreak Lock down was announced all over India on compulsory basis and all Schools, Colleges and offices were also completely closed down . My Client further states that because of Lockdown my Client’s Ireland Process came on hold. My Client further states that he was continuously following up with Ms. Ritika and she was continuously telling my Client one thing only that as soon as the Lockdown gets over my Client’s process will start.
13] My Client further states that in the month of May my Client was tired of following up with Ms.Ritika and so my Client complained to Ms. Deepika Gupta – Hr Head that my Client’s process is not moving ahead and he needs results for the same. My Client further states that thereafter Ms. Deepika informed my Client about Canada Process and told my Client to shift from Ireland process to Canada – Atlantic Immigration Pilot Programme.
14] My Client further states that he had informed Ms. Ritika that he is not interested in the Canada process and he will wait till the Lock down gets over and will proceed with Ireland process. My Client further states that thereafter various mails and repeated remainders on the phone to Ms. Ritika as well as Ms. Deepika also. My Client further states that he had received mail dated – 20/05/2020 from Ms. Ritika stating that if any further opening they received in any other country they will inform my Client accordingly.
15] My Client further states the last mail received from Ms. Ritika was on 04/06/2020 stating that after providing Diploma transcript will proceed further with your case. My Client further states that various mails were sent by my Client and by his Advocate. My Client further states after June, 2020 he didn’t receive any calls from Ms. Ritika, Ms. Priyanka or Ms. Deepika regarding the further update of the Ireland work permit process and till date he has not received any further update either from Ms.Ritika – Case Manager, Ms. Deepika – Hr Head and Ms. Priyanka Mallik – Consultant.
Therefore as per the above Circumstances it is clear that Oceans Outsourcing Solutions and all the above mentioned Directors and staff have cheated my Client and duped him for sum of Rs. 40, 000/- on the pretext of giving job in Ireland and you are legally liable to refund my client the sum of Rs. 40, 000/- within 7 days of receipt of this notice or else my Client will be forced to initiate Police Complaint in the concerned police station and also file Criminal Complaint in appropriate Court and also Complaint in ROC Delhi for Blacklisting the Company.

I had sent notice dated 23/10/2020 to all the Directors of the Company, but the same notices has been returned backed as unclaimed. I want to bring to your notice that in The Ministry of Corporate Affairs website, new two Directors have been added and the names are given below.

The Applicant states they are misleading and submitting fraud documents on the website of MCA.

Till date I have not received any reply for the complaint filled by me. The Oceans Outsourcing Directors are cheating innocent people for no reason and duping their hard earned money. So kindly let me know when my Client will receive his Rs. 40, 000/- paid as consultancy charges for getting Job in Ireland.
