Points as mentioned in the agreement:

Point 32: That the first party undertakes to complete the flat in all respect and deliver possession thereof to the second party upon receipt of the total cost in time within 31st March 2013.

Point 33: That the first party further undertakes to complete the basic surrounding infrastructure and amenities within next three months ie. 30th June 2013 to make the dwelling units habitable.

Point 34: That, it is also agreed that, in the event of delay in completion of construction and delivery of possession of the flat to the purchaser by the above specified date for any other reason rather than mentioned above, the developer first party shall pay compensation equal to the amount of prevailing rental in the locality for the delayed period.

Complaint: This is clear breach of trust and legal agreement by Trishna Skyscraper Ltd’s (BBSR) Director - Mr Satyabrata Dhir as you can understand from above statements. My repeated follow ups and request for updates on the progress of the construction has never been taken seriously by the builder’s office. Also my attempts to meet the Director in person and raise my concern have failed as each time the office staff will lie about his availability.

I have selected this property in the first place as it was approved by State Bank of India (SBI). So being a SBI customer I trusted this builder and agreed to invest my hard earned money in this project as it is backed by SBI Home loan. I have done the down payment and paid the required amount through SBI as per the agreed slab but builder is still not providing a clear commitment on the date of possession of my flat. Also builder’s office staff has denied to pay any late compensation as mentioned in the agreement. They are saying they will consider it at the time of final payment.

Please advise and help me get justice.

Thanks Sanjay for your support and advice. I am already chasing SBI and sent couple of mails to the SBI branch manager and RACPC office to raise my complaint against the builder.

Hello Sushil

Similar case was happened with me when I purchased a flat in Vadodara, Gujarat. Central Bank has given payment to Builder without my confirmation neither verbally nor in written. Finally I got possession after delay of two years when I complaint against builder on consumer complaints portal.

Please chase up with respective Bank authority to get possession from builder.
