[Resolved]  Orderyourchoice.com — order number #65196 - complaint about cake

I have called concerned OrderYourChoice concerned person to order Red Velvet cake with some fruits to the address Bhavani, Erode on 25/08/2018. They confirmed the Red velvet cake to that address and they said they confirmed this with the Vendor for both cake and address.

After that, I placed order worth of Rs.825 for Red Velvet cake and the order id is #65196. After that, I got call from that team to change the order to Chocolate truffle cake, since that vendor haven't accept the order due to insufficient things to make cake. I'm totally disappointed, but I have accepted that cake since I don't have other option at the last minute. And I asked that, I have paid Rs.825, but the chocolate truffle cake is worth of Rs.698, then they said they will send chocolate for the remaining money Rs.125. I accepted that too and I clearly mention them to write happy birthday message with name and put some fruits in it if possible. They said ok.

But they delivered normal chocolate cake, not chocolate truffle cake. And they kept a bunch of grapes in that cake and they haven't mention happy birthday message also in that cake. Also, they haven't send additional chocolates also. I'm totally disappointed when I see that cake. Actually, the cake was ordered for birthday, and I planned to make it as surprise for my family, but the shop people gave surprise to me when I saw that cake. I have attached the cake photo which they have delivered to me.

After that, I contacted OrderYourChoice team regarding this issue, they said they have provided wrong commitment to me, but this is not my fault. Actually, they haven't confirm this order with the Vendor actually. Also they delivered only normal chocolate cake worth of Rs.150 (500 grams), but I have paid Rs.825. I have asked refund for the remaining amount, but they are not responding to that.

Atlast, I got mail from Manager (OrderYourChoice) that they will refund only Rs.125 (which they haven't delivered additional chocolate), but I have paid Rs.825. After that I asked them regarding this refund, but they are not responding, please look in to my concern.

Dear Customer,

We refer to your Order # 65196. We have intimated to the customer on[protected] that Red Velvet cake is not possible due to long distance and about to cancel the order. But the customer not agreed to cancel and instead they accepted Chocolate cake with a basic design with chocolates. As the chocolate is not delivered Rs.125 shall be refunded back to the customer account. The complaint related to the design of the cake is not valid as per the terms as the design is always indicative in nature. The customer also not paid the additional delivery charge for Bhavani as it is very far from Erode. Nowhere in India Bakery sells cake worth of Rs.125 which is completely unacceptable. Hence the complaint is not valid with related to the complete refund of the amount.

One thing I want to tell that, You have mentioned Chocolate truffle cake, not a normal chocolate cake. Also I haven't accepted that cake too, I have asked you to cancel that order, but you people told me that the delivery person already came to the delivery point. How it could be possible, without confirming the order, how the delivery person could take the order and come to delivery point. It is your careless mistake that you haven't follow up both customer and vendor.

And if it is not possible to deliver the cake to Bhavani, then why you people accept the order and confirm the same. I have sent the mail with address details and asked you people to confirm the address. You have confirmed both the Red Velvet cake and the delivery point. After that only, I placed order for Red Velvet cake. But you people asked me to change the order at the last minute. It is not my mistake, it is your mistake that you people provided wrong confirmation to me that you could deliver the expected cake for me to the address which I have provided. But you haven't delivered that too. If you want, let me know I'll share the email communication details with you people.

Till now, I haven't raise complaint about the design of the cake, how you could tell that I'm asking about the design. I have asked about the worth of it. I have paid Rs.825, but you promised me the Chocolate truffle cake (worth of Rs.1, 198 for 1kg) about 500 grams, so the 500 grams will be Rs.599. But you have delivered normal chocolate cake (not truffle cake) and it is not worth of Rs.599 and surely it will be around Rs.299 or it may be lesser to it. Previously, I have attached the screenshot of how you people delivered to me, can you tell me whether that is truffle cake. I have contacted this with your team people, and they accepted that this is not truffle cake and it is normal cake.

Your comment says 'The customer also not paid the additional delivery charge for Bhavani as it is very far from Erode'. When I place order, I clearly told that it is about 20km far away from Erode, and your people confirmed me that you took order all over India and you can deliver to all the surroundings of Erode. Why you people confirmed the address to me? And you told like I haven't paid the delivery charge. You should prove me that, when you have asked the delivery charge for this and when I have refused to pay that? You should prove me regarding this. If you can't prove this, then it clearly shows that you are a cheater and you should ready to accept that.

Also, I haven't asked you to refund the complete amount. I have paid Rs.825, but you have delivered Rs.299 cake only. So I need refund of Rs.526.

Also You should tell that, if mistake is not yours then why you are hiding. I tried lot of times to contact Manager of your branch, but he is hiding and he is not ready to talk with me. Why you people are hiding and not ready to talk with me, you should tell me the answer for this. I have contacted your team people and asked him to call you and he called you when I'm in the call, but Manager told he will call later and I heard that one. First, tell me why you are hiding, if mistake is not yours.

If you need email chat between me and your team people, let me know I'm ready to attach the same for further clarification.
