PCMC — leakage of my flat due to upper flat

Sir,

This is to bring to your notice that i am owner of flat b2-301, regency cosmos, baner road and i am having leakage issue from flat above me b2-401, i have tried all possible channels of deliberations /request/written complaint to society who arranged meeting but he refused to come, now society is helpless to resolve issue hence request pmc to look into matter.

Subject - severe leakage complaint from your flat b2-401 to the flat below b2-301 of mr. Ajay bamzai (Regency cosmos, baner road, pune)

Respected sir,

This is to bring to your kind notice, myself ajay bamzai, resident of b2-301, would like to draw your attention to the severe leakage in my flat in all the rooms and the passage leading to the common bathroom, this is a serious threat to us as my bedrooms are hugely impacted and i fear any day any mishap can happen as now the water/paint/ debris is coming out each-day.

I would request the esteemed municipal commissioner to order inquiry /inspection and see the for yourself grave danger to life which we are facing and morover it is danger to the structure of b2 building as well.

Till date actionable done from my side.

1. Waited for 03 months, as mr. Suyog was supposed to purchase adjacent flat b2-402.

2. Personal endless phone-call and meeting with no substantial/concrete outcome.

3. Raised complaint to mc on 30th july'2017 as per the trailing mail and support document like photograph attached.

4. Raised the complaint through 'adda' application with no response in-spite of followup mail on 12th august - refer trailing mail.

5. A. My flat visit was done by shri umesh d malasane and shri hemant gadkari on 16th august 2017.
B. Same day i. E.16th august, myself/mc had joint meeting with mr. Suyog raut at his residence - it was decided, that myself will take ownership of arranging vendor for leakage repair of entire b2 building and mc will prioritize leakage repair of my flat.

6. As promised i arrange best possible vendors for repair and mr. Suyog will allow access and finally i was convinced to go with national waterproofing with quotation of 1, 68, 000/- inr

7. The mc / shri suyog - both of you are in loop for quotation received for repair.

8. Based on your communication to me via sms, 17th aug, i had turned up at mc office at 10:00 am but mr. Raut did not turn, i tried to contact him couple of time that day but in vain.

9. Again from two weeks have been trying to allow access but i have been denied till date, tried to message him 2/3 days back with no reply and yesterday also contacted him but it was futile.

10. Agm was help on 30th september'2017 and my cases was moved to grievance committee.

11. 12 octuber got message from grievence comitee - as per by-law 2016 - there is no provision of grievence commitee and hence they cannot persue cases and then againt it was handed over to mc.

12. On 13th octber - mc releases a notice letter to mr. Suyog raut, b2-401 for resolving leakageof my flat on sunday 15th ocober but he refused to come.

Now since all deliberation mechanism like phone call/email/meeting have failed so i am left with only legal option to exercise.

Hence request respected municipal commissioner, shri kunal kumar ji to intervene and help me in my cases.

I am attaching pictures of damage.

A Cat has delivered kittens in our terrace. Many times we have tried to remove them but the cat is become so wild that even we are finding difficult to enter in that area. we shall be grateful if you could kindly make arrangements to remove them as early as possible. Thank you,
