BPTP FRAUD
I booked a floor with bptp builders in year 2009. Subsequently they allotted me one floor in project Elite Floors. I was made to pay construction linked installments of amount exceeding 12 lacs rupees. However when I visited the site recently I noticed even the site does not exist.


When I protested company tells me to either get the money refunded or sign a fresh new agreement for allotment in far flung area and again it may take another 3-4 years for construction.So even after waiting for more than three years and depositing hard earned money with them I am back to square one.

    It is more than one & half month has been passed we are yet to receive the Requisite transfer document from M/S BPTP LTD. We have been calling to your customer care on regular basis , Umpteen no.'s of mail has been given to M/S BPTP but all in vain.

    My financer M/S LIC Housing Finance needs Transfer documents to fulfill the demand raised(demand of Rs. 1,17,400/- raised via letter dt 14/05/2012) from M/S BPTP. We have requested M/S BPTP to send the same on urgent basis and extend the period of payment of this demand by two weeks as the delay in providing transfer documents is from M/S BPTP's end.

    Pl help over same.

      I booked a flat in Pareltite floor in Faridabadin a project by BPTP in 2009. My cutomer number is BE-48/120599. I have made complete payment of flat alloted to me (Floor No B-23-12-FF) last year. As per agreement the flat was suppose to be ready for posession in April 2012 which is far from reality as on today. Most shocking is last year BPTP raised an additional demand of Rs 5lakh to towards increased super built up which is in reality neither increased nor was in intial plan. I had to pay that amount. This year again BPTP has raised a fresh demand of Rs 1 lakh as EDC charges.

        BPTP is a big cheat and cheating customers klike any thing. The sequence of event in my case is as below.

        BPTP allotted a villa in December 2007 under Park land Project Faridabad, (Villa F7/47 ) ( Customer releation number of BPTP 105354 ) and I paid 35% BSP +100%EDC+100%IDC+100%PLC charges.

        Builder Buyer agreement signed in June,2008 and as per the agreement signed by Sunil Puri on belaf of BPTP.And as per that Villa was to be delivered by 2011.

        BPTP raised demand for completion of foundation @10% of BSP in the same month and it was paid. After that they stopped the demand.

        In 2010 BPTP informed that my villa has been relocated by them and again promised to do reallotment in 2011. But again they did not do that and keep on giving excuse for delay.

        Few daya back they have have now come out with the statement to take money back or explore other options of flat.

        I am really fed up with their indifferent attitude and raise following objections.

        1. If they have completed foundation how can they relocated my villa?
        2. They are not replying any thing in writing which raises doubt about their intention?
        3. They are simply cheating me without any fault and again selling new villa to new people at much higher rate.
        4. Their senior persons never lift the phone and avoid all queries.

        I have written to their directors but they also keep quite. I think that there is deliberate attampt by BPTP to cheat me. Can some one suggest what may be the course othar than legal one.

          I have booked a villa through my hard earned money and till date waiting for allotment though in between they have alloted me Villa in F block sector 88 but same has been cancelled without specifying the reason and delivering a false letter . From the date of reciept sam of the letter i am regularly cordinating with them but no results and all executives are just providing a false comment.

          BPTP SEEMS TO HAVE Cheated many customers like us .

          Inspite of repeated followup no concerete action have been initiated till date due to the fact this was a well planned move by a builder who have strong politicians as back up and support and are not affraid of any court , law or consumer forum .

          I am surprise to see that there are more than 500 Complaints being registered on this forum but did not find even a single resolution for any of the complaint. May i request forum orgnaisers to update the resolution/status of the complaint registered.
          I request all victims to come forward and join hand together against such a corrupt builder who have just finding the way of escaping after enjoying the benifits of hard earned money invested by many buyers .

          I am also the vicitim of BPTP
          I have booked BPTP resort in June 2012 by paying booking amount of 5 lakh. Inspite of several reminders I am unable to get any confirmation/ allotment letter. BPTP is bunch of scoundrels and swindlers which are politically supported by the corrupt pliticians. I beleive we must unite and sue this corrupt builder

          We do have same problem with BPTP, we have booked a flat in GGN have paid 19 lakhs, we have agreement too but in last 3 months we have not paid the amount as asked BPTP to give us 3 months we will pay outstanding 8 Lakh with interest, insted of giveing us time, they said that your property is not more.. when we asked to return our money then they said that this will take atleast 4 months but some amount will be deducted.. I am planning to put case againt them.. just collecting the information.. how to do.. and Govt. bodies who look into such issues.. any idea ?

            I have booked 3 bed room Hall Kitchen Flat aprox area 906 Sq Feet in BPTP
            Project "Park Elite Premium" situated in Parkland, Faridabad. in the Name of : NEELAM MITTAL
            My Customer Code : BE 44 122050

            I have paid 25% of Basic sale price ie Rs.427026/-. After 25% payment, I have not recd any
            letters/calls/demand note for next step progress of the Project. I was informed that, after 25% payment, Loan from Banks will be processed and BPTP is in process for getting approval for Home Loan. Once Home Loan is Approved for this project, BPTP will inform and Laon can be processed.

            Even after a lapse of more than 2 years, we have not heard from BPTP.

