At 09:28 a.m. today, I called Police Control Room for help. The garbage in garbage bag outside my flat is not collected by the garbage picker of the building since the past four days and even today. Rangoli made my me on Diwali day outside my flat was removed the next day without informing me and even the flower torans made by me for the main gate of my flat were removed and taken away. Still the garbage in the garbage bags are left rotting outside my flat near the lift.

Address: Maheshwari Mansion, 34 Nepean Sea Road, Mumbai

Saraswatibai Bishwambharlal Charity Trust which is managing the affairs of the building Maheshwari Mansion at 34 Nepean Sea Road in South Mumbai is registered with the Charity Commissioner of Maharashtra State as Charity Trust. Flats in the building Maheshwari Mansion are given on rent flouting the tenancy laws for personal gains by the trustees. A trustee who assumed office in or about 1995 locked the flat which was used as the Office of the Trust and then locked two more flats one which was adjacent to the office premises and amalgamated both the flats which is illegal. Another flat which was vacant in the building was also locked by the same trustee. Though the said trustee was staying elsewhere in Mumbai, the three flats in the building, all bearing name plates of the trustee, became the address of several shell companies even when the building is a residential building. The said trustee passed away few years ago but the three flats are still being used illegally. A member of Maheshwari family who is also a trustee of Saraswatibai Bishwambharlal Charity Trust is issuing illegal rent receipts for the three flats with malafide motives.

Illegal Activities in the 90-year old building Maheshwari Mansion in South Mumbai

Address: Maheshwari Mansion, 34 Nepean Sea Road, Mumbai 400026

The story and history of people living below my flat in Flat 12 Maheshwari Mansion at 34 Nepean Sea Road in South Mumbai - These inhabitants of flat 12 moved from a garage in a nearby building `Navjivan’ at Nepean Sea Road to this flat in or around 2002, when the heirs of the previous tenant wanted to sell the flat. They bought the flat at a throw-away price to use it for their business and are storing their imported electronic products...

There is lot of noise of coming from flat 26 which is above my flat since 07:30 a.m. today. Today being Saturday, it is vacation time for the family of Dr. Rajeev Sharma and his associates in Maheshwari Mansion. Saraswatibai Bishwambharlal Charity Trust which is a trust registered with the Charity Commissioner of Maharashtra State has let out flats in 85-year old building Maheshwari Mansion situated at 34 Nepean Sea Road in South Mumbai to persons having dubious backgrounds and ulterior motives. It is very hard to digest how the office of the Charity Trust which is flat 8 Maheshwari Mansion has been occupied by a General Physician named Dr. Rajeev Gokulprasad Sharma and his family. The same doctor named Dr. Rajeev Gokulprasad Sharma who poses himself to be a General Physician and travels abroad frequently with his patients from affluent Marwari families has occupied two other flats whose tenants were cardiologist Dr. K. U. Jhatakia and Dr. Patel. One of the three flats let out to Dr. Rajeev Gokulprasad Sharma which is above my flat is presently occupied by people calling themselves to be servants and drivers of Dr. Rajeev Sharma. I am aware that there was a Pizza Delivery Company operated from the same flat by Dr. Rajeev Gokulprasad Sharma. It is very hard to believe and raises suspicion that a doctor who is a General Physician associated with affluent Marwari families is also running a Pizza Delivery Company from a building which is the property of a Charity Trust and also occupying the office of the Charity Trust in the same building.

Since 19th March, 2021, two balconies of my flat in the building Maheshwari Mansion in South Mumbai are enclosed with bamboos. Cyclonic storm had blown away the material used to cover the bamboos. Under the guise of repairs, a hired contractor has broken and damaged the chajjas and parapet wall of one balcony attached to the kitchen and damaged the other balcony attached to a bedroom. Photographs clicked by me yesterday morning from balcony of a room to show how the trustees of Saraswatibai Bishwambharlal Charity Trust registered with the Charity Commissioner of Maharashtra State have been harassing me since 19th March 2021 by damaging my shelter.

The guidelines issued by the health ministry are not being obeyed and complied with by the occupants of flat 18 in the building maheshwari mansion at 34 nepean sea road in mumbai. The building is under the management of saraswatibai bishwambharlal charity trust. Shobana merchant who was convicted last year by a metropolitan magistrate's court has been continuously harassing and causing nuisance and obstruction to me. For all 24 hours, the common passage outside the lift is littered with cardboard boxes and garbage. The building sweeper collects the garbage only once a day at around 9 a. M. For disposal. There are rats in the building but these persons residing in flat 18 of the building have no civic sense and no fear of law. They are being aided in their acts by the corrupt management of saraswatibai bishwambharlal charity trust.

