Co-operative Housing Society. — Parking.

Hello Sir,
I would like to state that I stay at Soni Sarovar Co-operative Housing Society at Borivali (West). We are totally 70 members in our society. Out of that 30 members approximate have been allotted Parking space from the Builder. The have been given only Rs. 10,000/- receipts for that. The other 20 members approximate have been allotted by the Society on deposit of Rs. 70,000/- for stilt and Rs. 35,000/- for open space. Now in the present General Body they have by majority of the General Body passed a resolution stating that all the members who have taken the parking areas from the Builder or from the Society will be given preference to opt their parking space to the new member entering the Building through sale and if the new member does not want then only the member who is in waiting list may get the parking. Thus all the members who own parking from the Society or Builder will sell their parking at a premium and the other 20 members who are left will never get a parking space. Thus kindly help me as to where can I file a complaint against these people and as to how about can I go through.

We live (My mother is the flat owner) in Kalyan (W), Mumbai - 421 301. Our society having managing committee, they are having an objection for owning a pet dog, i have given written request letter for allowing to bring me a english family dog in my house. They have refused my request and take the signature of all flat owners regarding not allowing me to bring a pet dog in my house. I want to know that LAW if any besides this including housing society rules (if any). We want a pet dog at our own flat because my father and mother are retired and very much old, also my daughters are small and they all are dog lover.

So kindly give the perfect guidelines for the same.

Dear Sir/Madam,
I am associate member of the flat. My society refused me to become a member of committee beacuse I am a associate member of the flat. THere argue is any associate memeber can not be committee member or chairman or secretary (I had already submitted all power of eterny that includes the clause that I can hold any position from first member of my flat owner). Can you please guide the rules.
can a managing committee hold AGM before getting approval from reisterar!s office ie after 14 Aug the committee ask for approval.
in a co-op.housing society, can secretary keep society documents in his own custody?

i have problem with my neighbour. They always keep the dustbin bag and scrab in the lobby opposite to our door i gave complain and writing letter our society but they are not taking any action. But if some guest comes to our house it looks very odd and and most of the time they keep function and keep their furnitue in lobby how i can take objection please tell me
I am living in a co-op housing society at Kothrud, Pune. About 3 years back our society officials have decided to rent some of the vacant area of the society land to a company for the commercial usage. For the consent of every member on this, a notice was circulated, which I did not sign as I was objecting the same & I am still against the same.

However the agreement with that company was made by the society officials & the land is rented. The company (to whom the land is rented) has built an AC room just in front of my flat to install the machines. The split AC unit to this room has 2 fans & with regular intervals these fans are getting on & off & more importantly making large noise. The surrounding are of this room is also not cleaned regularly, causing unhygienic conditions.

Tomy knowledge the Sale Deed with the builder has not been made so far, whereby the entire area of the society comes under the ownership of society.

What I would like to know is if the Sale Deed is yet to take place, whether society officials have the authority to rent any vacant land for any commercial use, that too when some members have objected to it ? And what is to be done to remove this unit from the society, which is making lot of noise & disturbing the whole purpose of peace for which the flat location was chosen.

Your early reply/guidelines would be highly appreciated.

how much can a co-op housing society spend on yearly pooja and dinner for members of the society
As per the AGM decision(two years back) our society collecting Rs.1, 000/- per month towards shed work of the society building (contribution calculated on area wise). But some of the members are not paying the same.on 08.01.2012 we have a special AGM, and decided to pay full amount of shed work each and every member by 31.01.2012.But there is no positive response from our society members side. In this stage it is diecided by the managing committee to repay the amount already paid by the members. Is it any legal problem to repayment of the said money. please clarify the same.

whether it is on per sq.ft area of flat or it is on No. o[censored]nits in Society

I am staying in the society from last 4 yrs the flat is in name of my father, for which the society had objected, Reference to the same my father than gifted me the flat and we got it registered in my name, Now the society is not making me the member of the society and put some condition as undertaking that should give it in writing the I will not involve myself in any society matters and dispute

What do the society bye – laws say about dumping of junk material / shoe racks in the common passage opposite lift or outside the individual’s flat but in common passage . What action can be initiated by me as the Managing committee members have failed to get it removed and few of the so called MC members themselves also follow these practices. our society is not providing balance sheet and audit reportts to any of the members of the society, as a member i wud lyk to know what is the action to be talen against such society for such default.

Dear Sir,
I have living in Shivtirtha nagar, kalewadi, Pimpri, Pune - 17
My flat no is D25 which is lying on 5th floor.
But on 6th floor one flat which is just on my top, The flat owner of that flat is working commercial work on his flat. They are doing some metal, iron job work so i am facing continuously sound problem & we are not concentrating on our mind due to this.
So please tell me is there any rule for this so that i can take action on this,
I told him almost 4-5 times politely also told society member but still he is working

My car is parked in society designated parking slot and i regularly pay parking maintenance charge as well. all affairs of parking related matters are handled by society.

recently my car was parked in society premises and got damaged by unknown person. I am trying to claim insurance company but they shall pay only partly compensation.

Is society is liable to pay for compensation to member ? Can i take legal action on society ?
