Sub:- Misseling and Refusal for Refund

Reg:- HDFC Insuranc Plan Vide Policy No. 13436854 in the name of
Mr. Dhruv Sharma R/o 497/2, Randhir Lane, Karnal

I am Dhruv Sharma and I hereby formally wish to refer my complaint NO. 103038 & Query Ref. No. T05560781 regarding subject above for selling insurance thru unethical and unfair means & reply thereof sent through mail from [protected]@hdfcinsurance.com .

In this regard my submissions in brief are as under.

1. That I am Dhruv Sharma Permanent Resident of 497/2, Randhir Lane, Karnal.
2. That my mother Smt. Vijay Sharma Widow of Late Sh. Yoginder Parkash Sharma also resides with me.
3. That my mother had got a account opened with HDFC Bank, Kunjpura Road Branch, Karnal, vide Account No. [protected]. ( copy enclosed)
4. That my mother deposited Rs. 1000000 in the said account for obtaining forex card for traveling to USA.
5. That after observing the sound client Mr. Ashwani Staff of HDFC Bank, Sector-8 Branch, Karnal approached me and convinced my mother for opening account in sector-8 branch and transferring the whole amount by promising to provide better services.
6. That my mother got the account opened vide account no. [protected] with sector-8 branch in the joint name of Smt. Vijay Sharma & Mr. Dhruv Sharma (copy enclosed) with good faith.
7. That after some days Mr. Ashwani requested my mother to convert my amount in saving account into FDR due to job’s target pressure and assured her that she will enjoy more interest income than saving account.
8. That my mother converted the amount into three FDR’s of Rs. 250000/- each for one year’s , two year’s & three year’s respectively.
9. That FDR of one year’s and two year’s provided by branch having Deposit account number no. [protected] & [protected] respectively (copy enclosed).
10. That my mother intimated Mr. Ashwani again & again about the non receipt of FDR’s copy of three years, But Mr. Ashwani tried to mislead me by giving various excuses ( eg. Request has been put up, I have emailed many times, FDR’s copy will be sent to you after next weak and so on.)
11. That after contacting to branch I came to know that I was issued insurance plan having the premium of rs. 250000/- annually. I talked Mr. Ashwani and other staff of insurance Mr. Dua, Ms. Anshu, Ms. Shivani etc. through telephonic & orally talk because intimation letter of non receipt of policy bond was refused by the branch by making excuses ( some copies enclosed.
12. That all the facts shows that that intention was not good of Mr. Ashwani and insurance selling was preplanned.
13. That the investigation carried out by your goodself seems not fair & reflects negligency of your duties which is not expected from your esteemed authority.

In view of above it is apparent that Mr. Ashwani staff of HDFC Bank , Sector-8 Branch, Karnal (Haryana) & other involved employees thereto sold this insurance through wrongful means and unethical practices. I was neither explained any insurance plan nor I gave any consent for the insurance but for FDR for three years. This was deliberately concealed to the client and information for FDR was shared with a view to missell the product. This can be judged on the following grounds:-

1. I had never told about the insurance plan and my consent was taken for FDR for three years of Rs. 250000/-
2. I have not received any policy bond till now despite of intimating Mr. Ashwani (concerned person) and concerned branch times and again and copy of POD provided by insurance branch office does not contain my signature, the signature on POD is fake made by involved employees.
3. The address mentioned on POD of Policy bond mentioned wrong i.e. 499/2, Randhir Lane, Karnal while my real address is 497/2, Randhir Lane, Karnal and the same is also mentioned on bank account statement (copy enclosed).

May I kindly request the Manager of Management of HDFC Bank and Insurance to withdraw policies and arrange to credit my money in my account immediately and take strict action against Mr. Ashwani and other involved staff in the wrong act .Failure of cancellation of policy and reversal of money shall constrained to initiate appropriate legal proceeding against you in competent court of Law.

If my case is not resolved immediately then in addition to the recovery of my capital I may also seek compensation for mental agony and discomfort and lodge FIR against Mr. Ashwani (Main accused concerned person) to be prosecuted under section 420IPC.

Submitted for immediate action please.