Flats in 80-year old building maheshwari mansion at 34 nepean sea road in south mumbai have been let out on rental basis by saraswatibai bishwambharlal charity trust. Labourers hired by residents of flat 18 on 2nd floor in c-wing have been breaking walls of the building on the rear side. The wooden frame and the glass panes of the window had been removed few days ago and today the labourer is breaking the building wall adjoining the window. I have clicked these two photographs from my kitchen balcony and my bedroom at around 18:15 hours today.

Maheshwari Mansion which is more than 80-year old building at 34 Nepean Sea Road in South Mumbai is managed by Saraswatibai Bishwambharlal Charity Trust. The building has sprawling flats let out on tenancy by Saraswatibai Bishwambharlal Charity Trust. The tenants of flat 18 in C-Wing on 2nd floor have made several illegal additions and alterations in the flat. Earlier they converted the kitchen to bedroom and the master bathroom in the passage was converted to kitchen. The water pipes from the washing area of the kitchen was diverted by extension pipes. The same bedroom which was earlier the kitchen of flat 18 is being renovated. I could see workers removing the window for which they have even broken the wall of the building. Drainage pipes are being tampered with by hired labourers. This illegal construction work on the rear side of the building has been going on since the past ten days from 18th September, 2019.

The Secretary and trustees of Saraswatibai Bishwambharlal Charity Trust claim to be owners of 80-year old building Maheshwari Mansion at 34 Nepean Sea Road in South Mumbai. Illegal additions and alterations and even encroachments are very common in the building Maheshwari Mansion. A truck was parked at the rear gate of the building Maheshwari Mansion at about 2 p.m., on Sunday 20th January 2019. The debris of flat no. 33 on 4th floor which was accumulated at the entrance of the gate since few days, near the garbage bins and under the round balcony of my flat, was filled in the truck and taken for disposal. I am attaching one photograph which I clicked on 20th January, 2019 at 14:27 hours from the round balcony attached to my bedroom.

There is illegal construction going on in the building with the collusion of the trustees of the building and the rules and acts of mumbai mahanagarpalika are being violated.

Some instances of illegal additions and alterations in maheshwari mansion – c-wing are given hereunder -

The building is being ruined and is in danger.

The building maheshwari mansion under the management of sarsawatibai bishwambharlal charity trust is let out to people with no civic sense. Few residents in `c' wing of the building have shifted from chawls in the past few years. There is continuous noise pollution in the emanating from flats in `c' wing. Sometimes the noise is due to illegal construction work going on in flats and sometimes due to people making noise in kitchen with grinding stones. Mumbai mahanagarpalika is requested to keep instruments in the building to measure the noise and take action against the merciless and cruel trustees of saraswatibai bishwambharlal charity trust. Many times i have called the policemen to stop the noise and today i called the security guard to check who is making the noise.

Bamboos have been tied along the building waĺls on the back side of my building since january 2018. Today some labourers have untied the bamboos behind one of my rooms and kitchen. But there are bamboos from the balcony of my bedroom to the balcony of my kitchen. Malafide intentions of the persons who have given this contract to hired labourers is evident from the fact that it took them since six months to untie the bamboos and i have not seen any work done.

A stranger rang the door bell fixed outside the main gate of my flat about 15 minutes ago and asked me to let him in my flat as he wanted to see if there was any leakage in my flat. I told him, "bring police or fire brigade personnel with him because i think you have come to kill me". I asked him as to who sent him to which he had no answer and told me that he is repairing the building. I then told him to wait and i took my smartphone from my computer table and clicked his photo with the building security guard at the main gate of my flat. I have informed the security guard that if i am killed then this man should not go scot free. I am not aware as to who is repairing the building and i have not been informed of any repairs going on in the building.

There is constant harassment, nuisance, obstruction and breach of peace and tranquility in building maheshwari mansion at 34 nepean sea road in south mumbai. The building is managed by saraswatibai bishwambharlal charity trust registered with the charity commissioner of maharashtra state. There are disputes among the trustees of the said trust. Taking advantage of the disputes among the trustees, some ladies residing in the building have been posing as caretakers and managers of the building. One lady renu chokhani residing in b-wing of maheshwari mansion placed two plastic mats, outside the lift and on the marble staircase, in c-wing of the building. I called the officers of malabar hill police station at around 4 p. M today and informed them that i am living on one kidney since past few years and the mats had been deliberately put in c-wing by renu chokhani who is a resident of b-wing to cause harassment, nuisance and obstruction to me.

