Air India — Being stopped from travel due to two passports

Respected Sir,
I would like to bring your notice about our regretting situation at Delhi airport on Dec 1 2021 that we are stopped from travel in air india flight AI185 to Vancouver, Canada because i have two passports.

We were waiting in the airport for the boarding pass issuance and we were on time .Since i have two passports and visa printed on old passport, airport officials told that they couldn't update the new passport number in the system due to server down.We checked in the counter on 1 am for the 5.15 am flight. and officials told to wait till the system up and we patiently waited till 4.15 am check in closure time and we couldn't travel due to this.

We confirmed from IRCC side and canada embassy that visa issued in old passport is not a problem to travel unless we showed both passports at the airport.

Me, my spouse and 4 year old daughter waited in the airport for 14 hours.The overall experience from the staff was very bad. Initially they told they will re-issue the ticket but later we understood it was a lie and we left to our hometown.

Now when we checked for tickets we came to know that tickets are available only on jan 14, 2022. Please let us know if you have any options to book the tickets in the upcoming days. I was supposed to report in my office Dec 1.

Please provide the details where to update the new passport number.Can we update by ourselves?

I demand a strong action so that it should not be repeated in future for any other passenger. Also I would like to know, if the flight was overbooked and i was intentionally kicked out.

If the passenger, is willing to reach the Canadian Vancouver international from Delhi as soon as possible the passenger's duty is to have the valid ticket, valid passport, valid visa, if any, mandatory vaccinated certificates, if any.

As the copies of the passports can not bee observed and the state of the unknown system of or inside (the Indira Gandhi international) airport is not in access for anyone, the injured passenger can rely on what is "in his hands" in any possible action.

The attached tickets show that 2 passengers had confirmed reservation for the Dec1, 2021 Air India flight 185 departing 05:15am,
did not attach the copies of "new" and "old" passport, copy of visa for the verification of the validity,
did not attach the copies of the reply of an indefinite staff of the air carrier or of the airport.

The injured passenger can not demand indefinite strong action against unidentified person or against unknown entity at anonymous web site.

The presentation of 2 valid passports can not restrict the right of the passenger for the departure.
Though, the entry rules to Canada demand the air carrier and the passenger departing from India to present the valid entry permit.
The entry permit can be one and only one travel document:
it is the valid passport, which includes the authorization of Canadian authority for the entry in any its page.

If the passenger presented himself for the registration at the air carrier desk of the airport in the time, specified in the ticket and presented the valid travel document along with the vaccination certificate, if any, the employees of the air carrier must make the necessarily corrections of the passport, if any, and to allow the passenger to board of the purchased flight.

The fall, technical or human, of the system can not be a good reason of the refusal to board in specified circumstances.

Moreover, the air carrier departing to the Canadian airport preset the notice regarding the passenger's right of appeal to the exact authority visible to the passenger during the registration procedure at the airport.

The rest actions, which were described by the passenger, are multiple mistakes of the passengers, incurred from the above violations of the air carrier.

Thus, the passenger can hire a qualified lawyer, either in India or in Canada, for reimbursement of losses.
The fee of the qualified Canadian lawyer, if the passenger will demand a reasonable reimbursement from the injured entity, vary from 80 till 150CA$. Number of hours for the assistance depends upon the passenger person efforts and knowledge of legal procedure (assumed about 20-30) in the present case.
The court fee can vary, depends upon the jurisdiction, starting from 100CA$ in Canadian county court.

The fees for Indian lawyer can be[protected] rupees, application and other fees about[protected] rupees, for the presentation of the case before the magistrate (district) court in the residential area of the passenger in India.

The rules allow the passenger to decide on the legal action not later than 2 years from the final reply or of the final application towards the party, which the passenger finds guilty in his losses.
