[Resolved]  Puravankara Projects — Cancellation charges for apartment

I paid an amount of Rs. 240756 in June 2013 towards initial booking amount for an apartment in Purva Skywood. This was under the condition that Purva would allot 2 covered car parks, as promised by their Sales Person. As per the plan, only 1 covered car park was being given per apartment. However, as we were booking a 4-bedroom apartment and we had 2 cars, we asked for 2 covered carparks (at a cost). The Sales person promised to get this additional car park allotted in consultation with their higher management and it was with that understanding that I gave the advance payment. Later it was mentioned by their managers that Purva Skywood project does not have provision to allot additional car park to any resident. They said at best they can provide a back-to-back car park, which is an operational nightmare. If the car at the back has to be pulled out, one has to wait till the car in the front is moved out. Thus I was fooled by their Sales person. I then wrote to them to cancel by booking. They reverted that an amount of Rs. 100000 would be deducted as cancellation charges. Additionally, an amount of Rs. 6650 would be deducted towards stamp paper charges and the balance only would be refunded. I never got a copy of my allotment letter from Puravankara. I never got a copy of the agreement from Puravankara. They were smart not to handover any papers to me (except the receipt for the advance I paid). The primary reason for my cancelling the booking was due to Purvankara cheating me on the car park matter. They made a commitment for a 2nd covered car park and did not meet it. Under these circumstances it is not correct on their part to deduct Cancellation Charges. Secondly, when the agreement has not been made (they did not give me a copy of any signed agreement), they cannot levy Stamp Paper charges. In effect, they have tpo refund me the full money I paid as advance, plus appropriate interest on the amount since June 2013, as they defaulted on their comitment to me. Regards, Krishnan S. R.

Received a cheque by courier for Rs. 122196 from Puravankara during end-May 2014 . Balance amount of Rs. 118560 still remains unpaid.