Maheshwari Mansion is 80-year old building at 34 Nepean Sea Road in South Mumbai. The balcony and chajja of the balcony of flat 32 on 4th floor in `C' Wing collapsed. I saw a van with bamboo sticks being emptied at one of the gates of the building Maheshwari Mansion today at 2:30 p.m. On inquiring with the Security Guards, I was informed that the disaster occurred during the night about five days ago and none of the emergency services were called at the site when the incident occurred. The building Maheshwari Mansion is managed and maintained by Saraswatibai Bishwambharlal Charity Trust which is registered with the Charity Commissioner of Maharashtra State.

These photographs have been clicked by me about 15 minutes ago when i saw a man digging pits on the rear side of the building (In which i am residing) under the balcony attached to my kitchen. The man who was digging has escaped after a woman near the dustbin in the compound saw me watching and alerted him that i was watching him. There is breach of peace and tranquility in the building. It is unknown how the person entered the building compound and with what intention was he digging a hole in the building compound. There are no security guards stationed on the rear side and at the third gate of the building which is also the entrance to the garages of the building.

Water falls heavily from the roofs of the illegally built rooms and cabins on the terraces of flat 33 on 4th floor and flat 37 on 5th floor below into my balcony, on the boundary wall of the building and on the footpath adjacent to the building Maheshwari Mansion at 34 Nepean Sea Road in Mumbai. Illegal construction has been allowed by the trustees and the Secretary of Saraswatibai Bishwambharlal Charity Trust which maintains the 80-year old building Maheshwari Mansion. There is illegal construction in several flats of the 80-year old building. Bathrooms have been converted into kitchens, kitchens have been converted into bedrooms and rooms and cabins have been constructed on terraces of flats in the 80-year old building by several tenants and residents illegally without the permission of Brihan Mumbai Mahanagarpalika. These photos have been clicked by me today when it is raining heavily. The water falls into my balcony and even below on the boundary wall of the building and footpath used by pedestrians. The damp walls have ruined the facade of the 80-year old building and have been gradually weakening the structure of the 80-year old building. A few days ago, a building in the Bhendi Bazar area in Mumbai collapsed and many residents were dead and injured.

Sushila kothari staying with her family of around15 members in a terrace flat on 4th floor of maheshwari mansion-c wing at 34 nepean sea road is creating nuisance in the building. Her son prakash kothari use to spit paan and gutka into my balcony and on the footpath below from above. Her grand daughter had kicked me in my abdomen in 2013 after which i had to undergo surgery at breach candy hospital. Another grandson use to play cricket in the passage leading to the main gate and throw ball on passers by on the footpath adjoining the building wall. Two grand daughters bolted the common main gate of b and c wings on 23rd august 2017. The lift of c-wing of the building is being continuously used by her 15 family members to visit jain temple in matru ashish. The terrace of the flat has been converted to bedrooms illegally. Earlier the same flat with terrace was rented out to the maharaja of bikaner who used it as his guest-house. When the manager of the guest-house mr. D. D. Sharma passed away, the flat was usurped by mr. Raju kothari who was the husband of sushila kothari. The trustees of saraswatibai bishwambharlal charity trust who collect rent from tenants of maheshwari mansion have made a lot of money by legalising illegal possession of some illegal residents in the building maheshwari mansion including trespassers sushila kothari and her family. The trust has no office and a person named mr. Sampat work as the trust's secretary through his mobile phone and security guards of master security force. The said trust is registered with the charity commissioner of maharashtra state.

Duty officer psi chaudhary at malabar hill police station called watchman bhola to the police station yesterday soon after the incident. Complaint is lodged with jio fiber for my internet connection which is dead since yesterday afternoon. Three watchmen in the three wings of the building do not make entries of people and hired labourers visiting the building under the guise of repair work. The management of the building which is a trust has no office which was earlier in b-wing of the building and the secretary mr. Sampat has been sick since a month and works via his mobile phone. Complaint is submitted to higher police authorities also.

Two locals whose identity is not known working outside my flat since last three days were caught by removing electric bulb in the lift lobby and fixing electric switches which could be switched off and on by anyone on my floor and kill me. This is the justice i am getting from small causes court at mumbai and city civil & sessions court in mumbai where cases are being heard since 22nd july 1992. Earlier i stayed as an agent of high court receiver appointed by high court. The judges should pass death sentence now to get me killed if they cannot give justice instead of torturing me for so many years. Police constable kadam from malabar hill police station visited the site and told me that he is taking both the boys to malabar hill police station.

