[Resolved]  Ansal API — DELAYED POSSESSION OF FLAT AT MOHALI

I WANT TO BRING TO YOUR KIND NOTICE THE INJUSTICE DONE TO ME BY ANSAL API BY UNILATERALLY AND NO FAULT OF MINE LEVYING INTEREST ON ME FOR THE FLAT NO 360 GF SEC 114 GOLF LINKS MOHALI.

FOLLOWING IS BROUGHT TO YOUR KIND NOTICE;

1. I am an army officer presently posted at guwahati and invested in property of ANSAL API EXCLUSIVE FLOORS in sec 114 mohali (360 GF) in mar 2009.

2. I have been making the payments regularly and to my utter surprise when final call notice was served to me a sum of Rs appox 250000/ is added as interest on delayed payment which is beyond my imagination (CONSTRUCTION LINKED PLAN)

3. Though there were some delays in making some payments but that was because of delay in processing of home loan from ARMY GROUP INSURANCE FUND(AGIF) due to want of documents from ANSALS and it is on record that these delays in processing of home loan from AGIF are actually attributable to ANSAL as the required documentation are not provided and it took me more than one year to process the loan and later on also there were delays in release of installment from AGIF due to delay in release of receipt and photograph from ansals resulting into delay in release of next installment .On top of it a cheque of Rs 305723/ dt16 apr 12 fwd was lost and there was a delay of 04 months for release of duplicate cheque.(everything is documented and on record in the form of emails and letters)

4.FURTHER IT IS INTIMATED THAT I HAVE MADE ALL THE PAYMENTS EXCEPT THE DISPUTED AMOUNT OF RS 243329/ IN NOV 2012(total amount paid Rs.3452339/ against the basic price of Rs 3060000/ ) WITH A ASSURANCE THAT POSSESSION OF THE PROPERTY WILL BE GIVEN TO YOU AT THE EARLIEST BUT I HAVE YET TO RECEIVE ANY OFFICIAL COMMUNICATION FROM ANSALS AFTER A LAPSE OF MORE THAN 08 MONTHS WHICH IS NOT RESOLVING THE MATTER AT ALL.

5.EMI ON THE SAID PROPERTY IS BEING PAID TO AGIF WITHOUT TAKING OVER THE POSSESSION OF PROPERTY CAUSING FINANCIAL LOSSES TO ME AS THE PROPERTY CANNOT BE LET OUT SINCE LAST 08 MONTHS .

6.SINCE ANSALS WAS NOT RESPONDING TO ME , I APPROACHED AKOSHA(ONLINE CONSUMER FORUM) AND SENT A NOTICE TO THE COMPANY FOR AMICABLE RESOLUTION OF THIS ISSUE BUT TO NO AVAIL.

7. I CAME ON LEAVE AND WENT TO ANSAL API OFFICE IN CHANDIGARH ON 09 AND 11 JULY 2013 TO SORT OUT THE MATTER AND WAS PROMISED IMMEDIATE POSSESSION AFTER TAKING APPROVAL FROM THEIR MD/VP BUT NOW AGAIN THEY ARE DILLY DALLYING THE ISSUE AND AVOID TAKING MY CALL WHICH IS REALLY FRUSTRATING AS I HAVE ESPECIALLY COME TO RESOLVE THIS MATTER.

8. PRESENTLY, I AM LEFT TO FILE A CONSUMER COMPLAINT FOR GROSS NEGLIGENCE , LETHARGIC CONDUCT AND APPALLING LEVEL OF SERVICES AS WELL AS ADDITIONAL COMPENSATION FOR MENTAL AGONY AND LEGAL COST AND START A SUSTAINED ONLINE CAMPAIGN SPREADING THE WORD ABOUT THE DEFICIENT SERVICES OF ANSAL API FOR WHICH I NEED YOUR GUIDANCE AND SUPPORT .

9. LAST BUT NOT THE LEAST IT IS CLEARLY MENTIONED IN THEIR ALLOTMENT LETTER PARA 5(C) THAT THE PAYMENT MADE BY THE ALLOT-TEE WILL FIRST BE ADJUSTED TOWARDS THE INTEREST DUE , IF ANY, AND THEREAFTER THE BALANCE WILL BE ADJUSTED TOWARDS THE INSTALLMENT DUE WHEREAS THEY FAILED TO DO THAT IN MY CASE.(COPY OF ALLOTMENT LETTER AND ANSAL'S CALCULATION SHEET OF INTEREST ATTACHED)

10. IT IS PERTINENT TO MENTION THAT INTEREST ACCRUED OVER A LONG PERIOD OF TIME IN VIOLATION OF THEIR OWN TERMS OF REFERENCE IS NOT A ISOLATED CASE , IF IT IS HIGHLIGHTED IN PRINT AND ELECTRONIC MEDIA LOT OF GRIEVED CUSTOMERS LIKE ME WOULD COME FORWARD AND ASK FOR REFUND FROM COMPANY WHO HAVE ALREADY PAID THE INTEREST OUT OF IGNORANCE.

11.BEING AN ARMY OFFICER , I AM LEAVING NO STONE UNTURNED TO FIGHT MY CASE INDIVIDUALLY BUT AT THIS STAGE I NEED HELP FROM FORUM LIKE YOURS TO EXPOSE THE BLATANT FICTITIOUS CHARGES LEVIED BY PRIVATE BUILDERS LIKE ANSALS TO FACE THE TRUTH

12.MAY I REQUEST YOU TO TAKE UP THE MATTER ONE LAST TIME WITH ANSALS ON MY BEHALF TO RESOLVE THE MATTER AMICABLY AND GIVE ME FURTHER GUIDANCE TO START A SUSTAINED ONLINE CAMPAIGN .

We were going through old complaints that we were not able to resolve and came across the one filed by you (#159830). I know this is very late but we are extremely sorry that we could not help you. Resolving consumer complaints is very challenging and we are not successful every time. We are learning from our mistakes and trying hard to get past the constraints that we still face to improve the resolution rate. Hope you will also understand our situation.
