The Mobile Store — Lose of my phone by The Mobile Store deposited for repairing

I had purchased a Micromax A54 phone on 27.04.2013 vide invoice No. 7720/8931600 from your store No. 3371 in Ghaziabad. At the time of purchase, the company had charged me an additional amount in the name of extended warranty. The wi-fi system of my phone stopped working a few months ago. I approached the same store No. 3371 on 29.01.2015 (please note it is 29th Jan. 2015) for getting the defect rectified. The store manager asked me to leave the phone as it would take around 7 days to get it repaired. When I visited the store after 10 days, they informed me that it is yet to come and asked me to visit again after 3 days. In this way, I kept visiting the store every 3-4 days and they kept uttering the same thing, "Sir, your phone has been sent to Ahmedabad for repair and is yet to be received back". However, every time they were unable to give me a concrete date when I could get my phone. Still patiently I kept on enquiring the store twice a week after a gap of every 3-4 days. Whenever I visit the store, the store employees would call their repairing centre to satisfy me but from their talking, I am sure they might have lost my phone as the people at repairing centre are unable to provide updates about my phone to the store people. In this way, I have visited the store in Ghaziabad almost 10 times in last 35 days but could not get a satisfactory answer from them about where my phone is, leave apart getting the phone back. A service which must not take more than 5-6 days has already taken 35 days and still you are not sure when you would be able to deliver me back the phone. Also, the people at the abovesaid store in Ghaziabad are also very cunning and non co-operatives. They are colluding with the repairing centre persons in causing me so much of harassment. Everytime, the store people would say that the matter is not in their hands and they assure me to update me with latest status over telephone and email. So, every time I provide them my phone number and email ID but never get updates from them on the issue. Even during my last visit on 28th Feb. I requested them to forward me the mail received from the repairing centre but they didn't. I wonder whether you have posted people at your stores to facilitate growth of the business or to get the company shut down by breaking relationships with valued customers. Now, my patience has left me and I am going to file a suit against the company in a local court in Ghaziabad. I have all the documentary proofs including the receipt given by the store to me on 29th Jan when I deposited the phone with them for repair. This mental harassment is not warranted in a civilized society from a company like yours. I am sure from this behaviour of the company, that I am not the only victim of deceit and forgery by your company. But I wish to remind you that everyone visiting your stores is not a fool that you can take undue advantage of. I will file suit for getting a fresh phone of the same model and at least Rs. 5 lacs in damage for mental harassment and wastage of so much of my precious time. I am a qualified Chartered Accountant and very well know how to deal with an unscrupulous company like yours that cheats on its customers. Ultimately, our country is not a lawless land.
