    A Division Bench of Hon’ble Delhi High Court way back on 31.10.1998 in Delhi Abhibhavak Mahasangh case (AIR 1999 Delhi 124) summarized the conclusions as under: -

    “i) It is the obligation of the Administrator and/or Director of Education to prevent commercialization and exploitation in private unaided schools including schools run by minorities.

    ii) The tuition fee and other charges are required to be fixed in a validly constituted meeting giving opportunity to the representatives of Parent Teacher Association and Nominee of Director of Education to place their view points.

    iii) No permission from Director of Education is necessary before or after fixing tuition fee. In case, however, such fixation is found to be irrational and arbitrary there are ample power under the Act and the Rules to issue directions to school to rectify it before resorting to harsh measures. The question of commercialization of education and exploitation of parents by individual schools can be authoritatively determined on thorough examination of accounts and other records of each school.

    iv) The Act and the Rules prohibit transfer of funds from the school to society or from one school to another.

    v) The tuition fee cannot be fixed to recover capital expenditure to be incurred on the properties of the society.

    vi) The inspection of the schools, audit of the accounts and compliance of the provisions of the Act and the Rules by private recognized unaided schools could have prevented the present state of affairs.

    vii) The authorities /Director of Education has failed in its obligation to get the accounts of private recognized unaided schools audited from time to time.

    viii) The schools/society can take voluntary donations not connected with the admission of the ward.

    ix) On the peculiar facts of these petitions there is no per se illegality in issue of the impugned circular dated 10th September 1997.

    x) An independent statutory Committee, by amendment of law, if necessary, deserves to be constituted to go into factual matters and adjudicate disputes which may arise in future in the matter of fixation of tuition fee and other charges.

    xi) The Government should consider extending Act and Rules with or without modifications to all schools from Nursery onward.”

    The Hon’ble Supreme Court in Modern School case (2004) 5 SCC 583 upheld the validity of the above decision of the Delhi High Court.

    Despite these provision Thakur Public School is hiking fees every Year without consulting with PTA & despite strong resistance & in last 4 years the fees have been doubled, furthermore they are selling Staionery ( Note Book, Text Book, Project File etc. ) Uniform, Shoes which is also illegal.

    Hence there is immediate need to instruct school administration to reverse the hike in fees, refund extra amount taken from student on account of other activity charges.

    dis skul is vry bad
    The management does need to provide explanation to parents but as no of kids are more than school capability, school is charging highest fees in Kandivali area. Nursery is about 48000 per annum (excluding security) and Playschool (42000). There are development charges (don't know what is this), other charges are also not explained properly. Tuition fees is at 7875. Forms are sold every year at Rs 500 for re-admission. Registeration charge is charged every year 1000 per annum and Zadhu Singh Charitable Charges are etc Rs 1000 per annum. All DD are requested in name of Trust and not school. Fees Book is also changed for some reason. All looks fishy. Do not how Govt will control this as they have only defined Tuition fees under school fees. All other charges charged by school are considered internal to school hence, cannot be challenged. If we look tuition fees is not changing but other charges are varying substainly year on year is always revised upwards.
    In spite of paying a huge amount as fees and overheads which are not even explained to parents properly. Teaching standards are worst.Teachers are rude management don't want to face the parents as management themselves are uneducated and illiterate.Teachers don't have command on English language mostly they speak in Hindi. Parents are not treated properly no complaints or suggestions are entertained or thinked upon.Overall teaching standards are not satisfactory parents have to struggle at home to teach their children.Overall it is the worst school teaching wise staff wise
    We are actually getting nothing against what we are paying.Thumbs down for Thakur Public School.
    (Overall expense of an average thakur public school student is around 50/60 thousand per year.
    can anybody explain why and where this amount is spend on our children as after paying a big amount as so called fees we have to pay extra for uniforms expensive shoes(with a compulsion to buy from school) stationary projects and also for sports and annual meet. TPS is not a school actually its just a source to exploit people and mint money with no government checks.

      Non-Refund of School Fees

      Dear Sir,

      I want to lodge a consumer complaint against Thakur Public school, Kandivali East, Mumbai, where I have admitted my 2 kids for admission for year[protected]Nursery & Lower K.G) . I have submitted the withdrawl application on 15th Jan 2008 for the session to start on June 2009. The reason is that we are moving out from Mumbai permanently.

      I have explained the same reason to the school and assured...

      Dear Sir,

      Myself Sonia Vij. I was working as preprimary teacher in Thakur Public School- Thakur Village Kandiwali-East. Now i am shifted to Pune since one year. I have applied for my EPF withdrawel from Thakur public school on 29th Feb-08 however i have not recieved my EPF till date. I have enquired from Thakur public school but every time we are not getting right response from school.

      My EPF number is MH92 685279.Kindly do the needful at the ealiest.

        Dear Sir,
        This is regarding my daughter’s admission cancelation, I taken the admission for my daughter in the school in advance for play group in Oct 2008, for the year (season) ie[protected]school will start from June 2009), I paid the fee of 8000/- Rs in advance for the first quarter ie June 2009 – Aug 2009, Now I am sifting from Mumbai to Nagpur, when I approached the school for the cancelation of the admission & first quarter advance fee refund they refuse to refund the advance fee for first quarter ie June 2009 – Aug 2009 . At the time of admission I purchase the application form for 500/- Rs & paid 2000/- for registration, I have the brochure and receipts given by the school at the time of admission, Its no where written in that the advance fee is non refundable in case of cancelation of admission.
        Please advice me about the legal prospect in this circumstance.