            Even No Allotment has been made to me

              Dear all investors/readers,

              I am writing this blog after reading so many complaints by customers invested in various projects run by BPTP. I am actually in shock after reading all sorts of negative traits shown by BPTP like false commitment, misrepresentation of facts, hiding of facts etc. involving from customer care to the top management. My heart has sunk in deep sadness while I am writing this as I have also become a customer of BPTP by booking a flat in Park Generation project in September 2011. I have paid second payment of 10% to BPTP in November 2011 however they have not allotted flats till date. I have applied for a home load which has been sanctioned but bank official has told me that they can not start funding as the project is not approved yet. I am surprised why would this be as I remeber seeing a new paper advertising of Park Generations project which read that BPTP has all the required approvals with them...now this seems to be a clear fraud !!

              Unfortunately, i have read all these complaints against BPTP today only. I thank all of those who have shared their bad experiences/complaints against BPTP with us and making us realise that we need to be very cautious while delaing with this builder.
              Therefore, I call all the investors of BPTP Park generations to please joing this group and make forum for us where we can discuss together things like payment plans, discounts offered, project timelines, etc. I am sure together we can handle things better rather than in isolation. Hence, i would hereby, request all the investors of BPTP Park Generations to join and update this forum about any communication from BPTP.

              I too booked the flat in Sep. 2011 and made two payments. Now, they are saying that allcoations would be made by the end of March 2012. I heard a good reputation about BPTP but I'm afraid now. There customer care service is really , no one answers the call.

              Dear Mr. Anil,

              I too have booked an appartment with BPTP Park Generations last November and have completed my 2 payments. Everytime I approach the customer care, I find their reply that the allocation will start this month and so on... But till date, I (and as many other BPTP-Park Generation Customers) have not received any message for the appartment allocation. Home Loans are not processed until we receive the allotment letter from BPTP.

              I approached few banks for home loan, but they say that they do not have sufficient project documents (provided by the builder) to sanction home loans.

              With all the blogs floating around, I feel, its better to be extra vigilant with this builder.

              I agree with you to form a group so that we can fight for our cause unitedly.

              Thanks for responding to this blog. So far we are 5 investors and i think now we are a sufficient enough to go to BPTP's office ask them about the allotment.

              I too visited the builder office in February and was told that the allotment would start in March but nothing happend in March. Then I visited builder them in March and was promised that the allotment would be done in April is almost gone and there is no news about allotment yet.

              I would request you all to keep checking this blog atleast once in every week so that we can communicate to each other and if required, we can fix a time and can visit builder office together sometime in May.

              Till date no allotment from the BPTP, whenever I call them they tell in 4-5 days allotment will start. Intially they were saying in April they will start the process but now with May round the corner, only God knows what this guys are upto. Is there some way I can get my money back from these looters. I have no hope in this BPTP.

              m also in the same boat - gave 2 installments and last week my husband visited their office in gurgaon and got the info that another 2-3 it will take to get the alotment letters!!!

              Hi All,

              Builder was supposed to release allotments by January 2012 and it is now May 2012 that too there is no surity when would the allotment happen. We should not wait beyond May and plan to go to the builder's office in June. I would again request you all to keep in touch through this blog so that we can plan a visit to builder's office in June if the allotment does not take place in May.

              hi, same here. Called the call center and got to know that it would take 2-3 months more. And then I tried to intimidate the guy by saying I want a cancellation. Seemed he was overjoyed to listen to that and was willing to help me. Lets meet & go to the builders office on Jun 1 - Friday.

              I too invested in BPTP Park Generation project. A friend of mine has also invested in it. I am really surprised at the attitude of BPTP towards this problem. If there is a problem they should acknowledge it and offer a reasonable explanation. Forming a group is a good idea. Lets us all meet the builder together on 1st June as suggested.

              Just to remind everybody, they imposed service tax also on each installment. So while asking for reimbursement, we should ask for that service tax portion along with interest.

              The payments in this project are supposed to be construction linked...they should be asking for next installment before showing any progress on construction ideally. There can be some confusion also. Anyways...lets get further clarity on allotment day.
              I have also got call from BPTP stating that rather than going with computerized draw system they will allocate flats on first come first serve basis. Do you guys thinks that it can be a wise way of allotment?
              Dharmender Phogat - i hv called bptp broker and they said as v raising demand after long time so may be company can ask for 2 installments at a time - or there will not be much gap between two instalments as grounding will start immediately after alotment

              I have received an authorization letter from my broker today to authorize broker to represent me in the alottment process. The letter reads that my broker will be selecting a unit on my behalf and I can not challenge same after providing this authorization to broker. This is NOT FAIR...why should i authorize my broker to choose a unit on behalf??? I have booked apartment and I am paying for it...why should broker be selecting my unit??

              Has anyone of you being asked to sign such letter of authorization?

              got the same from my broker and clarified over phone - he says that it will be on first come first serve basis- like in my case i hav given the cheque on 2nd day of receving the bptp sms and wrote my priority over application - so chances of getting the desired options are more than the investors who took late decision - so let's hope for the best - atleast one step after a long time of almost a year

              yes as no other choice - bptp will not entertain each customer and alotment come thru broker only - so only option is to keep faith in broker or god:)
              Rashmi, I spoke to BPTP customer care yesterday again and got a different reply this time. CC executive told me that it is not mandatory to sign this authorization letter as this is meant for those owners who could not attend the allotment so they should send their broker to complete the allotment on their behalf...now this seems more logical! He said I can ignore this letter as long as I willing to take part in allotment process myslef rather than through a representative.