Since last two days, flat no. 26 above my flat has again become a source of noise and nuisance in the building. Complaints given to police, mhada and municipal authorities since november 2015 are on record. Illegal construction in the vacant flat began on 2nd november, 2015. Best undertaking website shows five electric meters have been installed in several flats in the building in the name of devesh sharma, the son of dr. Rajeev gokulprasad sharma. The building built in 1936 is under the namagement of saraswatibai bishwambharlal charity trust. It appears that the trust has been helping dr. Rajeev gokulprasad sharma who is also a director in several companies to launder his undisclosed income and black money and/or to escape prosecution by income tax authorities. The said trust even issued illegal rent receipts of the flat in my possession which is conclusive evidence of the illegal activities of the secretary and trustees of saraswatibai bishwambharlal charity trust. Illegal cosntruction is going on unabated in flat 26 since 2nd november, 2015.

These three photographs have been clicked by me an hour ago today.

First two photographs are of a man who makes noise in the lift lobby of first floor under my flat. He visits flat 12 on first floor daily under the pretext of selling fruits but gossips with the lady residing in flat 12 for hours outside in the lift lobby.

The third photograph is of a man who said he is making noise as he is hired removing paint in the balcony and rooms of flat 12 on 1st floor under my flat.

Complaints of illegal additions and alterations made in entire flat 12 were made by me to mumbai mahanagarpoalika d ward building department in 2002 and also malabar hill police station. Since then they have been enjoying protection of mumbai mahanagarpalika, malabar hill police station and saraswatibai bishwambharlal charity trust which has emboldened them to cause harassment, nuisance and obstruction to me.

The area above the underground water tank and the water pump room on the rear side of the building and the building compound are being misused. There are eight garages on the rear side in the building and one toilet. Saraswatibai Bishwambharlal Charity Trust, BEST Undertaking, Brihanmumbai Mahanagarpalika-`D' Ward, Officers in charge of issuing Ration Cards, Voters' Identity Cards, Telephone Lines, Vehicle Licences and Aadhar Cards are all in collusion and connivance and should be held responsible for the noise pollution, water pollution and illegal construction in the 80-year old building Maheshwari Mansion where I am residing since my birth. Action should also be initiated against all the above mentioned persons and authorities responsible for endangering human life and property in the prime and posh locality on Nepean Sea Road in Mumbai.

Saraswatibai bishwambharlal charity trust, registered with the charity commissioner of maharashtra state, has been indulging in several illegal activities in 80-year old building maheshwari mansion at 34 nepean sea road in mumbai. The secretary of the trust who is shown as constituted attorney of the trustees in several court proceedings and the trustees do not attend the court proceedings in small causes court inspite of being served summons. All of them have illegally transferred tenancies in maheshwari mansion for monetary considerations and gains. Flat 26 above my flat has become a hotbed of illegal activities since the past few years. Earlier it was drivers and servants and now it is carpenters, painters and masons who have been using flat 26 and making noise day and night to cause deliberate harassment, nuisance and obstruction to me. They are mostly working in one room above my computer room and are not visible from the front side of the building. One police officer of malabar hill police station in mumbai who has been recently promoted and transferred from malabar hill police station told me that devesh rajeev sharma and dr. Rajeev sharma have purchased flat 26 above my flat. Illegal additions and alterations are continuing since 2nd november, 2015 in flat 26 with the sole motive of driving me out of my flat where i am residing alone. I have now come to the conclusion that the corrupt secretary and trustees of saraswatibai bishwambharlal charity trust are also involved in sharing the sale proceeds of several flats sold to devesh rajeev sharma and dr. Rajeev sharma in maheshwari mansion.

