Respected Sir,
1. I am the legally wedded wife of Late Shri DHIRAJ GUPTA, who expired on 15.08.2025 due to cardiac arrest. Out of our marriage, a son named Mr. Dhruv Gupta was born, who is a minor studying in Class 10th.
2. After the death of my husband, my two brothers-in-law have illegally taken possession of certain movable properties belonging to my deceased husband. They are also adopting frivolous techniques to deprive me and my son from our rightful share in his estate.
3. During the lifetime of my husband, he had purchased an Insurance Policy from Bajaj Allianz Life Insurance Company Limited, Policy No. [protected]. At the time of purchase, I was the nominee in the said policy. However, without my knowledge, the name of the nominee was later changed using mobile phone of my husband. Further, I am the nominee in all the bank accounts belongs to my husband.
4. Importantly, the original policy documents are still in my possession. Despite this, my brothers-in-law are attempting to fraudulently claim the proceeds of the insurance policy on the strength of their alleged nomination.
5. I had approached the office of Bajaj Allianz office situated at Ghaziabad through my Advocate, but was informed that the company would disburse the claim to the nominee, irrespective of the rights of Class-I Legal Heirs. This is against the settled position of law that a nominee is merely a trustee, and the insurance amount is ultimately payable to the legal heirs of the deceased policyholder as per the law of succession.
6. Shockingly, my brothers-in-law even offered a bribe of Rs. 50, 000/- to facilitate the wrongful processing of the claim in their favour.
7. I am a housewife with no independent source of income, solely dependent on the insurance claim amount for the survival and education of my son. If the claim is wrongly disbursed to my brothers-in-law, it will cause irreparable loss to me and my minor child and lead to unnecessary litigation.
In view of the above, I humbly request the Hon’ble Authority:
• To immediately intervene and issue necessary directions to Bajaj Allianz Life Insurance Company Limited not to disburse the insurance claim amount to the nominee, and to hold the claim in abeyance till the matter is finally adjudicated by the competent court.
• To safeguard the rights of Class-I Legal Heirs i.e., myself (widow) and my minor son.
• To direct the insurer to act in compliance with the established law that nominees are only custodians, and the actual entitlement lies with the legal heirs.
I am also in the process of approaching the competent Court, but the same will take some time. In the meantime, your urgent intervention is necessary to prevent injustice and protect the rights of Class-I Legal Heirs.
I request your kind office to take necessary action at the earliest.
