[Resolved]  KDP Infrastructures Noida — False commitment of Possession , 3 times and non commitment of KDP infrastructure

I booked a flat (in Phase 1) in July 2008, with KDP Infrastructures G-47, Ground Floor,
Sector – 6, Noida - 201301, INDIA. with a promise of Posseision in Dec 2009. Have met the chariman Manoj Goel of KDP , he asured us of possesion in march 2010, further as well the head of NH58 builders association Mr KK Goel , When he double assured us that possesion shall happen sometime in June/July 2010. However going by the status of site as on 16th May 2010..it is 150% clear that it can not happen before Dec 2010..that too if the work goes on at a good pace (which is very probable that in dec 2010 , some other reason will find its way..).

There had been other discrepencies also , for example a penalty clause was stated to be there at the time of booking, that if possession does not happen as per communicated , but the same could not be find in the agreement copy.

Dear's it is my humble request to please understand the customer plea and escalate the issue to all other people, so that others can get some benefit from it..

I agree man, these KDP people are a big craps. Anyone who is booking the flat with KDP Infrastructure, please go though their allotment papers throughly and have an attorney to review those papers before you sign anything with KDP.

I will suggest anyone who is buying the flat with KDP, not to throw his hard earned money in KDP's well. They are worst builders I have seen in my life in real estate, the owners of KDP Infrastructure are non professional, non performers and rude.

Anyone who is a victim of KDP please contribute your input here.
yes, man. I do agree with you. we are also in the same trap. The KDP is the worst builder. We also booked in July 2008. In last 8 months we have visited the place thrice. There is not even an inch progress. I think they have just looted our hard earned money. I am sure that we will not be able to deliver even in 2011.
So, pleast don't get trapped by KDP.
guys its happening with every builder...why do we guys forget its civil work, , , , its labour oriented job...
I have a flat in KDP..Infact I booked in 1st Phase which is still under finishing.even I have met management regarding possesion and all..they were very courteous..their reasons were very practical... .so end of the day I am satisfied with the quality and the their commitment towards every thing...If we consider todays scenario there are builder selling flat without being having purchased land...where as in KDP, the project is completed 80%...in many blocks finishing is going on...so relax and have patience...

Looks like KDP gave you good commision or may be u WORK for KDP.
Customers are frustrated and loosing money..KDP as builder as well as on the personal front proved to be worst builder...

If the reasons are so genuine...then why can't ur so called "good" KDP inform the same to the customers...like us.

They can always send email or call to intimate the delay and reason...
we are not against the geniune reason of delay, but in reality they failed to give any reason..Infact they niether reply to emails nor do they take the phone call.

You r the only person who sounds satisfied with this KDP ...may be u got the flat booked as gift by them... well in case... even I would have said same for them..

But yeah ... this is a public forum.. so please speak out the reality...
I am also a buyer of KDP though in phase II.
Personally i feel that being a non-regulated sector, these kinds of delays are very common in today's scenario. Even the big players like - DLF, OMaxe, Parsavnath etc. have many projects which are delayed for years. The agreement also is always in the favour of builders, and not buyers.

Having said that, KDP being a new entry to RE, i was expecting some kind of delay. Even though they have given date of possession of ph II as March 2011, my financial planning is such that possession will be given around December 2011 in *best case* scenario. That does not mean i am willing to wait for 2-3 years, and would certainly take them to court if they take unreasonably long time and give non-justifieble reason.

Almost all developers, including Ashiana, SG, Ajnara have projects running way behind schedule in the area. So its not correct to say that builder A is "worst" builder and builder B is "best builder". No builder is best today in India, and no builder is worst. Even state players like DDA, HUDA etc. are cheats.

What we need is a Real estate regulatory authority. Very soon.
even we have booked a flat in November 2008 in Phase I and I am being assured to take the possession in 18 months.As these builders are delaying the projects they are delaying it delibrately so to utilise the hard earned money of the costumers in other projects and reap the benefit towards them.
As a customer of KDP and being betrayed by him I appeal to all who are being betrayed to form an association and then address the issue approaching individually will not solve the problem.So if any one wants to be in the group he or she can give me a mail in sumit.[protected]@yahoo.co.in and provide me all the particulars such as the name, phone no, email id, date of booking and type of property so that the issue can be addressed as early as possible.
I have been through various judgements of the National Commission and Supreme Court where it was told that the delay in giving possession of the said premises is itself a kind of harrassment and a person who has gone through it is eligible for the compensation irrespective of the clause present in the contract or not...
Is there is any development in this regard, any posession date that KDP people have provided?

I had booked a flat in KDP in jul'08. Initially they told me that there is pre-emi scheme going on so i booked my flat under that scheme after 2 months they told that the there is no such schemes as RBI has shut the scheme. due to all these issues my payment was delayed by 8-9 months on which they had imposed a heavy penalty on me and now they themselves are lagging on the Possesion part. Please help me how to get rid of this penalty thing... it will be a gr8 help if any body can help me in this.

I would really appreciate if we people could gather together and discuss it over. Builders ike these are best handled by a group of people rather than an individual. I request you all just drop a mail to mme at "sh.[protected]@rediffmail.com". I have also bought a flat in phase-I of KDP Infra and the delivery was commited to be in December 2009. But I visited them today itself and the status as of today i.e. 16.01.2011 is not pleasing too. They say that they will try their best to get the first four towers delivered in March/April and others shall follow obviously suject to trend of rains ion coming season. This is at the best a clear deception and harassign o[censored]s buyers. Should we not act as one against them ??? Should we keep paying the EMIs and rents ??? Why is only buyer a mute spectator ???

my dear friend i agreed with u, possesion is a littil delay.but the quility of construction is very good and when its deliverd you will get a good home. plz take some passions, everything will be gone in customer faver
I Agree with all of your views and kind of pain we all are in but what we can do on it just see what we have done against builder, writing and posting our views in such kind of forums. we can just do this buddy accept the fact, I am sure no one o[censored]s taken any step against the builder other than waiting for some MASIHAA to come and do all well for us...The Best scenario to cross your fingers and wait till we get our possesion. And about the possession of 1st phase in KDP will take atleast 1-more year that to March 2012 (if they really accelerate the construction work in 5th gear). And those who are talking about quality lets wait boys and we all see the same after possesion, One more thing after sales, service is also one of the major issue because in landcraft (River Height) they are charging on an average 6K/flat/Month for Maintenace/Power Backup/etc. So it just like people in society living on rent.
I totally agree with the views posted against the builder. We all have paid interest free maintenance security, will it not be used for the maintenance of society or it will be part of sale price paid to builders. please clarify this subject.

I am also suffering from KDP false commitment and late possession, apart from this I believe you are also aware of some facts



1. The Kitchen marble used by them is not of same quality as shown in Sample flat. It is of infreior quality.

2. The Kitchen Shelf is just 2 feets Broad it should be minimum 2 feets 3 inches.

3. The Kitchen Sink is very very small. T kitchen is too his is not as per sample flat and it will be of no use.

4. The overall look is too bad.

5. The Sanatry used in Toilets is very very simple.

6. The outside walls are just 4 inches wide hence there are chances that, we will see seapage inside house during rainy season.

It's been 3 and half years I've booked my flat still waiting for possession (initial commitment was one year only). Last 3 years they are making fool o[censored]s nothing else. Every time you call or meet them will give you the commitment of another 3 months.
I totally agree delays can be possible in such kind of project. But my question is. How much delay? One year commitment could be 1 and 1/2 year or could be maximum 2 years but its already 3 and 1/2 years. Got frustrated from KDP :(
