Hi ALL, The same thing happened to all o[censored]s also. We went to visit Goa during first week of September-2015, and we were caught by Club Jiva agents in Dona Paula on 4th September-2015, saying that we are so lucky that we got a gift and to bring that gift we have to go to the one of their own resorts which is Sandalwood Hotel & Retreat Vainguinim Beach, Dona Paula, Panjim, Goa. the people who caught us did not give us a moment to think and immediately asked us to follow them on their bike.(WE had also rented a bike) . . Once we reached there, these Club Jiva employees made us sit for 30 minutes and in the meanwhile asked us to show our ID Proof & Credit Cards that we have and asked us all our personal information on how much limit do we have in these credit cards. Then took the Xerox copies of my Pan Card and all Credit cards that we had and they told us that it is important for them to take these copies to give the Gift. After that they said we have to attend some presentation of 1 hr. however Unfortunately the presentation went for some 4.5 hrs. Then they brought some other employees of Club Jiva, namely Shruti Pandey, Melville Fernandes, Kalpana Biswas and these three employees took back our gift card first without scratching the options on it and then took us to one another office room inside the same Sandalwood Retreat to give us Presentation on Club Jiva, and during that time, Their 3 Sales Agents, Shruti Pandey, Melville Fernandes and Kalpana Biswas from Club Jiva Marketing team, gave us a booklet and list (Xerox copy) of 77 IRA list of resorts, where-in they repeatedly informed us that once we pay Rs. 140, 000.00 upfront, and the maintenance amount of Rs. 4900.00 once in 2 years, there is no need for us to pay anything else While utilizing our holiday week in any of the 77 IRA list of resorts plus the 8 own Home Properties of Club Jiva (Which Club Jiva employees informed that these 8 resorts completely belong to them for a lease of 99 years), plus 2 hotels/resorts in Switzerland. Also, one another commitment was given to us that if we become a Club Jiva member we shall receive the DAE Gold Advantage card valid from 2016 (day of activation) till 25 years. And additionally they also promised us that in Bangalore, we would get the 25 years membership of The Club (Mysore Road) Bangalore, valid from 2016 (day of activation) till 25 years, and we need not pay anything for it. We wanted to check on any feedback of Club jiva as We wanted to check the credibility and goodwill of Club Jiva amongst their members/customers on cellphone internet or by calling our friends, who have similar memberships, however we could not get any mobile network at their Club Jiva sales office (we suspect after discussing with other victims that they had used cell phone jammers.) . Due to tremendous persuasion and Pestering and repeated forcefully offer from Club Jiva Employees/agents, we seem to have been Misled/misrepresented /cheated to take the club jiva membership, When we asked about what are their terms and conditions, they said there is no harm in paying first as they have a 30 days refund policy, wherein if a member is not satisfied, he can ask for full 100% refund of his membership amount. When we asked them to give it in writing, they informed us that first we should pay the money, and in the meanwhile, they are asking Kalpana Biswas (one Club Jiva employee) to type all these terms and conditions that they informed us and bring. We paid Rs. 140000 (Rs One Lakh Forty Thousand). We asked the documentation and after taking all our money, they gave us the agreement and asked us to sign it first as we have already paid the money and asked us to go through it afterwards once we reached our place. That is the first time we suspected and asked them to give all their commitments and promises in writing on email to us, which they said they would do next day, and we are going to get a welcome kit from their Mumbai Support office. After that we were informed the Gift option as B which is same Free Holiday option that Club Jiva gives for all the customers as usual, after only pretending the other gifts, in order to Lure and bring the people to their rented office where their Sales/Marketing team can fool them with all fake commitments and trap them in an unfair and illegal manner, and duping/cheating them of their hard earned money (and never fulfil any promises/commitments made earlier and illegally use their money as an investment amount in Club Jiva business sought by misrepresentation and unfair means. We came to know about their modus operandi in next 2-3 days. In evening when we reached our place, we checked their feedback and credibility on internet and we were shocked to know that Club Jiva has a very bad name and very bad reputation in the clubs and recreation market and we saw so many customer complaints available openly on the internet. Also, there were some thousand ruppes money and my handycam missing from my bag, which we suspect either employees /agents of Club Jiva have stolen... Because of coming to know the reality of Club Jiva and very bad reputation that this Club Jiva/ Holiday Kart pvt ltd has in the market, next day we went again to Sandalwood retreat and asked them to refund our entire amount, and return what they have stolen from us. They refused to refund our amount of Rs. 140000.00 at that time, and didn't accept the theft ? As we have been observing seeing all Club Jiva Victims, Club Jiva / Holiday Kart pvt ltd (Ananta Oorjaa venture) Support team has been continuously changing their statements every now and then, deviating from what was promised to us in the beginning, leaving us no option but to forcibly take a legal action on them. Thank God that you people as Tourists in Goa, escaped the clutches of Club Jiva without paying anything, For us we are still fighting a legal battle and complained in the police station in order to get back our hard earned money which they duped us with. The modus operandi of Club Jiva is to lure and bring people to their rented office, make people members, forcefully and wasting time (and theft of these new prospective member's belongings ) that’s too in a vacation. You also please file a police complaint on them, so that every rightful tourist coming to Goa on a vacation should not fall prey to Club Jiva, and get cheated ultimately... Goa tourism should also take an immediate action on this Club Jiva asap, please also file a complaint in http://www.goatourism.gov.in/ and send them your grievances on dir-tour.[protected]@nic.in, The Goa tourism after coming to know all these malpractices by club jiva would definitely take an action to ensure the safety of tourists, let's try to save the other innocent tourists at least...

It's already 19th November, and there is no trace of any refund till now. In fact none of your employees including yourself don't even pick the calls, nor are responding to any emails. Since I was asked by your company to mark my complaint on "https://www.consumercomplaints.in" as resolved?????

Under the circumstances, As per your companies own commitments, you have only 1-2 days time to process the refund, failing which we will be constrained to approach the court of laws under both civil and criminal laws and you and your companies shall be held entirely responsible for the cost and consequences thereof. All the necessary proofs would be presented to the honourable Court as well as police complaints would be immediately pursued.
Request to please close this in a decent way while we have some time.

I was promised for being given refund till 20th November-2015, However, It's already 19th November, and there is no trace of any refund till now. When will I get my refund ?
Do refund dates change by employees changing the companies ? pathetic.
Hello Consumer Complaints forum,
As per the discussions with club jiva member relations team, they don't force anyone to remain a member who doesn't have a genuine need of a timeshare membership and wants to disassociate, As we personally have many commitments and can't use their services because of time constraints, club jiva member relations team has allowed us to cancel the membership and currently processing the refund, hence I do not seem have any complaints against them, as long as entire refund is processed asap.
