I have also cancelled my booking (Nirmal Lifestyle Kalyan), and they said me that they will refund the money in 6+ months.They have also said that they MIGHT deduct 4% from the paid amount. Which is not good at all, I have sold my gold ornaments and withdrawn my PF amount for the payment, Hope i get my entire paid amount soon, they have also said that there are very few chances of deduction and will all the paid amount.

They will refund the amount after the flat is sold to some one and his 20% payments is done, after that it wlill take around 1 month to do the processing.

I[censored] have any update please let me know.
Hey friend I also cancelled my flat and they assured me same like you but in my case I didn't sign any agreement nor I signed allotment letter that's why I am not liable for any deduction.

There are 3 more people who cancelled their flats and they are still struggling for money back.

Friends lets gather together and FIGHT FOR YOUR RIGHT because there are many stories (shattered Dreams) which are spoiled by this builder. I heard some of them,
Middle class families (Likely Common Man). They had strong desire to buy their own house. Most of them was lured and harassed by this bluffers because they are easy prey for builder. Some of them sold their gold, withdrawn their PF, borrow money from relatives and someone even started doing overtime and part-time jobs to fulfill their own contribution but after investing own contribution they only got some peace of receipts, false commitment and harassment. And now when they all are going to ask for their money back then they have to go through deduction, false commitment, and threatening warnings (law).

i totally agree with all of your views regarding Nirmal Kalyan property. I had also booked in June 2011, already paid 20% and 80% loan already sanctioned (3 time sanctioned from diff. banks, just because of miscommunication from nirmal officer due to which i have a loss of rs.15000 towards process fees 2 times). Till date, no one from nirmal not yet clarified that why they are not doing agreement. now new tension given that there is one new Govt Circular regarding 33% stamp duty registration to be paid by property owner i.e. we all. I need more information & clarification on this. Is any one help me on this.

There is no such circulation for 33% stamp duty and registration by government.
Don't listen to them and don't even trust on them.

Simple solution to this problem just cancel your flat, At least you will be in peace of mind.
This project is not yet approved by KDMC (As its on forest land and facing some dispute with villagers) and they does not even have CC above 7th floor.

Choice is yours..

The guys at Nirmal lifestyle are cheaters, they promised the possession of our flat in Excel by 2011. There is no sign of excavation yet, leave alone the construction.On enquiring about the cancellation of the booking and the refund of the earnest amount, they replied saying that according to the company's policy, there will be a 4% deduction of the booking amount and it will take a minimum of 8 mnths to refund our money.While booking the flat there was no mention of this policy either by the sales executive nor in writing. How can they demand a cancellation penalty? They infact should pay us the interest we wld have earned (min10% pa) if invested in a fixed deposit in a bank or give us a ready possession flat.
We are not yet received any positive updates in regards of construction of Excel building. It was very disheartening for us that, we are receiving only one answer from your reps.that awaiting CC from KDMC for excel issue. I don't understand that, only excel building is left for construction among the 8 buildings which supposed to be constructed in 1st phase. What is the actual issue with excel site ? Why KDMC is taking so much time for providing CC..? Apart from 1st phase, I think 2nd & 3rd phase building construction is being undertaken by you. Pls. let me know the latest status of excel building.

It is difficult for us to obtain 20 yrs. loan from Nationalized banks for the booked flat. As our age is running out & bank will not approve our loan for max. years. Pls. take some necessary steps for the said long pending issue. We had paid almost 3.70 lakhs (20%) amount of flat since long back.

Secondly, I want to bring some serious issue in your notice that, as per your suggestion my brother has shifted to Glory - 1404, from excel and paid more than 50% amount of flat (upto 5th floor rise). In the month of Mar 13, he has done the registration of the said flat.

As, he is salaried person and has salary account in Bank of Baroda. Initially he had applied for the loan for balance amount of flat with BOB. The matter was discussed with your finance executive (Mr. Harish Menon), he instructed that to apply loan with State Bank Of India. Accordingly, he had applied loan with SBI but Executive from SBI asked my brother to provide the following documents enable them to process the loan formalities.

