Apollo Hospital — complaint against apollo gleneagles hospital kolkata regarding negligence of pathologist

Address:53/10 santi ram rasta, 711201

Dear Sir,
In between the lines stated below, I want to draw your kind attention & benign intervention as well.
It has two fold matters -
Firstly, Clinical Injustice which is causing the misuse of money of Patient Party & also may lead to the death risk of my Father Mr. Kanti Lal Mohanto (UHID 1492079) who is a Cancer Patient & a Senior Citizen of Age 66.
Secondly, while drawing attention of Apollo Management regarding the erroneous Histopathology Report, they have misbehaved, even abused like anything like Local Gundas & Mastans & even forcefully put me out from the discussion Table by catching my hands.
Regarding the First Part
With severe pain in Abdomen & continuous loss of Blood through Urine, I brought my Father to Apollo Gleneagles Hospital Kolkata for consultation with Urologist Dr. V Mahendra. On first Visit, he advised for CT Scan of KUB (Kidney, Urinary Bladder). On same day we have done the CT Scan through Apollo itself & met with him. Upon the findings of CT Scan of KUB . Doctor suspected the same as a case of cancer & suggested for immediate operation (T.U.R.B.T & Cystoscopy) for operating the Tumors & examines the Tumor Grade & Bladder Deep Muscle for Biopsy in order to investigate the presence of Cancer & the quantum of Area already affected in inner muscular part of the Bladder.
So, I admitted my Father to Apollo Hospital Kolkata as per directive of Dr. V Mahendra on 13th May, 2019 & on 14th May, 2019 the operation was executed by Dr. Mahendra & the sample of Tumors & Deep Muscle of Bladder Cell was sent for Biopsy in order to investigate the presence of Cancer & the quantum of Area already affected in inner muscular part of the Bladder by Cancer. The Father got discharged from Hospital on 17th May, 2019.
The Doctor has given the Estimation for above Operation & Investigation of Rs. 1.5 Lakhs, but at the time of discharge we paid Rs. 2.13 Lakhs for complete operation & investigation of presence of Cancer & the quantum of Area already affected in inner muscular part of the Bladder by Cancer.
The collected Tumor specimen & Deep Muscle Specimen of Bladder through the operation of T.U.R.B.T & Cystoscopy was processed by Apollo Pathologist & conserved the same in multiple Slides & Blocks in order to investigate the presence of Cancer & its Type & to check whether it has affected or not the deep muscle of Bladder.
On 24th May, 2019 we received the Investigation Report (Histopathology Report – Biopsy Report) met with Dr. Mahendra & he confirmed that it is high Grade Papillary Urothelial Carcinoma, pT2 with Deep Muscle of Bladder affected by the Tumor / Cancer.
Upon the findings of Histopathology Report of Apollo, the Doctor has recommended for immediate 2nd Surgery called Radical Cystectomy in which the amputation of the complete Urinary Bladder Organ was mandatory. The Approximate initial cost of the Operation is near about 6 to 7 Lakhs, as confirmed by Dr. Mahendra, accordingly he has also provided the Admission Note for 5th June, 2019 for admitting the Patient to Hospital for 2nd Surgery of Bladder removal from Body.
Due to involvement of high Cost & just to have 2nd & 3rd opinions, I have communicated primarily with Chittaranjan National Cancer Institute (CNCI). They have advised to submit the Slides & Blocks for review for which the Apollo Management already tested / assessed & declared it to be as high Grade Papillary Urothelial Carcinoma, pT2 with Deep Muscle of Bladder affected by the Tumor / Cancer.
After review, the CNCI has confirmed that it is high grade papillary Urothelial Carcinoma, but deep Muscle invasion is not seen in slides & blocks supplied by Apollo i.e. Deep Muscle is free of Tumor / Cancer which differs / oppose Apollo Report.
Then we communicated with Tata Medical Center (TMC) for 3rd review as we have found mismatch in Histopathology Report between Apollo & CNCI. The TMC has also requested for submission the same Slides & Blocks for review.
After review they have also confirmed the same as CNCI that it is high grade papillary Urothelial Carcinoma but Deep Muscle is free of Tumor / Cancer which also differs / oppose Apollo Report.
We intimated the same to Apollo Management Dr. Partha regarding this mismatch of Histopathology Report on 31st May, 2019 through WhatsApp & Dr. Partha confirmed via WhatsApp that their Report is correct.
As per Apollo Histopathology Report (HPE) As per CNCI Histopathology Report (HPE) As per TMC Histopathology Report (HPE) Remarks
Papillary Urothelial Carcinoma Papillary Urothelial Carcinoma Papillary Urothelial Carcinoma All 3 Findings are same
High Grade High Grade High Grade All 3 Findings are same
Tumor invades muscularis propria i.e. Deep Muscle is affected by Tumor Deep Muscle invasion Not seen Deep Muscle is free of Tumor TMC & CNCI Findings are same but both differs / oppose the Apollo Findings
Treatment requires Organ Amputation No Organ Amputation required as per review report No Organ Amputation required as per review report TMC & CNCI treatment process differs Apollo treatment process due to different HPE Findings
High Cost involved in Surgery – Approx 6 to 7 Lakhs (Initially) Low Cost Involved as no Surgery required at present as per review Low Cost Involved as no Surgery required at present as per review

