I am attaching herewith legal notice issued to the company which is self explanatory: DEAR SIR, I AM SENDING HEREWITH LEGAL NOTICE SENT TO CLEARTRIP WHO HAD CHEATED ME IN BOOKING MY TICKET TO TIRUPATHI: KINDLY INTERVENE AND CMPENSATE ME WITH THE LOSS SUSTAINED BY ME. Legal Notice Date:-23/09/2012 The Principal Officer, Stuart Crighton – Founder and Chief Executive Officer Cleartrip Travel Services Pvt Ltd Unit No. 001, DTC Buiding, Sitaram Mills Compound, MM Joshi Marg, Lower Parel (East) Mumbai-400011 Dear Sir/Madam, Ref:- Booking of Airline ticket from Mumbai to Tirupati on 01/10/2012 and Tirupati to Mumbai on 03/10/2012. Trip ID: [protected] Sub:- Claim for Refund 1) Rs 7574/= for actual extra charged (Actual paid by credit card Rs 20324+Rs250= Rs 20574 less one way ticket booked approx Rs 13000/= balance remain Rs 7574/=) 2) Rs 4000/= extra paid because of Cleartrip site wrong booking for above sector 3) Rs 15000/= for mental harassment. TOTAL claim Rs 26,574/= (1+2+3) payable with immediate effect In reference to above I checked Cleartrip site on 22/09/2012 for booking of 2 airlines ticket from Mumbai to Tirupati on 01/10/2012 and return on 03/10/2012 and showing total fare Rs 19566/=. I started procedure to book ticket by credit card and in the mean time I got call from Mr Harpreet from cleartrip portal and asked me to help on line in booking for my tickets for which I was trying through net. I told him that I will book online but he said there is problem in booking of the ticket of above sector and he will do it online without any extra cost to me and therefore I agreed to it. After that sequence of events happened is as under:- 1) He said instead of Rs 19566/= now I have to pay Rs 20,324/= due to fair change and I agreed to it and I paid whatever he said. Copy of his mail sent to me is attached for your ready reference. I paid the same amount is also attached for your ready reference. 2) After that he said there is further increase in fair and I have to pay Rs 250/= more for which he sent me mail attached which I have paid. 3) After that he said there is again change in fair and I have to pay more Rs 4000/=, in that case I said I don’t want to book ticket now and please refund my entire money with immediate effect. In that case he said he already booked one way ticket from Mumbai to Tirupati and he can not refund my entire money. 4) I spoke to his floor manager and requested that this is very wrong and cheating with genuine customer and then he said we can not do anything now. We are not responsible for this act. 5) I left with no option but have to book return ticket from another source because they were asking more money, at what ever price ticket was available since ticket cost may go up at any price and one way ticket is of no use. In this procedure I wasted my Half working day and money as well. I called many times and discussed with different-different employee but there was no cooperation received from your side. They said it happens and they are not at responsible for this act. When I asked about refund of excess payment made by me on their request, there was no satisfactory answer was received and said it will refund as per their procedure. This is illegal act and harassment to genuine customers of India. Nobody can make them fool like you do. You have equal and full responsibility towards this kind of act. This need strict legal action against you as per Indian criminal and Civil act. Being a consumer, we are aware of our consumer rights. All the consequences, cost will be at your account. In this situation I show cause to 1) principal officer of your portal, 2) Harpreet who cheated me 3) Duty floor Manager and 4) All other employee who are responsible and part of this act, In view of above, why legal action should not be taken for all the responsible person mentioned above for entire episode and loss of money and mental harassment to the genuine customer? Your written Reply should reach me within 7 days of receipt of this notice hence legal course of action will be taken in this regard.
