Suzuki Motors — Suzuki access 125 delivered with bad quality and high price

Dear Sir / Madam,

I have bought Suzuki Acess 125 from sub-dealer ASMI MOTORS, 319, Sathy Main Road,
Sivananda Mills Bus Stop, Sivanandapuram, Coimbatore - 641035 on 31st Aug, 2017.
The main dealer is GOLDFINCH MOTOR CYCLES INDIA PRIVATE LIMITED, Mettuyapalem Road,
Coimbatore.

They told me that the vehicle is brand new and cost is 74, 000/- and offering 15k discount on account of BS3. They insisted for spot payment of 59, 000/- for vehicle and 1000 for Notary for address proof. I asked them multiple time to confirm the vehicle cost. They confirmed that the actual price is 74, 000 including additional fitting, insurance and registration cost. However they shall offer 15k discount on account of BS3.

I paid the said amount to them on 31st Aug, 2017 through IMPS. They promised me to register the vehicle and handover
to me on the same day late evening.

Later I found that the vehicle is 2014 model and its on-road price is 63, 000/-. I also found that the vehicle is with the vendor since 2014 and thus he finds it difficult with registration and insurance.

I was cheated by the sub-dealer that the price is 74k and offered 15k discount.

The story didn't ended here. After rigorous follow up and frequent visits, they
gave me bike on 12th April but completely in bad condition. I had a serious argument with them but they insisted that I had to take bike and money will not be refunded.

To list few of the issues with bike on delivery:
-- Front mud guard one side is completely scratched and thus they painted to cover it
-- speed meter and odometer not working
-- foot mat is small and not fitting for the Suzuki access
-- There are scratches on bike
-- There is crack in front light indicators
-- Seat is slightly torned and they stitched seat cover to cover it.
-- Initially they told me engine warranty card and tool kit shall be provided and took my signature on invoice.On the next day, they say there is no Manufacturer engine warranty available. Now they say that the bike is very old and thus no manufacturer warranty. Instead sub-dealer says that he will take care of engine issue if any.
-- No tool kit
-- No Manufacturer Manual
-- Sub dealer got insurance done for bike with manufacturing year 2016 instead of 2014. He claims that it is by mistake
-- There are nuts and bolts missing in several parts of the bike. I have complained and they fixed it.
-- They gave bill for 59, 000 from Asmi motors but final invoice is generated as 52, 008/-. However they argue saying that I was provided 15, 000/- discount.

To summarize, they sold a very old bike with many issues for a high price to me. This is completely cheating and thus seek your support in addressing these issues.

I am completely helpless and had to go to consumer forum too if required.
