Vatika Group — Recovery of accrued rent due over the past four months

We are the current legal owner o[censored]nit No. 313-A, Vatika Triangle, Mehrauli-Gurgaon Road, Block B, Sushant Lok Phase 1, Gurugram, Haryana: 122002 and write this email to raise a demand for the outstanding rent rightfully owed to us by Vatika Ltd.

On 03.09.2021, the ownership o[censored]nit No. 313-A, Vatika Triangle was transferred from the earlier allottee Mr. Gurjit Singh Mansahia and Bikramjit Singh Mansahia to us through the Assignment Form signed on the same date.

As per the agreed terms, we were supposed to receive a share in the monthly rent of the commercial space at Vatika Triangle equivalent to our unit size.

However, we bring to your notice that till date of this email on 12.01.2022, we have not received a single instalment of our share of the rent paid by the legal occupier/tenant of our space over the past four months.
We also bring to your notice the mental harassment and trauma caused by your representatives who made us run pillar to post and make numerous reminder calls during issuance of our assignment letter. Our letter of assignment was finally issued after a prolonged delay of 56 days on 29.10.2021.

We request you to abide by our agreement and transfer the outstanding amounts as follows into our bank account:
1. Unpaid share of the accrued rent of our unit from 03.09.2021 onwards;
2. Appropriate compensation for the mental harassment, trauma and inexplainable delay caused by your representatives regarding issuance of our assignment letter.

Please note that on failure to swiftly and amiably respond to this email and resolve this issue, we would be compelled to send an official legal notice to the Directors of Vatika Ltd., and to the Directors of the company acting as legal tenant of our premises.
The legal notice would claim the above amounts, along with 18% interest arising from the date of the original delay.

Furthermore, such failure to transfer the rent and security amounts due would also compel us to enforce our right and seek transfer of possession of our unit space immediately.
