Amazon India — partial refund done on a product returned which was a fake product

1. I ordered a pair of asics shoes from site amazon in a sale for ruppees 3499.in that they gave me 500 ruppees cashback amount in their own account. I didn\'t apply any voucher manually but their automatically took on certain terms and conditions.
2. Now the seller sent me wrong shoes. He sent me cheap shoes of ginger putting asics brand tag and inside asics shoe box.
3. I called customer care for this matter they said they will investigate. They took 5 days and didn\'t give me any proper reason that why this has happened and asked me to provide the pick up time for it and they will initiate the return.
4. Their app doesn\'t allow initiating a return request by purchaser in case the wrong product is delivered. You have to call customer care and after investigation is done they themselves initiate the return. That\'s exactly what happened.
5 but now they have initiated the refund amount of rs2999 deducting rs500 as cashback received as amazon pay balance account.
6. I called them again they showed me down terms and conditions page
7.in that terms and conditions below point is written - in the event the order is returned by the purchaser or cancelled by the purchaser, seller or amazon seller services private limited, for any reason whatsoever, the order / purchase transaction will not qualify for this offer and the participation of the purchaser will be deemed withdrawn.in the event the order is cancelled in part, the offer may be availed only on the net amount paid by the purchaser basis eligibility.
8. Now tell me isn't it an unfair policy and practice, they are following. They are forcing me to buy from them own site even though the fault was there, from their end. I had to call them again and again, every time new customer executive picks up the call and i had to explain the situation too to bottom. I mailed them sending pictures and everything i did from my end. But instead of compensating me they deducted my amount. I didnt want their cashback. I don\'t ask for it. I didn't apply any any voucher on it. I even didn't cancel the order. I took all of the pain from my side and they are like their system is designed in such way only. Which i think personally is not a fair practice. It\'s not about 500 bucks it\'s about the way they are conducting it. I want to know can something be done on this part legally.