              Is it safe to give one broker authority to chose and book flat on actual buyer's behalf?
              I visited BPTP office and they informed that it is all actual buyer's wish whether to authorize broker or not.
              You are absolutely right Ashish! It is our wish whether we want to authorize broker or not hence it is not mandatory to authorize your broker.
              Dear All,

              It is absolutely unfair to authorize a broker to finalize a flat on our behalf, unless and until it is absolutely not possible for an investor to attend the allotment dates (for ex. if an investor is a NRI or if he/she is out-of-station).

              I spoke to my broker and I informed him that why should I authorize someone to take such an important decision on my behalf, while I can be present at BPTP office for allotment. I have refused my broker and have informed them that I will not give any authorization letter.

              In the mean while, I havent heard anything from BPTP about the start of allotment dates. Earlier, they said it would be done by 30th June. If this was true, we all should have received an official letter/email by now from BPTP to inform their customers about the allotment dates.

              Have anyone of you received any information about the allotment dates?

              I request all in this group, to keep this blog updated so that we can share any information/updates about Park Generation. Forming a group will be great idea. Does anyone have any other thoughts?

              I have received a letter from BPTP yesterday evening for an invitation towards allotment procedure. As per my priority number (first-cum-first serve basis), my allotment is scheduled on 5th July.

              The letter also mentions that the next demand shall be provided on the SPOT.

              Does this mean that they will provide just few days for the 3rd installment?

              Thank u so much psoni for info - after checking this i immediately called up my broker and he said that they hv not received any info from BPTP regarding alotment date - i checked in BPTP office directly and found that they hv not received by authorisation letter from my broker !!!- then i forwarded the authorisation letter to bptp office for doing the needful - guys i think v hv to extra careful as can't rely on broker.

              Hello... I also received allotment invite yesterday from BPTP...it is scheduled on 5th June...time mentioned in 2:30 pm...r there different timing/dates depending on priority no. Also, is the priority no. from within a group for eg. people who have opted for 1760 sqft have diff priority no. than customers who have opted for 1470 sqft or is it common priority number for all customers who have submitted applications?

              I got my allotment but not the one which I was promised initially. It's all corrupt out there.

              I have contacted SBI bank(as not willing for housing loan from HDFC/India Bulls) for home loan and they told me that loan can't be processed without Allotment letter, means what they provided are 1. request for allotment of a particular unit and 2. Is demand letter.

              Allotment letter's format is different. Any views from your side?

              Also they are not willing to provide any documents for legal process during loan processing. When contacted customer care they told me to post a email for this purpose as currently they can't provide this.
              i have been told during alotment and signing consent letter that we will receive official alotment papers over letterhead by mail.
              so loan will be issue by bank by seeing that papers.

              also want to know whether they will invite investors for 'bhoomi poojan'???

              Hello Dharmendra,

              Do you mean that banks are not sanctioning the home loans? If the project is not having clearances and licence, how would HDFC and Indiabulls sanction home loans so easily? My allotment was finished yesterday (in last lot) and BPTP told me that HDFC, Indiabulls and ICICI are registered banking partners for this project.

              Please share your experience if you are planning to apply for a home loan from other bank.

              Has anyone noticed the service tax mentioned on the demand letter? It says 12.36%. As per my knowledge, this should be 10.3%. I am not sure if the service tax has been revised to 12.36%. Is anyone aware about this hike in service tax??

              @Prashant: Please contact HDFC bank executive when you are free and ask that are you able to sanction loan including currently raised demand amount you will got ur answer.

              Only IndiaBulls is saying that they will pass loan but because BPTP will give them some documents related to project directly when this will be approved and this is may be because of some tie ups between them.
              Hi Dharmendra, you are right. HDFC guys are telling me that Park Generation is not included in their list of approved projects.
              Now, I think we should ask for official allotment letter's from BPTP, as the project is still not approved from govt. and banks are not sanctioning the loan on this. I think we all now call BPTP for the official allotment.

              G8 to see this common platform of all BPTP park generation flat owners.

              I like all of you i also own a flat at park generation.

              Tried speaking to the customer care on allotment letter and when this will be officially launched. All they are doing is beating around the bush (it will happen soon). I have already sent a letter to them asking for the license nbr as well as the exact date for official launch. I would request everyone to do the same i, .e put them in writing.

              Moreover, i also asked them when are they going to send give us the allotment and the seller buyer agreement for the flat. The lady told me that it will be done after the 30% is paid. I really fail to understand why is being so very late.
              I request that we all go together 1 day to BPTP and speak to the higher official there to get all clarification.

              Why are they charging us if the place is still not approved by the govt??
              I would request everyone to review this and advise the day and date that we all can meet and speak to BPTP.
              If need be we need to take a day's off then so be it.

              Guys there are lacs at stake here...
              The choice is ours if we all want to talk to BPTP together or talk inividually and get no results..

              It was nice speaking to you today morning.