1. Documents in regards of project approved by KDMC.
2. Clearance certificate (CC) received from KDMC upto which floor.

When My brother asked regarding above mentioned documents with Mr. Harish Menon, he was simply denying to provide the same and adamantly behaved with my brother. Today when I spoke with him in regards of the same, he has given only verbal confirmation that the glory building has received 10 floor sanctioned from KDMC but on discussion it was observed that, he is not willing to provide the documents which are asked by SBI. Moreover, he insisting us to apply loan with HDFC, Andhra & ICICI bank which you had tied up. It is our will & wish to obtain loan from any Nationalized banks, your representative can not detect his terms & conditions for the same. We request you to ask your person to provide the above mentioned documents to SBI Banks so that my brother can pay the balance money in installment through SBI. Mr. Menon is insisting my brother to pay the amount upto the floor rise (6, 7, 8 & 9) otherwise penalty / intrest will be charged for late payment. Being a representative of Nirmal Lifestyle, his way of conversation with the customer is not upto the mark. Today, when i spoke with Mr. Menon & Mr. Narendra arora, they not even shown their courtesy to listen our issue. Mr. Menon told me to go at any extent, we will not change our terms. Your reps. can not behave like detector with his customer. he can not forcibly insist his customer to do the thing as per his laid down instructions.

If, we get low interest rate from other bank and we are comfortable with SBI then why your people insisting to go with your approved banks. Why can't they provide the required documents to our Bank.

Request your kind intervention on the said matter. Kindly ask your representative to provide the required documents to SBI so that bank can disburse your floor rise payment. We are not going to pay any penalty for the payment which has been asked by your representative. Pls. note that, there is no delay from our side as the loan has already approved by SBI and matter is pending due to non receipt of above documents from your side.

If, all the thing are approved from KDMC then why can't you provide the same to SBI.

Still, we are not getting proper response from your sales as well as finance team. Both the teams are pointed their finger to each other when we asked some queries related to the Excel building. You are the last option left with us to get our queries resolved.

Your early reply will be appreciated on the said matter.

As discussed in last meeting which was held at Nirmal Lifestyleoffice, Mulund with my brothers (Mr. Rajendra & Mahendra) and Mr. Sameer, that time you had given options to us to exchange the 1 ½ BHK Flats which wasallotted to us in Excel B Building into 2 BHK Flats, as there is some disputein obtaining CC from KDMC. Based on your options, My brother Mr. Rajendra BGovalkar only, had opted option to exchange the Flat from Excel – B 1204 toGlory – 1404 B Building ( which has 2 BHK Flats) . According to yourexecutive/Manager Mr. Pravan singh., my brother has completed all theformalities including the amount Rs. 3, 91, 000/- has already been paid toyour account staff for extra Space but it is observed that from 1stJul 12 to till date, you A/c department has not deposited cheques into NirmalLifestyle account.


This is to inform you that, My brother has taken loan from thenationalised bank and monthly Interest amount will be deducted from hissalary from next month’s onwards. Why should we bear the charges due tonegligence of your A/c Dept.


Therefore, it is requested to you to withdraw the abovementionedamount from Rajendra’s account at the earliest and issue the allotment letterto him for exchange of Flat from Excel to Glory Building.


Secondly, It was informed to Pravan singh, Manager that Myself, Mahendra & Sameer are not interested to opt your 2BHK Option as it isdifficult for us to pay the extra amount which was calculated by your Reps.Request you to confirm us when you are going to start the work of ExcelBuiliding or at least forward the tentative date of possession, so that we willplan our budget.

We (myself & my 2 brothers) had booked 3 flats (1&half BHK – Area 675 Sq.ft) in Excel Building at Kalyan project in 2010. At thetime of booking, your sales executive (Mr. Nikhil Joshi) had confirmed to usthat the said building project will get completed by Dec 12 and possession willbe given to all members by Jan 13. Now, we had visited at site and found only 2building (Adavantage & applause) works are in progress and Excel work isnot yet started due to non availability of CC from KDMC.


Many times we had visited to your Mulund office and askedthe people regarding possession of our Flat & work progress at sitebut they are not able answer our queries. Some people told us that, construction work for Excel building will not be initiated because in previousplan, the space was approved/allotted for construction of school and there issome obligation.


Today (24/5/12), I spoke to Mr. Pravan Singh, Site in-chargeat Kalyan and enquired whether Excel building is going to construct at the saidproject or not. I don’t understand that, if your project is not approved fromKDMC then how can you print the pamphlet for the building and how you canallot the flats to the buyers/customers?


