Delhi Gurgaon Expressway — Mismanagement of Tag Lanes

On January 16, 2010 I was traveling through Lane 20 of the Delhi Gurgaon Expressway at the KM24 toll plaza. Two cars were ahead of me, which were bumper to bumper. When I came up to the toll booth, my Smart tag beeped indicating that I was cleared to go. However, when I went through the barrier came down on my windshield and damaged it.

The explanation given by the management ie DSC Limited is that the car infront of me traveled through the barrier with my payment and that I did not maintain the "required" distance. This distance is nowhere specified.

Also, the car which was ahead of me had made its payment another car had gone through on it, while my payment was used to pay for the car in front. This indicates mismanagement of the toll plaza.

I would like to file a case against DSC Limtied for deficiency in service on the following grounds:
1. I have paid for the trip, so I should have been able to go through expecially when the barrier went up
2. the car infront of me should have been cleared off the lane before my tag gets swiped. otherwise defeating the purpose of the tag lanes.
3. My car was damaged by the barrier even after I paid for the trip

Please advise if these are valid grounds for a case against the company.
