Tvs Motor Company — Booking amount

Dear Sir..
My name is Vishal Kumar Singh and I have booked a tvs raider from OM TVS Which is very near to my location. I have paid the booking amount of ( 3000 + 5000 ) /- and waited for around 45 days for my vehicle but they were not be able to deliver it. Finally i have bought the same vehicle from another dealer and asked them to refund my booking amount. But now they are delaying it from last 15 days. Their excuse is like we have used your booking amount in our personal work and will return only whenever we have money. So my question is who gave them authority to use this booking amount in their personal work. It is my humble request please help me to get my money back this is totally comes under fraud.
