My house on June 05, 2010 was demolished on the order from the Dy. Collector, Mr. Yeshwant B. Tidke as I was not ready to vacate the place on the ground that my house where I was staying is a private land and I had paid rent to my landlord till March 2009 (Staying since last 44 years). I had filed with RTI and even got a reply from RTI that CTS No. 708, 729(pt.), 732 & 732 1 to5 is not yet approved under SRA. I had even written to the Dy. Collector with enough supporting’s to prove that this land is a private land and copy of RTI filing was also submitted. My son had even met the Dy. Collector alongwith the other tenant whose house was also demolished.
Our house was demolished and we were forced to vacate (My family consisting of 9 members – including 3 senior citizens & 2 children). The demolition squad entered our house from the front & back door as if we had committed a crime and they took all our belongings and loaded them into a truck without our permission. Our house was demolished with the help of a Bulldozer and our belongings were dumped into a small house provided by the builder which could not even accommodate half of our belongings and they dumped the rest into another room which was provided to another tenant whose room was also demolished. We had even approached the Police Station to give a complaint regarding the cruel demolition of our house; they also refused to take a complaint.
We have still not got any documents in writing from the Dy. Collector, Builder or Landord on this cruel act of demolition. We do not have any agreements signed with the builder till date. We had visited the Builder’s office on several occasions and even written to the Dy. Collector but we are still to get any reply.
On October 4, 2011, I received a call from one of the tenants in this Society at around 9:30 pm. He had called to inform me that the builder (Himmatlal Kacchara) had given him a call regarding allotment of flats on a draw system. I was completely stunned to hear this as I have still not received any document / agreement signed yet and builder was going for a draw on (October 5, 2011). Of 30 member society, 15 members are not eligible. How is it possible to form a society with only 15 member’s eligibility? This building has 12 floors what does it mean?
During end of December 2011, I received a call from builder’s office to come and collect the keys of the newly constructed building (under SRA name) as the house where my belongings were dumped need to be vacated. The builder said he will get my household belongings shifted with the help of Dy. Collector advice to the house allotted in the building under SRA and then I will have to collect the keys from the Dy. Collector.
I had visited builder’s office during 1st week of January 2012 and had a long discussion with the builder (Himmatlal Kacchara) but with no results. He is only ready to give an area of 269 sq.ft. as per the SRA rule.
The builder has started his construction work on the plot facing the roadside where my house was demolished. I am fighting for my right which I am not going to give up. I am absolutely clear that this plot is a Private land and they are developing it under SRA for their benefit. I demand a house with an equivalent area in the Private building for my house which was demolished which I believe is right and should get it. Require support from everyone in this regard
Now it is also being heard that the builder and the landlord & builder is having a tussle among themselves and the landlord has filed a case for claiming that this land is Private land and not an SRA. This will now be like another case of Adarsh Housing Scam which we need government to interfere and resolve the issue.