A car is parked in front of one of the three gates of Maheshwari Mansion. It is one of the three gates which is the entry and exit gate for the garages of the building on the rear side. Though there is a board of `No Parking' affixed on the gate, two cars are regularly parked during the day and night in front of the gate. Some children and an adult man were making noise near the car since 11 p.m. and continued till 12 midnight. When I opened the balcony of my bedroom which is above the gate, they all quickly hid in the parked car. The car bears number plate MH 01 AL 714. After few minutes I heard the noise again. I could not sleep due to the loud noise below my bedroom. I called the Security Guard of C-Wing to ask about the owner of the car. I also asked a person from the building who was entering the building. Then I called the Malabar Hill Police Station. The Duty Officer PSI Chaudhary who came on the line after giving me his name disconnected the phone at least four times. I confirmed the name of the Duty Officer from the person who picked the phone the fifth time. I rang up on both landline numbers of Malabar Hill Police Station viz. 23635513 and 23635517. I rang up again and again for help to get the noise stopped at midnight. Then I rang up Police Control Room No. 100 at around 12:15 a.m. Call No. is noted as S100916/6. A Police Constable came on a motorbike at 12:40 a.m. He went on the rear side of the building with the two Security Guards of the building and warned the adult person who was making noise inside and outside the parked car alongwith with some children at midnight. The Police Officer PSI Chaudhary on duty at Malabar Hill Police Station deserves no respect and should be sacked from Maharashtra Police immediately for dereliction of duty.

I wanted to know the full name of PSI Chaudhary who was on night duty at Malabar Hill Police Station from yesterday night till today morning so that I can lodge a complaint against him for his abusive behaviour and dereliction of duty in the court.

I rang up Malabar Hill Police Station five minutes ago.

The constable who picked up the phone put me on hold and then a person came on the line and said 'I am PSI Chaudhary, You gave me bad words at night.'. I told him I want to know your full name and I have recorded all the calls and will produce evidence of all the calls and conversations before Supreme Court Judges. It is PSI Chaudhary who is guilty of dereliction of duty and woman abuse. He did not give me his first and full name and went on abusing me on the phone today. I rang up again and he was again on line. I again asked him to give his full name. Then I asked him why is he not giving me his full name and then I also told him he is a black sheep in Maharashtra Police.

This officer should be sacked immediately from Maharashtra Police. He has abused me not once, twice but at least six times in twenty-four hours.

There is illegal construction going on in flat 26 in C-Wing of Maheshwari Mansion since 2nd November, 2015. Complaints have been lodged time and again with Malabar Hill Police Station. Even higher and concerned authorities of Mumbai Mahanagarpalika, MHADA and Mumbai Police have been informed of damage caused to 80-year old building Maheshwari Mansion at 34 Nepean Sea Road in Mumbai. The police of Malabar Hill Police Station have been answering all calls made by me to Police Control Room 100. Today I have lodged complaint of hitting my ceiling with hammers at 11:03 a.m. with the Police Control Room. Complaint No. is S02091626. The Security Guard informed me painting work is going on in the said flat 26 but I doubt as in March 2016, BMC officers who visited the flat for inspection wrote to me that painting, carpentry and tiling work was going on in the said flat which comes under tenantable repairs. The illegal construction is being shielded with the collusion of Saraswatibai Bishwambharlal Charity Trust with ulterior motives.

80-year old building maheshwari mansion at 34 nepean sea road in mumbai is presently managed by saraswatibi bishwambharlal charity trust. A security guard named guddu tiwari hired by saraswatibai bishwambharlal charity trust is sitting in the lift lobby of b-wing and is using the electric meter room on the ground floor for his personal use. Today morning at 9 a. M., he removed the pots kept on both sides of the main gate of b and c wings only after i reprimanded him. The potted plants were kept on the footpath used for pedestrians to walk and causing obstruction to enter and leave the small building gate on the footpath. Today in the afternoon, he allowed a driver to play with cricket ball knowing fully well that there are best electric meters on the ground floor and cctv wires and telephone wires are hanging loosely in the 80-year old building. There have been incidents of short circuits where entire building has been gutted in fire. Also in the morning today, a woman residing on ground floor threw a bucket of water towards me when i was walking towards the steps to reach my house. Now i came to know that this woman on the ground floor feeds and offers the watchman guddu tiwari food and tea daily. Just a few months ago i was charged for offence under section 379 ipc by malabar hill police station due to an incident in which guddu tiwari was also an abettor. I was acquitted in the same police case on 8th july, 2016. At that time security guard guddu tiwari was stationed in the lift lobby of c-wing as security guard of c-wing. When the police of malabar hill police station reached my house today for help just now, guddu tiwari has disappeared from the scene of offence.
The police constables of Malabar Hill Police Station in Mumbai made no efforts to trace Guddu Tiwari who had disappeared from the scene of offence on 21st August, 2016. Today when I was entering the building, he instigated a driver working in the building to throw a large throw ball to hit me. Now this watchman Guddu Tiwari is in collusion with some residents, servants and drivers of the building to cause harassment, obstruction and nuisance to me.