              I agree with your views. I am an end-user and I do not have any other source of funds for the 3rd Demand. I am solely dependent on the home loans. Just today morning, I gave a call to HDFC bank's home loan - Manager - Mr. Sukhjinder Singh[protected] and he said me that BPTP is in process to submit the builder's documents to HDFC. However, he was not sure if the HDFC bank will be authourized banks for this project.

              Hence, he said that he can pre-approve / sanction the loan but the disbursement of the money will start only after HDFC approves the BPTP-Park Generation project. This may take approx. 1-2 months time. HDFC bank will just give us sanction letter for time-being.

              For our safe-gaurd purpose, Mr. Sukhjinder advised us to take a written confirmation from BPTP that BPTP will not charge any penalty if we just submit the sanction letter against 3rd Demand which is due on 25th July. He also asked me to take a written confirmation from BPTP that they will still retain 5% timely payment benefits based on this sanction letter.

              Apart from Indiabulls and HDFC bank, no other banks are approving the home loans.

              I think, as a group, we should definitely approach BPTP and ask the following:
              a) Official Allotment Letter
              b) Written confirmation that no late fees penalty is charged
              c) Written confirmation that 5% timely payment is valid if sanction letter submitted before 25th July.

              I advice all to write to BPTP customer care so that we can receive their reply in next 2-3 days.

              And after this, if the situation demands, we can meet at BPTP's office on Friday 13th July in 2nd Half.

              I request all within the group to share your thoughts on the same. Please also share your contact numbers.

              I have a similar situation as I have a pre-approved loan from HDFC. I have email the BPTP customer service and I got the following response :

              Dear Sir,

              Greetings for the day!

              Iam in uk not in US.Hdfc can pre-approve your loan even before the project is approved. All you need for that is urs sallery slips and few more docmnts. I will sugest you to eitger contach local hdfc branch in US or contat my friend in india as he will help you to get urs loan processed. It takes about 20 days to get pre-approval letter
              One thing also we can do...for the 3rd installment...We all go to the BPTP office before 24th and can ask them that we will only give the 3rd installment as soon as you will give us the allotment letters and we need to take a loan for the payments.

              Second I have visit in your Udhyog vihar, Gurgaon office and customer care told that only 2 banks HDFC and India Bulls are tied up for Housing loan and told that BPTP will not provide any document for legal clearance process during housing loan processing by SBI. Can I ask you that how you can bound a customer for Housing loan from HDFC and India Bulls? We have right to go to any bank for loan purpose on individual capacity and as we are customers of your project and invested 20% money(of BSP of Total price) till now so you how you can refuse to produce all documents related to project to the bank from where we trying to get house loan.

              So I request you to provide all the required document(for their legal process) for loan processing to SBI and Allotment Letter to me.

              Please note that we are unable to even apply without Allotment letter for a Housing loan and I am not interested in going for a loan from HDFC/India Bulls till now.

              As you know that last date of submission of payment is 23rd July, 2012 and loan can't be approved due to lack of documents which you have to provide, so I request you to provide all necessary documents when they(SBI Bank) ask for then for processing of loan.

              only worry is that as time approaching fast for 3rd demand installment, in any case if we delay the payment only we are are going to suffer with extra interest money + we will not be entitled for advance payment benefit. what i understand from their previous projects is that BPTP is slow but deliver ...so i think m going to arrange the money and making timely payment. also called up bptp off for alotment letter for which they said that we will be doing the needful after july end so that all money (3rd demand) credited into bptp account by then and also few owners not appeared on said alotment dates so also tying up that loose ends!!!

              This is really absurd..i think BPTP has not got any approval from the said authorities..my personal opinion is that they only have a LOI for the said project and does not have a license, otherwise i am sure they wud have launched it with all ho hulla. We should all be there at their office and talk to them together as well. There is no point each one o[censored]s going alone 1 by 1 as we will all get a "merry go round" replies..We should all go together and first ask for License nbr and then allotment letter and then concrete reply on when they are launching the project.These are important questions and we need concrete reply from them.

              I agree with Kasshvi... There is no point in going one by one... I had written to BPTP last Tuesday and asked them their licence number, actual launching date, confirmation on allotment letter, etc... Surprizingly, I havent received their reply even after 7 days and even after sending them reminders twice.

              BPTP's customer care will answer with merry-go-round replies only when you call them on phone... However, they are not committing anything by giving written reply or confirmation in writting. And this raises our eye-brows and doubt the intention of the builder. If they have any operational issues, they should clearly intimate their customers about the true facts... But I doubt, no builder (especially in this NCR region) will be so honest to reveal actual truth to their customers.

              As most o[censored]s think, we should meet at BPTP's office and get reply to our questions. We can have many more people join us because its a matter of our hard earned money which is getting blocked due to un-necessary delays.

              Please suggest date and time so that we can meet at BPTP's office.

              It seems a situation has been created by BPTP for all the customers, who are solely dependent on loans. Customers with Loan requirement have been assured that you don’t pay have to pay late payment interest (provided you submit a sanction letter from bank) but your Timely Payment Discount will be forfeited if you pay after due date. Naturally bank wont be able to disburse any some of money until they receive 1. Buyer’s agreement, 2. Permission to Mortgage.