For this mismatch, other 2 Establishments TMC & CNCI has suspected that the required number of slides & blocks needed to be delivered to the patient party was not delivered by Apollo. Upon drawing their attention at meeting with Dr. Partha – Assistant Director of Apollo Management & Dr. Enam Khan – Director of Pathologist on 10th June, 2019, Apollo has denied such & told that all the slides had been delivered to patient party against payment.
Had it been so, then a simple Questions arises that based/depending on the same Slides & Blocks, how can 2 other renowned health organization namely TMC & CNCI opined completely different with Apollo, point to be noted that the other 2 organization are of the same view.
So, due to this inconclusive erroneous Histopathology Report, the both TMC & CNCI has suggested to repeat the First Surgery Cystoscopy & T.U.R.B.T in order to take the specimen of Deep muscle of Bladder & Tumor & to send the specimen for Re-Biopsy for getting clear picture on Histopathology Report for further course of treatment.
As we spent already more than 2.13 Lakhs in Apollo for the same Operation & investigation & as other 2 renowned health organization TMC & CNCI have suggested to repeat the operation & investigation due to mismatch findings between Apollo Histopathology Report with review report of TMC & CNCI, so we put a written complaint to Medical Super of Apollo Dr. Partha on 10th June, 2019 for justification of mismatch of Histopathology Report with other 2 renowned Health Organization.
During the Meeting with Dr. Partha – Assistant Director of Apollo Management & Dr. Enam Khan – Director of Pathologist on 10th June, 2019, Dr. Enam Khan promised to review the balance specimen available with them & confirmed that he will inform the findings by very next day. Dr. Partha has also promised to provide justification reply of my written complaint by very next day.
On very next day i.e. on 11th June, 2019, I went to Apollo to meet with Dr. Parth & Dr. Enam Khan, but Dr. Enam Khan did not meet with me as per his promise & due to unknown reason the review Report of Balance specimen was not provided to me till date.
On the contrary the very next Day Dr. Enam Khan has denied to have a conversation with me & I was also not permitted. More to that, Dr. Partha & his team have tried to force / convince me to re-admit my Father to Hospital & repeat the earlier operation (TURBT & Cystoscopy) instead of giving me the review report of balance specimen as promised by Dr. Enam Khan on 10th June, 2019.
It indicates & also quite evident that there must be some confusion / error in their finding of Histopathology Report, that’s why they are pressurizing me for re-admission & Re-operation & repeat investigation instead of providing me the review report of balance specimen as promised by Dr. Enam Khan on 10th June, 2019.
On 12th June, 2019 the Apollo Management has given me the Written Reply of my Complaint through their Security Manager, without meeting with me. In their reply, they have tried to conclude the case by stating that the tumor is muscle invasive by co-relating the Pre-Operation CT Scan Findings, not from Histopathology Findings. They have not given any comments on Histopathology Report or review Report & simultaneously also advised to repeat the operation TURBT & Cystoscopy with Investigation at free of cost by Apollo Management
Now Questions are::
1. If the Case had not been reviewed by other 2 Establishments, we would have to go under 2nd Surgery Radical Cystectomy as advised by Apollo Dr. Mahendra, which is nothing but amputation o[censored]rinary Bladder, who could be the responsible of this act of operation & surgical Activities?
Whereas both TMC & CNCI recommended (as per review) for only Medication (BCG Injection), & there is no need of Surgery at present.

