I have purchased a flat in a residential project and was given possession in April 2007. However, till date certain facilities as per sale agreement and sales brochure are not provided in the complex like Close Circuit TV, Children Play equipments, library, cyber cafe etc. Our repeated meeting with the promoter has yielded no result. However, while taking possession of the flat, we have given a letter to the promoter (drafted by promoter) stating that we are satisfied with the project and it is complete in all respects.
Also, the promoter has not yet handed over the maintenance of the project to association represented by flat owners and is presently charging maintenance charges arbitrarily without giving any details of its basis.
Please let me know whether on the basis of above grounds we can proceed legally?