              Therefore forget any timely payment discount for this demand request.

              Like all of you I have paid first two instalment from personal contribution and got a loan sanction letter from HDFC. I am ready to pay the third instalment, but the bank has also thrown a situation that if a customer pays more than 20% threshold from his or her contribution, then in future the bank will only pay 70% of demand request i.e. a Pro rata will be applied in all future demands.

              Therefore, I have decided that I would rather sacrifice Rs. 33K now as Timely discount and let the bank pay my third instalment, once BPTP issues all relevant documents. At least that would save the hassle in future of arranging 30% of demanded money.

              Imagine how much money BPTP is making by creating such a situation!!!

              Seriously a SCAM all over.

              One more news heard that High Court, CHD passed an order that no new licences will be given and construction will be allowed till further notification due to some ground water issue, don't know this project having licence already or not. If not then???
              After numerous emails to customer care, I havent received any response from them. Finally, I called their customer care and they informed that customer will not get 5% timely payment discount based on loan sanction letter. They said that BPTP has not asked customers to go to banks... They expect that if we submit the "CASH" then only we will get 5% discount on this 3rd installment.

              Further, they are not disclosing their licence number also OR official launch date.
              Should we approach as a group to BPTP to get the answers of critical questions?
              Yes!! I think its a high time that we all now talk to BPTP for official allotment letter. Othwise I think we are blocking our money. Guys share your number and tell me date when we all can talk to BPTP personally.
              I went to BPTP office for official allotment letter. They are saying that we will send you the official allotment letter within 15 days.
              One side BPTP is blocking our money and delaying the construction... On other side, I received an SMS saying the BPTP is lauching ECO at sector 37-D (in the same BPTP premises)...

              Good News: On visiting the site yesterday, the foundation work for Park Generation has been started.
              Thanks for sharing that news with us Psoni!! However, its still bothering that we do not have a legal binding on builder because the Flat Buyer Seller Agreement is still not executed. Moreover, there is no time stipulated (3 years to complete construction and hand over possesion) on builder yet which is part of Flat Buyer Seller Agreement. The time stipulation of 3 years would start only from the day when the Flat Buyer Seller Agreement is executed.

              Its already been a year now and we are still awaiting the Flat Buyer Seller Agreement to be signed. HIGH TIME now to check this with builder.

              We will be able to get home loans funded until the Flat Buyer Seller Agreement is executed between us and builder. Somehow we all managed to pay 3rd demand but not sure how many o[censored]s would be able to pay 4th demand ourselves too????

              I would suggest that we all group together and visit builder office soon...please let me know your thoughts!

              I called builder BPTP last week and they told me that by the end of Oct., everyone will get allotment letter. But when I called them today again, they are saying that it would be by Nov. or Dec as management is in talk with Bank. My biggest mistake to invest in BPTP. We do not have allottment agreement in hand...since banks have not approved the project so we can not get it funded by them...and here we are asked to pay 4th demand...???? I seriously doubt how many o[censored]s will be able to pay this demand out of our own pockets???? How come they raise this demand without getting the allotment agreement signed??? The management is so about raising demands but why are they taking so long to have the allotment agreement signed ???

              This is serious issue, that they have raised the 4th installment and no allotment letter has been raised. Also such a short span of time has been provided to make this payment, seriously mismanaged and malpractice on behalf of BPTP.

              I just called the HDFC bank and they said that the project has yet not been approved by the bank.

              It is my assumption that for people who have submitted the loan sanction letter earlier are not required to pay the 4th demand as the deadline date (because the project has not yet been approved by HDFC).

              I havent received the builder-buyer agreement, but I think, it must be on its way.

                I am Rahul. I had booked a 180sq.ft. unit in bclock (P8-23) in BPTP project BPTP PARK ELITE FLOOR. they give me allotment letter and we signature all documents like buyer seller agreement ect. My unit is P8, 1st floor. they demand me instalment for start of construction in feb.2010 and i paid it timely. after this no more demand from bptp. time to time i mail to bptp about the status of construction then they give me reply we are doing construction in many phases so when we will start the construction in ur unit then we will raised demand.
                sir now its been two yearsand after it they are not started construction on my units so please tell me what can i do? bcz all time company giving me same reply very soon we will start construction but we cann't give me confirm date.

                  BPTP, a Delhi based builder has good presence in Faridabad and some presence in Gurgaon. They cheat customers almost in every project nowadays. After getting 35% of payment, they ask buyers to sign an agreement which is totally on their favor. Consumers do not get any option here because of threat from BPTP, that they cna forfeit the money at any time. After sometime, they certainly add few more things in the language and ask more money (that may be 20% to 50% of projected cost). If customers do not pay, they again give a threat to forfeit money! In this way, they are looting customers almost in every project. There are many cases going on against BPTP. Recently there was an arrest warrant issued against their MD (as per TOI news).

                      I had applied for booking a Villa at Neharpar sec 85 in Faridabad in BPTP ELITE PREMIUM VILLA. In the year 2009 , Nov.

                      The total initial payment required was Rs.13.90 Lacs. which was asked for through Demand note generated every 45 days .
                      during this course the last payment of Rs.4.00 lacs could not be manged by me and due to some reasons my cheque bounced.

