A person is guilty of a public nuisance when he causes any common injury, danger or annoyance to the public or to the people in general who dwell or occupy property in the vicinity, or causes injury, obstruction, danger or annoyance to persons who may have occasion to use any public right. A common nuisance is not excused on the ground that it causes some convenience or advantage. Ghanshyam Mundra, his wife Suman Mundra and his two children who are occupying one room on the ground floor of B Wing in Flat no. 4 have been causing public nuisance in the building compound, ground floor common area and B Wing lift lobbyof which are all the common area maintained by the building trust. The wall of the lift lobby of B Wing has been broken at two places opposite the lift by these persons. The wall of the building near the window of the room they are occupying has been broken. The compound area which is used as a public way and is adjoining the footpath is used to play cricket by the son of Ghanshyam Mundra and his accomplices. Ghanshyam Mundra drives his motorbike on the footpath adjoining the building. Ghanshyam Mundra and his family are causing obstruction, danger and annoyance in and around the building, Maheshwari Mansion at 34 Nepean Sea Road in Mumbai. Was this information helpful? |
