My Father Late Lallan Jha had purchased a Hyundai Verna Car which is insured by Bharti Axa General Insurance Co. Ltd. Unfortunately Car got a major accident while we were coming from our native village to Kolkata in which my father was spot dead and we all our family members were severally injured. As car was total lost we approach to the said company for insurance, they take three months for inquiry and processing. After several reminders for on me, they decline the claim with reason that we were six people in the car including driver at the time of accident. Sir regarding this I want to say that they have not mentioned in their policy that maximum five person including driver, if my father knew the same then he never travel with five person as he was a very good person and follower of rules and regulations, I want to say also that the cause of accident was not a number of person as my father was only sitting beside the driver and I with my mother, sister (Age-21) and brother (Age-16) at back seat. Sir we all are very thin and was very comfortable to seat. My father had taken loan for purchase of vehicle which is due and we are very suffering financially after death of my father. Sir we are helpless as the company has decline the claim for the reason which was not a reason of accident. I mailed to the grievances of the said company but after the several reminders, they have not replied me. The company has not given us the death claim also. They have cheated us. Therefore you are requested to please help us. Ref. : Claim No. –C0663750 Policy No. – S80228006. Sub. : Claim of Vehicle No. WB 02 AF8873. With reference to your letter having Ref. Claim No. C0663750 Dated 12.01.2015, we would like to inform you that you have stated in your letter, Six persons including driver were on board at the time of accident, which is violation of the Motor Vehicle Act -1988. In this regard we would draw your attention that you have not mentioned anywhere the clause of Motor Vehicle Act.-1988 to refer the said subject. We referred Motor Vehicle Act. – 1988 : Driving vehicle exceeding permissible weight is an offence. Which was followed by us, as it was not over weighted. I would like to inform you also that we were six persons on board including driver due to some problematic circumstances. As per your spot survey and all the relevant verification you can clearly observe that the number of persons was not a reason of such misshaping as my late father with the driver were only two persons on the front sheet of the car, which couldn’t hurdle while driving. In relation to your statement regarding misrepresentation of fact, we clearly stated in our letter about that fact. At last I want to say that who will believe on such type of insurance company ( Bharti Axa General Insurance Co. Ltd. ), who don’t process such crystal clear accidental claim. At the time of insuring or we can say taking money from us you don’t educate such type of fact on process of our claim you come under the number of rules and regulations.