                      BUT BPTP DID NOT INTIMATE ME ON THIS.

                      so when I came to know about this and approched them , they had already sold out my villa , and had no other villa to offer as none was available.

                      when I decided to cancel my intention of buying a villa nad asked them for Refund , I was initially told to get the Refund process Documents signed from my broker along with a NOC.

                      On submitting the full set of Documents , they refused to accept , stating that first a initial cover letter is required , which would need to get approved before they accept the refund documents.

                      I gave the cover letter stating my request for refund.on the 1st week of Nov '11.

                      Now on 5th Jan '12 . I am being told that , my request has not been approved , and as per policy Refund IS NOT GIVEN.

                      They have asked me to opt for another property ,I agreed , but they said that my amount lying with them would not be transferred or adjusted immediately. I would have to make a fresh booking , after which 3 months later they would transfer the same to my new booking. So according to them I have to book another fresh property after paying around 7 lacs.

                      they have not given any other option and have said that you can go legal and fight the case for ten years.

                      now it will be more than 2 years 2 months since I applied for the villa , my Rs.9.0lacs is being held by them. this is my lifes earning and I would retire in another 5 years , but it seems there is no law which can tackle this menace of BPTP.

                      I require help to get my refund with full interest. but at the moment I can see no light at the end of the tunnel

                      can anybody help me?

( SANCTIONED LETTER ENCL. ) but I was not successful in the draw so the whole process of loan went in vein.

                          We have booked flat in BPTP sect 75 parklands in Dec 2007 in the name of Gurvinder Singh Matta, and at the time of booking we were told we will get possession in 2 yrs a. After 2 years again we were told we will get possession in 3 years. Our loan installment will start only after we get possesion. But now its going to be 4 years we have not got possession our loan installment already started. We were told we can sell off whenever we want but now when we want to sell we dont have any buyer. Pls suggest what to do in this situation. Pls help with clauses and advise solution

                            I have bought a flat of BPTP (Freedom Parl Life, sector - 57, Gurgaon) 2 years back which was the blunder of my life. We were supposed get the possession 2 years back but till now there is no response from the builder.

                            Company says "BPTP is a place of peace" whereas it just a place of all the stress and harressment.

                            Will not recommend to buy any property from BPTP, worst constructions and worst service......

                            I had booked a floor in BPTP Park Elite Floors in Faridabad, around 4 years back. Despite of paying nearly 100% of the payments and more than 4 years of waiting, still the builder is not giving posession. I can furnish all the related documents and mail exchanges if required.

                            I have invested all my savings and have to pay bank loan EMIs alongwith my house rent.

                            I would like to advise you that you have to send a legal notice through an Advocate &amp; then file a consumer complaint case against BPTP Ltd. under the provisions of Consumer Protection Act, 1986 in the District Consumer Forum, New Delhi/Gurgaon, Haryana in order to receive back refund of your initial booking/registration amount along with interest and compensation from such Company. This is the procedure adopted for intiating legal action against BPTP. If you wish to pursue a legal action against BPTP then you can contact me for the same. I am handling some cases against BPTP Ltd. and in some of the case the investors have started getting back their money along with interest from BPTP Ltd.

                            I am looking forward to hear a prompt reply from our end.

                            I want refund from bptp with interest at the earliest, as I do not wish to continue in this project.

                              I had taken a flat in the project Park Floors II with the flat # T24 – 202 in Sector 76, Faridabad, Haryana with the builder BPTP Ltd in the year 2009. The basic sale price of the unit is 23,80,000 and I had paid 4 lakhs at the time of booking. I had immediately applies for a housing loan with LICHFL immediately for the remaining amount and also provided the sanction letter to the builder. Based on that a tripartite agreement was also signed. But for the past 2 years the construction was delayed due to various reasons and during this period I have regularly followed up with the builder through email asking them about the construction status and have been told to wait for bank disbursement.


                              In June2011, i got a final opportunity letter from BPTP telling me to pay 14 Lakhs within 15 days else my unit would be cancelled. I was out of the country when i recieved that intimation and asked them to wait till I return. Post returning to India I re-applied for loan in LICHFL but due to some mismanagement from LICHFL my FI(First Investigation) report was pending for more than a month. On calling up BPTP I have been told that my Unit in Park Floors II with the flat # T24 – 202 in Sector 76, Faridabad, Haryana with the builder BPTP Ltd, has been cancelled and the builder tells me that the only option I have is 1.do a fresh booking in another project of the company (In this case brokerage charges would be deducted and I will have to pay the latest prices of the units, which is out of my affordability)
                              2.Or else forfeit my earnest money as cancellation.
                              Please note that this is NOT acceptable to me under any circumstance. I have been communicating with BPTP all through the year and had also provided the loan sanction letter from LICHFL which got invalidated as BPTP was not ready with the construction stage. The only response I got was to wait till the construction reaches a particular stage and suddenly I got an email in June saying that if I do not pay 14Lacs in 15 days my unit would be cancelled. I have been communicating henceforth that I have to re-apply for loan from LICHFL as my earlier sanction letter has expired validity and the bank process takes time and also that I’m out of the country when I received the demand letter from BPTP and hence need time till end of June to complete formalities. I had immediately re-applied but due to some issues out of my control the banks have still not sanctioned the loan. I’m attaching all my communications in this regard. I do not wish to do a fresh booking as my intention to buy in BPTP park floors II so early was to avail the low prices within my affordability.

