The Case Is Related To Booking A Flat From SHRIPROP LIVING SPACE PRIVATE LIMITED, Bangalore 560080 On 13th Nov 2022 . The Project Name Is Shriram 107° South East Phase 3 Situated At Manchanahalli Rd, Krishnasagara, Attibele Bangalore.
At The Time Of Booking There Was A Wrong Confirmation Made By Builder Side On Project Approval By Axis Bank And Based On Builder Confirmation Customer Who Already Had Axis Bank Home Loan Sanctioned, Went Ahead With Sale Agreement Process (By Paying Rs 3, 52, 162) But In Reality The Project Was Not Approved By Axis Bank. This Wrong Communication From Builder Side Exposed By Axis Bank In Dec 20th When Customer Submitted Sale Agreement, Builder NOC And Demand Letter To The Bank For Loan Disbursal. Customer Immediately Asked Builder For Cancellation Of The Booking And Asked For Refund Through Email Dated 20th Dec 2022 Stating That Wrong Communication Happened From Builder Side But Customer Did Not Receive Reply From Builder Side. After Few Days Builder Started Approval Process With The Axis Bank And It Got Delayed Till Date As On 22nd April 223. Seeing This Delay In Bank Project Approval Customer In The Meantime On 16th April 2023 Again Sent A Termination Request Through Formal Email Stating The Wrong Communication From Builder Side Leading To Victimization Of The Customer. Customer Also Repeatedly Informed Builder To Refund The Booking Amount But Did Not Get The Refund. Being A Diabetic Patient, The Stress Coming Out In This Phase Is Taking A Toll On Customer's Health Day By Day. As Customer Is Not Getting The Refund Of Booking Amount Of Rs 3, 52, 162 And Without It Customer Is Facing Day To Day More Stress Leading To More Criticality On Health.
