Vatika Group — Recovery of accrued rent and security deposit due over the past six months

Representative of Lincoln Developers Pvt. Ltd. and Vatika Ltd.,

I am the current legal owner o[censored]nit No. 607, Vatika City Point, Heritage City, Sector 25, Gurugram, Haryana: 122002 and write this email to raise a demand for the outstanding rent and security deposit rightfully owed to me by Lincoln Developers Pvt. Ltd. and Vatika Ltd.

On 13.07.2021, the ownership o[censored]nit No. 607, Vatika City Point was transferred from the earlier allottee Mr. Arun Aggarwal and Rama Kant Verma to me through the Assignment Form signed on the same date.

As per the agreed terms, apart from a share in the monthly rent, I was also supposed to receive a share of the five month security deposit paid by the commercial occupier of the Vatika City Point office space where my unit is located.

I bring to your notice that till date the five-month security deposit due 6 months ago has not been transferred to my account.
Furthermore, not one instalment of the accrued rent owed to me over the past six months has been paid by your company.
I also bring to your notice the mental harassment and physical trauma caused by your representatives who made me and my husband run pillar to post and make numerous reminder calls during issuance of my assignment letter. The letter was finally issued after a prolonged delay of 79 days on 30.09.2021.

Therefore, I request you to abide by our agreement and transfer the outstanding amounts as follows into my bank account:
1. Appropriate share of the five month security deposit paid by your tenant;
2. Unpaid accrued rent of my unit from 13.07.2021 onwards;
3. Appropriate compensation for the mental harassment, trauma and inexplainable delay caused by your representatives regarding issuance of my assignment letter.

Please note that on failure to swiftly and amiably respond to this email and resolve this issue, I would be compelled to send an official legal notice to the Directors of Lincoln Developers Pvt. Ltd. and Vatika Ltd., and as well as to the Directors of the company acting as tenant of my premises.
The legal notice would claim the above amounts, along with 18% interest arising from the date of the original delay.

Furthermore, such failure to transfer the rent and security amounts due would also compel me to enforce my right and seek transfer of possession of my unit space immediately.