                              How do I recieve refund of my full money or revive my allotment in the same unit at the purchased price?. If builder resists, what legal recourse do I have?

                                I have booked flat with BPTP (Park Prime, Sec-66, Gurgaon).

                                Recently I got demand letter from builder regarding enhanced EDC. They demanded difference of EDC between rate already demanded and revised rate.
                                Letter doesn't elaborate how BPTP calculated revised EDC (in my case, they revised rate came from Rs. 137 per/ft to Rs. 237 per/ft.)

                                After asking for calculation details, builder not ready to give details.
                                Also I asked multiple people who bought property in Gurgaon but none of them got enhanced EDC demand.

                                Notification using which they raised demand is : Haryana Memo "HUDA.CCF.ACCTT-I-2010/44973"
                                Help me on how to proceed on this.

                                same problem facing by us
                                Every builder has made this kind of increment. In my case, Umang has increased the EDC +IDC from 190 psf by 90 psf to a total of 280 psf. Also they have asked for addtional 13.60 psf as labour cess?

                                This is anohter way of looting money

                                  We are with you, They are looting our hard Money, Recently I paid 4 Lacs as Super Buildup Area Demand which should not be there they works on ethics.
                                  I booked Elite Floor in BPTP which was 876 Sq Ft as per Agreement and Initial Brocher now they send Demand for 4 lacs saying that your Super Area which is still tentative increased by 25% which is totally unethical.. Although have legal agreement in which condition signed in favor of Builder.
                                  This is company is very Un Trustworthy Company Looting Old Customer which already Invested thier money can't leave..

                                  Hi Anil, I'm M M Maurya and also suferer of BPTP park elite floors. Now they have conducted 2nd draw but sitll not providing the necessary documents to the HDFC bank to disburshment of loan. Sometime I think to drop my plan for flat. There are 02 other persons whom I know one is Mr. Shiva Rama Krishnan and other is Mr. Kshitij Mohan. If you have any suggesstion kindly inform me.

NOW COMPANY(BPTP) SENT A DEMAND OF Rs.3,74,986/- EXTRA STATING THAT OUR SUPER BUILT AREA IS INCREASED. BEFORE IT WAS 876 SQ FT NOW IT IS 1043 SQ FT. NOW THOUGH CONSTRUCTION IS ALMOST NEAR TO COMPLETE, HOW SUPER BUILT AREA IS SUDDENLY INCREASED. NOW I AM UNABLE TO RE SANCTION MORE LOAN BECAUSE MY BANK IS NOT SANCTIONING. IT IS UNFAIR TO CUSTOMER.                                       This is to bring into the kind attention of media that BPTP has done a big injustice to its customers of Elite Floor Project (BPTP Parklands, Faridabad) by raising an additional demand of Rs 4 to 5 Lacs for its 4,997 units consisting of 180 sq. yard, 250 sq. yard and 300 sq. yard size. For this unjustified and unexpected demand, BPTP has cited the reason that with construction at an advanced stage, super built up area has been measured to be 150 to 200 sq-ft more as compared to mentioned at the time of booking. Inspite, carpet area has not increased at all. As per BPTP, common area (consisting of Shaft, Mumty, Common service terrace, canopy, boundary wall etc) has increased during construction. Moreover, BPTP is not giving any exact details and justification for this increase of super built up area. On doing queries, BPTP just gives reference of the word “tentative super-built up area” which they have put in Builder-Buyer Agreement, signing on which was not at all optional. Customers are shocked and confused. Media is requested to give voice to this injustice.

