We (Sudip/swapnisha chandratre) made payment on 26th sept, 2015 of rs 170000 (Cash, credit card and debit card) and signed the contract for 30 year membership of holiday package and gym membership provided by priority international. Later, it appeared that the priority international representatives made false and unrealistic promises and we found the deviation in what is promised by sales person and written in the agreement. Important points that raised doubts in our mind listed below

1) deliberate and willful suppression of vital facts
During entire seminar/discussion there was no mention about "non-refundable agreement cost".In addition, we were not allowed to go into the details of each page and the complete agreement was cleverly/intentionally disguised.
The one of the example of intentional disguise is a very loud music being played during sales presentation to keep consumer in confused and hypnotized state.

2) misleading sales approach and fraudulent promises
Amc charges : we were told by sales representative harsha (Mobile no [protected]) that amc charges would remain same for 30 years. However, as per agreement, the clause is totally different.

Gym membership : the sales representative harsha promised to give gym membership for my family with talwarkar gym, baner road for 30 years and also promised that gym facility would start immediately. However, after signing the contract the approach of sales representative totally changed and denied to issue passes of gym membership immediately also told us that we will receive the passes after 2 months.

Free pick and drop facility : sales representative harsha, also promised to give us free pick up and drop facility but agreement deviates.

Additional charges of child bed in europe : this point was never mentioned in seminar and we were totally unaware these additional charges.

Almost all the points mentioned in the agreement have deviation from the promises made by sales representatives.


3) cheat
Credit card charges and interest : we were told that if we swipe the credit card all the charges along with interest will be paid by priority international and payable amount will be converted to emi's. So many times i denied to give the credit card, however 4 to 5 sales representatives gathered around us and literally compelled us to give the credit card just to check the balance and shockingly credit card was swiped for entire credit card limit. This was the act o[censored]tter cheat and priority international using this technique to trap the people get the sign on the contract in confused state.
On the basis of above points, we requested priority international to cancel the contract within "24 hrs" of signing the agreement.

During the meetings held with the sales and customer care staff, it seemed that sales representatives are either not aware of the clauses mentioned in the agreement or intentionally did not provide the complete clarity on important points. Also one of the sales representative even said that "we can give you verbal commitment but cannot write in the agreement" this statement clearly proves that priority international always had the intension to trap customer. The only goal of sales representatives was to collect maximum possible money from the customer and get agreement signed by hook or crook. Post signing the agreement priority international almost blackmailed us by stating the reason that "agreement cannot be cancelled and amount is not refundable under any circumstances". My wife undergone mental distress because of this statement and did not sleep for the week due to of this incident.
The priority international always taken undue advantage of non-refundable clause in the agreement. Apparently, the agreement is one sided and there is not a single clause if priority international fails to provide the service then what? What is commitment from priority international about quality of the service.? What is the guarantee that company will be able to provide service for next 30 years? What will happen to our money if company is closed.? If priority international do not have answer to these questions then it is very clear that the priority international out there to loot the people and it is the serious case of white collar fraud on the name of holiday package.

Despite of several meeting and mails priority international denied to cancel the agreement but agreed to downgrade the contract as per meeting with mr. Shahid (Mobile no [protected]) held on 15 oct, 2015. The minutes of the meeting listed below. Mail is also sent for minute of the meeting to priority international on 19 oct, 2015.

- first contract to be void and replaced by new contract.

-new contract will be done for 5 years (5 week international holidays) and agreed value of contract is 85000 (Inr)

-gym membership facility will not be provided by pihcl

-the amc would remain same (I. E. 7000) per year for 2 adults and 2 kids depending on usage. This clause will be added in agreement

-free pick and drop facility will be provided.

-the cost incurred while credit card swiping (Interest or any other charge) for the particular transaction will be paid by pihcl.

-the remaining amount (85000) to be returned by pihcl either by neft/cheque on or before 25th oct 2015 (As agreed, 10 days after said meeting).

After the meeting, we waited for the refund amount but priority international always had different intensions and resorted to coercive approach to sign another contract in my absence. After so many mails, personal visits and calls finally priority international credited the 80000 rs almost 3 months after the meeting.

During this period, priority international gave us hundreds of reasons was very reluctant to refund the partial amount. The reasons provided were very absurd "aaj nahi after one week", "bimar hu sir", "accounts wale chale gaye", "office main koi nahi", "we have money problem", "kal pakka milega" etc priority international did not even respected their own timeline given in e-mail.

After all of this, we did not want to take any service from priority international, but again priority international pretended to provide us service. Subsequently, we sent mail to priority international requesting for the assurance of the service from their tie-up's but we are yet to receive actionable reply from priority international (See the mail trail (Images) attached with this complaint.)

Now loud and clear that pihcl do not have any intention to provide the service, so moved to consumer court against pihcl. If anyone needs help to file case against the pihcl contact me on email [protected]@gmail.com

Just for information of customers, in very recent cases in consumer court, court has agreed that pihcl is following unethical trade practice (Lure the customer, forcefully sign the contract with "non refundable clause", poor service) that resulted into harassment of consumer. Also ordered pihcl return entire amount with fine.
