[Resolved]  Home Loan — EMI BEFORE PRE EMI

We had applied for housing loan in HDFC bank on 18th November 2009 and was approved on 30th November 2009 for Rs. 3000000/- which we had asked for. After that bank had disbursed the amount of Rs. 2618415/- by cheque(dated 2nd December 2009) to UNITECH. Now at a time of submitting all documents, pre emi & emi cheque on 01st December 2009, we were told pre EMI amount of Rs.17217/- and for which we had given a cheque (no. 675250 dated 26th December 2009), which was a first amount payable to bank from our side, and after that emi of Rs. 21902/- from 15TH January 2010. We were also told that you will receive repayment schedule within a week time to your address. At that time we had submited cheques as stated below
Pre EMI amount - Rs. 17217/- cheque no - 675250 dated 26th december 2009
6 X EMI amount for January - June 2010 Rs.21902/- from Rashmi KApadia's bank account
6 X EMI amount for July - December 2010 Rs.21902/- from Mitesh KApadia's abnk account.
Now after all this HDFC bank has sent a cheque of Rs. 21902/-(which is not even pre EMI amount) to my bank on 4th December (we have not given any cheque for stated date to HDFC bank) on that day probably disbursed amount was also not cleared to my builder (UNITECH).and due to mistake in date my bank had dishonored the cheque, After conveying this error to sector 14, Gurgaon Branch (Mr. Pranay Sharma) they told us that due to some mistake FROM THERE SIDE they have sent November 2010 EMI cheque of Rs.21902/- dated 15th November 2010 to my bank for clearance. Which is little difficult to understand, and said that we will send you an apology latter for the same to you at earliest. But up till now on 7TH January 2010 neither we have received any apology latter nor any feedback from the bank. Instead of receiving apology latter from bank we have received one payment due and penalty latter for the above amount and stated that payment was dishonored due to insufficient balance, which is completely wrong, because cheque was dishonored due to mistake in date, which is completely not acceptable.
How come even any EMI payment will be payable before even disbursement?
How come EMI will be payable before pre EMI?
And how come bank sent a cheque for clearance whenever bank wants?

And now we are keep on calling HDFC staff but no one is giving either solution nor any way to solve this problem.....
because this mistake spiled my loan record reputation....

I was offered an ROI of 10.25 % from HDFC Home loans for which i kept paying PRE-EMI for almost 7 months. When they started accepting the intallment as EMI, they increased the ROI to 11.50%. Then they asked me to deposit a conergence fees of 10, 000 as a convergence fees to get the ROI reduced.
They have stopped giving the details of principal and interest paid/remaining on a monthly basis online.
In case I try to get the loan transferred to a different bank, they would slap me with a 2% charges on the remaining principal.
I tried to pay online but their site was not working for 5 continous days. Eventually i had to drop a cheque on 1st of this month. My schedule allows me to pay till 5th of every month. Still they charged me with the late fees. I really doubt if their actions are really being monitored for compliance with standards. Anyways, i won't accept it as my fate and will continue to fight against these unethical practices.