                                      BPTP, has been cheating the people of India, who has put their life savings for purchase of flats for residential purpose in Elite Floors, Faridabad, in Nehar par area in sector 81, 82, 83, 84, 85 sectors. They have earlier tried to cheat in freedom Park Life Society, Gurgaon, but on intervention of Press and opposed by Buyers, they had to roll back the unjustified Demand.                                       Here, again they have opted to cheat and raise illegal demand. In this context following facts are presented to you to take action against this fraud Builder and save people from them.
                                      1. The Elite Floor was launched by BPTP in May 2009 for 600 odd floors for Sector 85 A & B block. But due to good response and going through bad market conditions BPTP take up this opportunity and booked approx 4600 Floor against 600 and made allotted to applicants in more blocks from sector 75 to 89 and made this a project of Parklands instead of Sector 85 without giving any rate difference to the buyers who are allotted in the block other than A & B, wherein the land rate difference is existing. Initially they allotted the flats as per their wish and cheated the public by saying that allotment is through computerized Draw, but all allotments done under table as per their own wish.
                                      2. As per application BPTP has to offer the possession within 24 months Plus grace period of 180 days from sanction plan (March 2009) i.e. Sept 2012. But the same was forcefully changed in agreement to 24 months from date of agreement (May 2010) OR 30 months from date of 35% payment (Oct 09), whichever is later (May 2012). By doing this BPTP has enjoyed the crores of rupees and delayed the agreement OR even allotment to thousand of buyers, from Sept 2012 to May 2012 i.e. 9 Months
                                      3. BPTP, played a cheating game, by getting signed an addendum for deliberate inclusion of Super Built up area, so that on this account they can unanimously charge money @ 5L / Floor later on.
                                      · Accordingly, under their planned plot, they increased the super built up area without any certification of third party agency or Government Authorities or Financial Institutions. Following point have emerged, prove their illegal and fraud intentions:
                                      · Why the Built up Area terms mentioned in application form is changed to Super Built up Area and why BPTP is making Flat Agreement instead of Floor Agreement and calling 3 Bedroom Kitchen Flat in their demands instead of Floor on 180 /250 /300 Sq. Yards plot.?
                                      · I am sure that all the sanctions from competent authority will be for developing Floors not FLAT. WE have booked the Floor not FLAT hence Super Builtup Area not applicable.
                                      · Why BPTP is not giving details of measurement certified by third paty?
                                      · We are being charged a different rate of super built up area and BPTP forced us to sign it same in agreement.
                                      · As per agreement any increased are a will be charged at the time of possession, why the demand is being raised now?
                                      · Why the dealer discount is not applicable on increased super built up area if any.
                                      · Service tax demanded by BPTP, since this demand will be extension to earlier stage wise construction demands and the demands before July 2010 service tax not applicable.
                                      4. Cost of the house should not increase by 5-6 Lacs as compared to the amount which was advertised on the time of booking, highlighting the Elite Floor Project as a low cost housing project due to which 4900+ customers had opted for this project. Now market being up, is it valid on part of BPTP to raise the cost of these units by 5-6 Lacs.
                                      5. How could BPTP, having qualified architects and civil engineers, not foresee this 200 sq-ft increase of common area, not even during construction? Proposed construction plan and proposed drawing needs the approval of HUDA Authority, which is another stage of checking. Does this not reflect that mistake is not incidental?
                                      6. If this increase of super built up area comes out to be say 500 sq-ft, in that case, will the customer have to pay Rs 10 Lacs more without increase of a single sq-ft of carpet area ?
                                      7. If customers bow before this unjustified demand and pay it, is there any assurance that BPTP will not ask for further money with same or similar reason ?
                                      8. Does “Tentative increase” of super built up area as mentioned in agreement have no upper limit? Can this deviation be of 15-20% ?
                                      9. Why “Super Built Up Area” terminology was not there in the original booking application and later in Builder Buyer Agreement? Why it was introduced later as an “Addendum” to agreement? Was consent (including option of not going for it) from the customers regarding this new term taken?
                                      10. As per the clause no.1.15 of the Builder Buyer Agreement, the Final Super Buildup Area of the Floors shall be determined after the completion of construction of the said colony. This stage is yet to come, even then BPTP has asked money for increased super buildup area. Is it genuine?
                                      11. As per Clause No.1.3 and 1.4 of the Builder Buyer Agreement, if the super built-up area will decrease, then the amount will be calculated on the Basic Sale Price and if the area will increase, then the increased area will be charge from higher rate (Rs.2,425/-). Is this double standard not a method just to to be beneficiary in any case.
                                      12. Most of the customers had taken loan for it. Even financing bank requires justification and proof about the increases area to finance additional loan, in absence of which, it denies the payment. How will they convince their respective banks?
                                      13. Company has not intimated to the Bankers/Financial Institutions about the increase of super buildup area and not got re-sanctioned the revised plan and Value of the project. It is normal practice in Real Estate, that the Builder gets sanction/approval from financial institutions. Why BPTP has not done it ?

                                        At BPTP things started rolling after six years only after competent Government authorities managing this portal intervened against my complaint of 25th Sept’10. Post that complaint the company initiated some work on villas and had asked for additional money. The construction was more of an eye wash for the Government agencies as after raising demand in Dec’10 the work is stalled again. The company is least bothered to inform its customers the reasons for stopping the work which started only after six years.

                                        As referred in earlier complaints as well that the officials of the builder (BPTP) either oblivious of the actual realities or do not share the exact reason for such delays and stoppage of work but maintain the stand the work will start by month end.

                                        Will it be possible for you to take up the matter with them again seriously and help many buyers like me as I am paying heavy interest on the housing loan whereas builder is least bothered about completing the project? It seems the builder is using funds raised from this project to complete their other project. On asking for the refund the company is offering 9% interest, though it might be mentioned in the agreements (which is normally one sided) but how come they can charge 18% to 24% in case there is delay from the buyers side.

                                        I seek your help in pushing them to either complete the project or refund the money with interest of 18% (so as to have some penalty element built into it) as by paying just 9% they had luxury of arranging funds at a rate much lower than market rate which they would have got to initiate t. The other option could be to consider cost indexation method to arrive at the cost but certainly 9% is not good enough to make good the financial and opportunity losses one incurs.

                                        PLEASE HELP AS DON’T KNOW WHAT TO DO AND HOW TO AVOID BEING TAKEN FOR RIDE BY SUCH PEOPLE. ONLY THIS AGENCY CAN HELP IN PROTECTIONG THE INTEREST OF COMMON MAN WHO IS ALLURED AND GET TRAPPED WITH THEIR BIG ASSURANCES/PROMISES AND THEN KEEP ON STRUGLING TO GET THEIR HARD EARNED MONEY BACK.