Sincerely Yours

DHRUV SHARMA

HDFC STANDARD LIFE INSURANCE LTD — NOT GETTING PROPER REPLY OF MY COMPLAINT EVEN AFTER 1.5 MONTHS

Dear Sir,

I have taken a Home loan from HDFC bank for which I have taken complete insurance under policy number 13027512.
My first EMI was due on 27-Aug-09 (through ECS)
I was informed on 4-Sep-09 about the failure of ECS (Still don't know the reason why it happened. No such communication has been made till date. Only through Email I was informed that the reason is miscelleneous which is unsatisfactory)
I was out of station from 02-Sep to 13-Sep-09
I was told to submit the money by cash or check.
I submitted the money by cash on 15-Sep-09 (2 months EMI 6250 Rs) in Sec-63 office, Noida, U.P.
I was informed there in the branch that no charges will be born by me as I was not informed properly and timely.

When I received my first Unit Statement for Policy, I got to know that some amount has been deducted under Lapse reinstatement and full contact reversal. I reached the local branch and met Mr. Sachin Sharma so called manager of the branch. He tried but could not succeeded to solve my problem and finally told me to contact customer care. I have been following with the customer care since long and they are only giving me miscelleneous reasons but not the exact solution. I am here attaching some of the records of our communication and my policy statement for your ready reference.

You are kindly requested to look into the matter and get the problem resolved from the concerned department. Thanking you in the anticipation of prompt positive reply.

I have been duped also by the BAnk and insurance syndicate of HDFC group. This is one of the common practice adopted by HDFC. IRDA must deal with them iron-handedly.
this is not only you. so many persons are cheated by giving policies. if you complaint there will not any use. ( [protected]@hdfcbank.com ). but this is also no use. because all HDFC bank representatives they are doing same thing to get commission. this is also one of the biggest corruption in all private banking sector and Govt. is also for for them.if you want to fight we have fight together. you can proceed to IRDA and consumer court.
HDFC Std Life is an ugly extension of HDFC. Why the bank should target its' clients, after compromising the details of their savings accounts to their agents who are educated in an institution where values, ethics or morals are not taught!

HDFC Standard Life Insurance Co Ltd

Dated:- 11-April-2011

Dear Sir,

Subject: Illegal and unethical Sales Practices of HDFC Standard Life Insurance Company
I am writing to you regarding my recent experience with HDFC Standard Life Insurance Company when I tried to purchase a life insurance policy. I requested the policy to be issued against my legal name, Din Dayal Gupta.

However, I received a policy document number 14053316 dated 30th Nov, 2010 which was issued in incorrect name, Deen Dayal, living in Sari Rohilla which is not my correct address either.

I was also shocked to find out that the insurance company had forged my signatures, wrongfully attested my passport copy and changed my name from Din Dayal Gupta to Deen Dayal in policy application documents to enable billing against my HDFC credit card which was in my old name Deen Dayal. Please see of policy, pages 2, 12, 14 and addendum page 2 for details on forgery.

Since then I am continuously requesting for cancellation of the aforesaid policy and the credit card as well 27th Dec, 2010. Even after four months of follow up, I am yet to receive a policy cancellation confirmation.

In the meanwhile, the HDFC credit cards division wrongfully released the annual insurance premium money to HDFC Standard Life Insurance Company against forged documents and has been requesting that money from me. HDFC Cards has also piled up late payment charges against my account.

Now, both companies, HDFC Standard Life and HDFC Cards are playing football with my case. HDFC Life has so far refused to cancel the aforesaid policy and refund all balance amounts against my credit card account. HDFC Cards is also refusing to accept its error in releasing money against forged signatures and reverse the credit card charges and is asking me to fight my battle with the Life Insurance Company.

Being subject to this everyday harassment, I request your early intervention in the matter and penalize the behavior and practices of HDFC Standard Life Insurance Company. I request you to instruct HDFC Life to cancel the aforesaid policy, and advise the concerned to refund all cancellation charges charged against my Credit card account without any further delay.

Thanking you,

Din Dayal Gupta

Dear Mr Manoj Raman,
I am in receipt of Letter dated April 04, 2011 from Binita Upadhaya informing me having registered my complaint under above said complaint no and deputing Mr Ganesh R, customer service Representative to handle the above Complaint within 2 weeks and also giving Escalation Matrix in case I don’t hear from you.