We had booked our flats because of your fame & earlierprojects which you had done successfully at Mulund. Till last year we had seenyour advertisement in newspapers and from Jan 12 onwards we have not seen anyad in newspaper. Can we know the reason? We heard that, you had givenpreference to riverside project first and our building project is not yetstarted. Mr. Pravan told me that, the Excel building work will get start soonafter monsoon or else he can accommodate/allot flat to us in ongoing buildingproject (advantage & applause) but we have to confirm him whether we wishto accommodate in 1BHK or 2 BHK flat as these building do not have 1 & halfBHK flat. If, we wish to go for 2BHK flats then you charging the present ratefor the increased area from the allotted 1 & half BHK area flat which wasbooked by us. We are not going to borne the extra charges.


Request you to confirm us the exact status & details forour Excel building project. We had invested approx. 3.5 Lakhs each (20% amountof the entire flat cost). We will wait till monsoon, if you confirm us that, Excel building project will be getting started soon after monsoon. We keep oursilence till date based on your people commitments on possession of ourFlats. Request you to tell us the truth. We are expecting your favourably& early reply on this matter.

We are 3 brothers & have booked flats at Nirmal Lifestyle project (excel Building) in Jul 2010 and paid around 20% amount of the overall flat cost but still construction of the said building yet to be started and always received only one answer from their all reps. that, KDMC has not yet given CC for the said building. Many times we has visited to the actual site location & Head office (mulund) but the Nirmal staffs are not co-operating to resolve our queries. In fact they are behaving with us like detector. They even not shown their courtesy to listen our calls. They are very adamant and moreover, they are asking customer to apply housing loan with the banks which they have already been tied up. My brother who has shifted to the glory building as the excel building construction is not yet started. The same was insisted by them only. Initially he was applied loan with Bank of Baroda where he has a salary account but one of the account reps from Nirmal told him to get the loan from SBI. Now, after taken approval for loan from SBI the same reps. is forcing him to go with their tie up banks ( ICICI, HDFC, Andhra Banks) as he is not providing the documents (KDMC approval & CC received for the project) which has asked to provide by SBI. On discussion, he told me to go to any extent for the issues we will not change our terms & conditions.

These people are enjoying to have interest on our money since last 3 years without giving any updates. Request your help & solutions.

I would appreciate the initiative taken by Mr Shailendra and brought out all the information in a very structured way . I have also booked flat in Exel building in 2010 and paid the earnest amount(20%). I dont understand why these people (Mr Pravan Singh, Mr Dinesh Suvarna, Mr Narender Arora...etc) dont give us clear picture of what is happening with Exel building, whenever i have inquired they say no updates till now, but u can opt for change in accommodation and rates very high. Why we should pay more for your company fault. i am happy with my flat.These people only have signed and given us the allotment letter and told that possession will be in Dec 12...Dec 13 so on (Now they r saying they dont know anything but when it will start, it will take 18 months) what does this mean. Excel building is in 1 st phase it should have been started earlierer than rest of the project its location is also good, i dont know what monopoly is going on.
Friends we should communicate with each other and keep others also updated through this forum for timely action.

hi.I booked a flat 21/2 years back in platano. I paid huge amt and was promised posession by 2013. However I started getting calls for making bal payment. When I went for site inspection there is still no infrastructure as shown inthe model.It is a jungle out there. The work is very slow. Recently I got a letter from Nirmal that my booking is canceled and amt paid by me is forfieted. This seems to be a scam.Bilal

I have also booked flat in Excel building of Nirmal Lifestyle, Kalyan project in Jan' 10. Since it is more than 3 & half year passed away but they are not giving the proper answer. While purchasing the flat they said that we get flat ready by Dec.' 12 but still the registration is not done.
I am leaving in Rented house with my baby & my wife we are waiting for our own house. We are fad-up of go on changing the rented house. I hope after this monsoon they will start the whole process & we will get our house very soon.
I booked in Amazon in 2010 on the 10-90 scheme and paid 5.4L. When construction did not start even after 2 yrs I cancelled my booking last Nov. Got confirmation from Nirmal that my booking was cancelled in Jan 13 and I will get refund after 2% deduction when someone books same flat. Now even after 10 months there is no response.
