[Resolved]  Flat Purchase — Token Amount given to not return

Hi , I was selected one 2bhk resale Flat in Kothrud in Jan 2006 , and given token amt 100,000( cheque) Rs to milind salunkhe ( Owner of the Flat) amount .
After 2 days i come to know that the flat is in Very Bad Condition and huge leakage in bellow flat , so i have cancel the flat and ask to Salunkhe to return my 100,000 Rs back . he given me 50,000 Rs back but Remaining 50,000 Rs is Still Pending with Him , now he refuse to give my 50,000 Rs back to me.

I have no Document Except Cheque Number with me .

Can i get my Money back from him ? If yes How ? Any Legal process ?
