[Resolved]  Maharashtra Co-operative Housing Society Rules — Max. amount of penalty charged for delay in maintenance?

What is max. amount of penalty that can be charged for delay in monthaly maintenance charges?

I am a tenant of a flat in a housing Society. I purchased a DTH connection and needed to use the terrace for the installation of the same. However, when I approached the Society chairman for the keys to the terrace. He blatantly refused saying that they dont allow DTH connections in the Society. Since they plan to go for redevelopment of the terrace they will not allow. No one has access to the terrace in the building. I requested him to allow me and if any of the work gets hindered due to it. I myslef will take it down..but he refused. I even avered that I would give it to him in writing. I even made my landlord talk to him but he refused saying he does not have power and neeeds committe joint decision for allowing a DTH antennae to be put up!. I am pretty sure even if I put in an application, he won't convene the meeting or let it happen. Please tell me is he right in his legal capacity to do the same?

Dear Sir,
I am living in 1st floor and there is leakage in Our Bathroom due to problem (water proofing)from 2nd floor. Then who will take the responsibility of repairing ? I have to pay 50% or it is total responsibility of person living in 2nd floor. Please give me advise.

I am the person living in the hsg soc in thane.actually we play cricket on every sunday and on public holiday from 12.oopm to2.oopm .Two member of our society has problem of our playing.First we use to play cricket on saturday, sunday and on public holiday at 11am. to2.00 pm but looking at THIER PROBLEM we stop playing on saturday.But they still have problem with us and they have warned us that they will take a legal action against us.So please tell me that can they take legal action against us and what kind of action they can take.please do email me on my email address. Recently I have purchased a new house in mahada colony, and not yet transfer in my name. I have one question, the society is considering me as tenant and taking the maintenance charges as if I am living on rental basis, is this correct or the society is doing injustice to me.

Archana — Maintenance of the park

This is about a park in NGEF LAYOUT, 3 RD MAIN ,NAGARBHAVI.
The park has a watchman who is not maintaining the park.
She claims that she will not maintain till paid.
Please remove her from that place and appoint another person.
Removing her from the job does't make a sense, did u tried to find exactly why she is not paid till. Don't rush for the solution simply by hiring or firing people... understand and have a insight look.

Our owner is being penalized for our keeping plants, arbitrarily and not on the basis of law. We would like to know what options are available to us. This is because the floor below us is the Treasurer and he is trying to use some coercion methods

Subject: Cost of replacement of Damaged Electricity Distribution Box.

Sir,

The fact of the matter is as given below:
The distribution box which supply the electricity to houses ( each floor has 1 box of 3 phase/2 way for two house) has worn off and damaged
in last 10 years.This is causing frequent buring of wires and Contact in the boxes.There is a possibilities of danger of fire in case of three phase getting
mixed due to faulty contact .The cost of the Box may be around Rs 1000.00( One thousand).In steps we may have to change 20 boxes


Dispute:
There is a dispute between a society member and society committee.
As per society committee the cost for replacement of damaged distribution box should be borne by society members.
However as per society members it should be borne by society committee as the box is outside the house and in the common property of the society.
It is the Society who has to replace/repair any damaged equipment/wire/cables etc in such case

Kindly guide us in this matter. who will borne the cost of new distribution box?

Registrar has appointed an Administrator in our building.The said administrator is one of the member of our
society, but he is not residing in our building.He comes after 15 days.We have informed about this to the
Registrar, he has written a letter to the administrator to fix elections, but the administrator is not agnoring
and refusing to implement.What is the solution for this ?
I am resident of co-operative society in Pune. At the time of purchasing flat, we have not purchased parking. now our society is charging deposit Rs 5000/- and monthly parking rents Rs. 300/- for open parking space. Is society allowed to make such decisions and make money on common parking. kindly can u pass on the rules and regulations regarding the commen space, and can the elected memebers on the comittee take such decisions without any consents from society members...

OURS IS REGISTRERED HOUSING SOCIETY ACCOUNTS 2009-10 IS PASSED BY MC AND CALLED THE AGM FOR PASSING THE ACCOUNTS, BUT MEMBERS ARE NOT ALLOWING TO PASS THE ACCOUNTS THEY WANTS OTHER MATTERS TO BE DISCUSSED FIRST WHICH IS IN AGENDA AFTER THE ACCOUNTS.PLEASE ADVISE HOW TO GO AHED.
I am residing at Mira road, the society which i am staying is operating illegally for past 8 years, no M20 bond has been filled.. the chairman & the secretary are also a non occupant member, they are staying elsewhere and given their place on rent. till date they have not showed the balance sheet.

We have file several RTI, but its all in vain as the registrar has not taken any action against them, there are several members in the society who have not paid their dues because of this problem, coz since 8 years they show only 2 lakhs in the bank, as deposit.

Please advise what should be done.
CAN THE SOCIETY CHARGE LEGAL CHARGES SPENT BY IT TO LITIGATE
THE MATTER WITH CO-OPERATIVE COURT TO MEMBER AND IF HE REFUSE TO
PAY THE SAME CAN THEY CHARGE 21% INTEREST AS OUTSTANDING DUES.

IF THIS IS CORRECT THEN NO MEMBER CAN LITIGATE WITH THE SOCIETY
AS HE WILL HAVE TO BEAR HIS LEGAL EXPENSES AS WELL AS SOCIETY'S
LEGAL EXPENSES TO LITIGATE THE ISSUE.

UNDERSTAND THE REGISTRAR'S OFFICE IS SUPPORTING THIS SO THAT
THEY ARE BENEFITED MORE.

IS THIS DOUBLE EXPENSES DETERING ONE TO LITIGATE AGAINST SOCIETY'S WRONG DOING.

ALSO THIS MAY BE AGAINST THE FUNDAMENTAL RIGHT AGAINST ANY
LEGAL RECOURSE.

I live in a co-operate housing society in Malad, Mumbai.
I have a car which is parked in the building premises and i also pay an annual fee for the parking according to the society rules. Recently one of my neighbor living on the ground floor had a problem with the car being parked in front of her house. As our building doesn't have much space we are compelled to park the car in front of her house. The car is at a distance of 2-3 feet from her window and doesn't block the entrance of her house but she still claims that the car causes trouble for her to enter her house and that it blocks her window and so we should park our car on the road. Since we live in a colony there is hardly any space to park the car on the road and it often get scratched due to the vehicles passing by and the construction goin on in one of the buildings. None of the society members have a problem with the car being parked in the building except for this lady.
