Subject: Legal Notice for Cancellation of Membership, Refund of Membership Fee, and Nullification of Annual Fees – Membership ID 2476192

Dear Sir/Madam,
1. Background:
I, Saurav Srivastav, had subscribed to Club Mahindra Membership ID 2476192 under the impression that it would provide flexibility and accessibility to resorts as per my needs. However, due to Club Mahindra’s unfair trade practices, deficient services, and failure to provide the promised benefits, I had formally requested cancellation of my membership on 1st December 2016 through Service Request No.[protected], and multiple follow-up emails dated 4th, 14th, 28th, and 29th November 2016. Despite repeated communications, my request was not honoured, and no response was provided to my grievance.
2. Unjustified Upgrade & Misrepresentation:
• I initially subscribed to Club Mahindra’s White Studio Membership, but Club Mahindra representatives persuaded me to upgrade to a Red Studio Membership, promising additional benefits and better accessibility to resorts.
• For this upgrade, I was charged an additional INR 2, 55, 621, bringing my total membership cost to INR 4, 87, 152.
• However, the promised benefits were never realized; resorts were frequently unavailable when required, and the membership failed to provide the ease of booking that was initially assured.
• This constitutes misrepresentation, unfair trade practices, and breach of contract, as I was induced to pay a significant additional fee under false pretences.
3. Violation of Consumer Rights & Unfair Trade Practices:
• I was charged INR 4, 87, 152, including Annual Subscription Fees (ASF), while other members were charged significantly lower fees for the same membership type in the same period.
• The membership turned out to be impractical as resorts were rarely available when required, rendering the subscription useless.
• The costs associated with the membership (including mandatory food charges) are exorbitantly high compared to alternate options available in the market.
• Some Club Mahindra resorts (e.g., Club Mahindra Pawna in Lonavala) are operated without clear statutory approvals, exposing members to legal uncertainties.
• Customer service is unresponsive, failing to address my repeated concerns and cancellation requests over the years.
4. Unjustified Annual Subscription Fee (ASF) Demands:
• Even after I formally requested cancellation of my membership in 2016, Club Mahindra continued raising ASF invoices against me.
• Since March 2021, I have received unjustified ASF demands, despite having moved out of India in June 2019 and becoming an Australian citizen, making it impractical to avail the membership benefits.
• Club Mahindra's failure to acknowledge my cancellation request and continued ASF demands are unethical, arbitrary, and legally untenable.
5. Relief Sought:

In light of the above, I hereby demand that Club Mahindra:
(a) Immediately cancel my membership (ID: 2476192) with confirmation in writing.
(b) Nullify and waive all past ASF claims raised since 1st March 2021, as they were levied after I ceased being a resident of India and had already requested cancellation.
(c) Refund the total membership amount of INR 4, 87, 152, including the additional upgrade fee of INR 2, 55, 621, along with interest at 12% per annum, from the date of payment until the date of refund, for non-performance of contractual obligations and unfair trade practices.

7. Legal Recourse:

Should Club Mahindra fail to take the necessary corrective action within 15 days from the date of receipt of this notice, I shall be compelled to initiate appropriate legal proceedings against your company before the Consumer Disputes Redressal Commission and other competent authorities, seeking full relief, damages, and compensation for mental agony, financial loss, and harassment caused to me.

You are hereby urged to treat this notice with due seriousness and respond in writing within the stipulated timeframe.