I would like to share the verbal communication I had with your Mr R Ganesh on 06-apr-2011 at 10:07 on Telephone No –[protected] and appraised by him that he is closing this complaint. I am surprised to note that how he can close this complaint without giving me suitable reply on the forged signatures made by your representative and action being taken against him at your end in writing and also let me know how HDFC bank has made payment to the HDFC Life Insurance without matching my signatures. Also I am fail to understand how HDFC Bank entertained application from HDFC Life Insurance with corrections made by their representative at his own without vetting to me. More than 3 Months have passed since lodging of this complaint but till now I have not received any written reply on the above by HDFC Life Insurance & HDFC Bank in this regard.

Also I am highlighting the incidence of dated 30.03.2011, where I got a call from[protected] at 9.16 am of Mr. Sanjay Gupta from HDFC Bank, Rajouri Garden Branch, New Delhi threatening me not to get out from my home if I don’t make payment of Rs. 3300/- in shape of cash today itself and again at 11.08 am I got call from Mob No. [protected] & subsequently from tel. no.[protected] to confirm from me whether I have made the payment or not.

Being a heart & diabetic patient, I myself felt in great shock of such mischievous threatening call I had to made payment in cash against Receipt No.13063516 dated 30.03.2011 to Mr. Pankaj Khanna of M/s B.R. Associates (ID No. N04161) on behalf of HDFC Bank, Card Divn., 110, N M Road, Chennai, to avoid any mishappening to my health due to purchasing of this Insurance Policy. Since then, on every alternate day’s visit of your representative’s at my residence, I am facing B.P. & some type of shock problem due to which my hands are also not working normally and I am incurring a huge amount on medical expenses to overcome depression problems and till now I had spent more than Rs. 2.00 lacs. Immediately after one hour of releasing Rs.3300/-, towards Late charges as advised by Mr Sanjay Gupta of HDFC Rajouri Garden Branch. I got a courier dak from HDFC Life Insurance, Janak Puri, New Delhi to deliver the Policy Bond Certificate, which I refused to take as the same was sent to you for cancellation on 27.12.2010.

Again on 31.03.2011 at 12.56 p.m I got a call from Tel. No.[protected] of Janak Puri Branch, HDFC Life Insurance asking me, why I have returned this policy certificate then I told the calling person that this policy bond was sent to you for cancellation before 3-4 months back and since then you were silent and now on getting Rs. 3300/-, your people are forcing me to purchase this Policy, which I am not interested at all and I still not getting favorable response of cancellation of the said policy and now suitable reply in writing is desired against the errant person who had made forged signature in Policy Document with suitable compensatory amount incurred on medical ailments and communication being done with you in this matter.

On 6.04.2011, your Mr. R. Ganesh expressing his inability to cancel this policy and I am being forced to continue the same, which I am really not interested to continue this policy. Again, on given assurance by HDFC for issuance of regret letter to take corrective actions in future and made responsible HDFC/HDFC Life Insurance any such type of forged actions, I am yet to receive the said letter.

Being subject to this everyday harassment, I request your early intervention in the matter and penalize the behavior and practices of HDFC/HDFC Standard Life Insurance Company. I request you to instruct HDFC Life to cancel the aforesaid policy, and advise the concerned to refund all cancellation charges charged against my Credit card account without any further delay.

Looking forward to hear from you soon in this regard.
Yours faithfully,

I am also victim of such fraud. A fraud agent called me up by representing himself as HDFC bank executive and sold me 2 policies with so many false commitments. When I realized that I am trapped and complaint to HDFC LIFE in written and online so many times they didn't responded well. The grievance department staff misbehaved in phone when I call to inquire about status of my complaint and at the end they closed the case by saying it wasn't missell. They are supporting frauds or may be corrupted and taking bribe from those frauds to sell their policies, They talk really sweetly when wana take money by selling policies and then show their devil side when you got trapped. If there is anything we can get justice or file major complaint against the fraud agents and corrupted HDFC life insurance company, kindly let me know as I would like to fight harder for justice to save many more people getting trapped by such fraud money eater insurance companies.
