[Resolved]  Reliance Infrastructure Ltd — Unncessary Harassment and addition of wrong charges

Dear Sirs :

My name is Minesh Gandhi, residing at 401, Adarsh Harmony, Rustomjee Adarsh Excellency, Goras Wadi, Malad (West), Mumbai - 400064. My Reliance Inftastructure A/c. No. is[protected].

I had received a letter from Reliance Infrastructure Ltd on[protected] bearing subject : Notice under Section 138 of the Negotiable Instruments Act 1881; Ref.: ECS returned by the bank unpaid. Account No.[protected] Return Doc No. [protected], and demanding for the payment of Rs.1,800/- towards bill amount + ECS return charge of Rs.250/- = Rs.2,050/-.

I immediately replied to them as under :

Dear Sirs :

I refer to my above mentioned account no.

I have received a letter from your office dated 23.10.2009 bearing subject : Notice under Section 138 of the Negotiable Instruments Act 1881; Ref.: ECS returned by the bank unpaid. Account No.[protected] Return Doc No. [protected], and demanding for the payment of Rs.1,800/- towards bill amount + ECS return charge of Rs.250/- = Rs.2,050/-.

I spoke to your office on 30303030 and spoke to one Ms. Sangeeta, who could not be of any help.

I immediately took up the matter with my banker The Ratnakar Bank Ltd, who confirmed that they have never returned any ECS till date. It is to be noted that my average balance with my banker runs into several lakhs of rupees and my banker would never ever return a ECS of Rs.1,800/- with the remarks as “Insufficient Balance”. I am enclosing herewith a letter from my banker The Ratnakar Bank Ltd, which is self-explanatory and also confirms the fact. I demand that the additional charge of Rs.250/- by reversed immediately without any delay.

This is nothing but due to the negligence on the part of your organization and I reserve my rights to claim for the damages due to this irresponsible approach by you. If at all the bank has returned by ECS, I should be getting a returned document alongwith the bank’s seal and signature of the concerned person.

I am the Managing Director of a Credit Information company in India in this field since +25 years and have good contacts with the press. Your negligence has disturbed me a lot and my reputation with my bank and society has been harmed.

I am also giving this in Press and also lodging a complaint with Consumer Forum towards Harassment from you. Besides, I am also going to the court of law a demanding a sum of Rs.10,00,000/- towards compensation for the mental torture I had to go through due to your negligence.

I now demand a immediate reversal of Rs.250/- and a cheque of Rs.10,00,000/- in favor of MINESH GANDHI towards the compensation.

After this I have not received any reply from them and hence seeing no other option I am forced to lodge this complaint with you.

I demand a compensation of Rs.10,00,000/- towards the harassment and mental torture I have had to go through due to this incident and am sure that you would definitely help me in the matter.
