In short,
If sharing OTP to facilitate RC transfer is “ILLEGAL”,
- then Cars24 is doing it for its customers, and is subsequently charging them INR 10, 000 by accusing them of being Non-Cooperative, after actually inducing them to do it. The government needs to intervene.
If sharing OTP to facilitate RC transfer is “LEGAL”
- then Cars24 is cheating its customers – by first telling them that it is possible and later by accusing them of following this method and being supposedly Non-Cooperative during Party Peshi. It is a complete trap, planned in advance.
Sequence of Events for me -
I clarified before our engagement that the car owner travels out of state on work frequently, and may not be available at short notice to go to RC transfer. I was told it wont be needed as it is not mandatory. That INR 10, 000 will be withheld till the RC transfer is done, or for a maximum of 120 days.
Car was handed sold on 26/10/2022 and 10, 000 INR was withheld as discussed.
I got a call from Cars24 support after 2 months asking for Party Peshi. I expressed my concern and asked him to talk to their agent who was dealing with my account, and in turn, called the agent and shared the details of the call.
I was asked by the agent to talk to the car dealer who was the intermediary in the sale, and follow the OTP process for RC transfer which happened on 27/12/2022. I did exactly as I was told by the Cars24 agent.
RC transfer happened and then I was accused of not being non-cooperative during RC transfer, and therefore, denied INR 10, 000 saying that I had to forfeit the amount as a result.
I have asked CARS24 support the following questions to which no answers are being given:
• If it is legally binding to be present in person for the RTO transfer, how did it get done in my case if I was not there in person?
• Does the RTO charge a fine of INR 1000 if the seller is not present in person?
• Who has entitled Cars24 to withhold INR 10000 when the RC transfer has happened in a flawless manner with my complete support? ( I did exactly what the Cars24 Agent asked me to do – share OTP with Car Dealer )
• If the RTO transfer has happened already, which law gives you the right to withhold the money?
In either case, if you are a customer, you are jacked of INR 10, 000. Their support team is completely useless. They will never listen to your exact problem and try to address it. Their primary aim is to purposefully confuse and trouble the customers the moment the transaction is done and INR 10000 is withheld.
Desirable Resolution: Pay me INR 10000 that has been withheld.