On asking the same Question to Apollo Dr. Mahendra, he has clearly told that he suggested as per Histopathology Report, if there is any mistake in report, he could not do any comment on that. It should be answered by Pathologist & he has also suggested repeating the Operation.
2. Why the Report of other 2 renowned Establishments who has been extending this Service exclusively for the Cancer Patient with fame & faith, are totally different with Apollo?
May be due to the profitability of Apollo’s own Financial Status by unauthorizely diverting it to Surgical
3. Why in their reply to my complaint dated 10th June, 2019, knowingly they have hidden the findings of Histopathology Report after review or pre-review?
4. They themselves were not confident of their Histopathology Report, very doubtful of their findings as preliminary they have demanded it to be very authentic (confirmed by Dr. Partha through WhatsApp dated 6th June, 2019, but post pressurizing by me, they agreed to review the balance specimen, but as previously told no reports was submitted to me till date. On the contrary, they have opined to re-operate the same immediately at FOC.
It is evident the preliminary Report was not at all authentic, that’s why they were agreed to do the same operation at free of Cost as mentioned in their reply dated 12th June, 2019, stating it to be a Good gesture towards Patient.
Regarding the Second Part
Had it been so (Good Gesture to Patient ? ) then,
Is it Good Gesture to misbehave, using abusing languages, forcefully to put anyone out of the discussion room by their so called Security Manager Mr. Uttam Chakraborty??
Where was the gesture then?
Feeling harassed while discussing My Father Case, with Apollo Management on 11th June, 2019 regarding erroneous histopathology report issued by Apollo which is causing delay to start the treatment for cancer. While discussing the case at Apollo Gleneagles Kolkata, their so called Security Manager Mr. UTTAM CHAKRABORTY & Dr. Partha team have tried to physically harass me & also abusing with me. Mr. Uttam has also given me life threat which has forced me to put General Diary against him at phoolbagan PS.
General Diary No # FGDE -788
They are trying to suppress my voice against their negligence towards one's life. Committing mistakes, confusing Patient by inauthentic reports, but forcing people to shut the mouth up so that the real truth cannot come out – could not be a sign of Good Gesture to Patients.
I strongly protest the condemn against this inhuman treatment from Management of so called prime health Institute of Eastern India (self-proclaimed in their reply).
Consequences of above Incidents to Patient & his Party.
1. Delay in Cancer Treatment

Due to erroneous & confusing Histopathology Report issued by Apollo & due to negligence of their Pathologist, the Cancer Treatment of my Father has not being started even after 1 month from First Surgery or date of detection of illness.

2. Increasing of Treatment Cost of Patient Party owing to repeat the same operation for negligence of Apollo Pathologist or incorrect reporting by Apollo Pathologist

Due to negligence of Apollo Pathologist & its Management, the entire Establishment (TMC, CNCI) including Apollo Dr. V Mahendra have suggested to repeat the same operation & investigation. We spent 2.13 lakhs for the first surgery where the same surgery can be possible only in 75 thousands at other nursing home. We spent money without getting any treatment & now again we have to repeat the same operation for re-investigation as earlier Investigation was not done carefully by Apollo Pathologist.
3. Chance of Spread out the Cancer Germ in other organs due to delay in treatment.

Delay in starting the treatment due to this erroneous Histopathology Report may cause harmful to patient as it is high grade tumor so the cancer germs may be spreaded to other organs.
I would request to ensure to get justice in both facts stated above.
Now at the end, I am requesting to provide me Justice in this regards as appended below.
1. I have no faith on Apollo Management anymore after this kind of harassments both physically & mentally, more to that a human beings life who is seriously ill, was neglected like anything.
Please mind it that till date my father is yet to get the appropriate treatment seriously needed right now due to this confusion, misconception & improper erroneous Histopathology reports of Apollo Gleneagles Kolkata.

So, I don’t want my father to be treated by so called Apollo Kolkata. So, either they should repay me the Total Expenditure, I have had to bear for my Father treatment in Apollo that amounting to 2.13 Lakhs or they should bear the expenses needed for repeat the same operation (due to negligence of their Pathologist), that amounting to Rs. 75000 under Tata Medical Center instead of 2.13 Lakhs at Apollo

As Apollo Management has promised at their written reply to do the repeat operation of amounting 2.13 lakhs (as per IP Bill during First Operation) at Free of Cost, so it can be expected that they will have no objection to bear the Expense of Operation of Rs.75000 by TMC where Apollo took 2.13 Lakhs for same operation. It will be cheaper for them.

So, I am requesting to the Secretary of West Bengal Clinical Establishment Regulatory Commission to get back the value of my money of Rs. 2.13 Lakhs which I spent at Apollo for operation of My Father. Due to negligence of Apollo Pathologist & Management, I will have to repeat the Operation.
As while discussing the Case with their Management, they have tried to harass/assault me physically with abusing languages & their Security Manager Mr. Uttam Chakraborty had threatened me which has forced me to dial 100 & record a General Diary to Phoolbagan PS against him.(GDE # 788)
So, in such situation, it will be not possible to re-admit my Father to Apollo to get the free of Cost Treatment in order to rectify their Mistakes.
So, I have planned to repeat the Operation through Tata Medical Center. Please find the Estimation Cost of Operation .It is only Rs. 75000 where the Apollo has taken 2.13 Lakhs from me for same operation.
So, I need your help to get the Justice & value of my money. The Expense of repeat operation of Rs. 75000 should be borne by Apollo - Kolkata
Requesting your Co-operation to get the Justice
Thanking You,
Regards,

I frequently asked to the staff of reception of Apollo Gleneagles Hospitals, Kolkata Byepass about the norms and system of Ecocardiography and USG of Prostate. But the staff all times answered only the fees/ charges and leave the call without giving other information like process that is empty stomach or time.
