[Resolved]  Mahindra Holidays & Resorts India Limited — Cancellation of Membership

Hi!

My father got a club mahindra membership in the month of August 2009, the down payment was 15000 which was paid at the time of booking thru credit card transaction, he took a 60 EMI plan at about 3500/month for 60 months, the tier booked was Blue Studio, since the plan is structured in such a way that he can only take his first vacation in 2011 he has not availed of any services from Club Mahindra, now he does not want to continue with the membership and wants the initial amount as well as the 4 EMI's that he has paid back from club mahindra, upon approaching them they show a clause that is part of the membership rules that the cancellation has to reach them within 10 days of the booking and that if he cancles now he will have to forfeit the booking amount as well as the EMI's paid till date. the other option that they are giving is to transfer the membership to another user, but they are unwilling to help in the transfer.

I want to check if there is a redressal for such issues, he is 69 and cannot continue to pay the EMI.

Pl help can i approach the consumer court with this issue, will it be of any use
