[Resolved]  Personal Loan — HSBC Bank fools its customers

Hello,

I have taken a loan of Rs.50000/- form HSBC bank at Chennai in February 2008.

My Loan Account Number is "[protected]".
I have already opted for an ECS facility for the deduction of the EMI.

Later I got married and had shifted to Pune. When the time of first EMI came the amount was not deducted from my account. One fine day one collection executive from HSBC has gone to my house in Chennai and threatened my parents. Later when I called the collection executive he gave me his reporting boss' mobile number. When I spoke to him he said sorry and also informed me that the ECS facility did not get activated due to some error.

Whose mistake was that?

Later he asked me to either pay the EMI in the bank in Pune or give it to the collection executive. I have never missed my EMI and have paid it when ever they came for it. In Sep 2008 I have paid the EMI in the Bank in Pune (as the executives always came towards the end of every month) and I even have the payment slip with me.

Again I got a letter to my Chennai address on Oct 13 2008 stating that my two months EMI was overdue (SEP and OCT) and that it will be informed to the Credit Bureau.

I had already asked the collection head (whom I used to contact for the payment), regarding the total amount to be paid for FORECLOSURE as I have paid seven months EMI. And he told me that 10% will be waived off and there will not be any Foreclosure charges as I have been paying
the EMI regularly.

He took nearly a month to confirm the amount and send the executive, when I asked whether I can pay in Pune branch he said it is not possible as it is Chennai account. I paid the total amount of Rs.35000/- specified by the collection head on 30th Oct, 08.

When I asked him about the outstanding letter which I received on 13th Oct, 08, he said it is a general letter and if I settle the whole amount my name will not be updated as a defaulter in CIBIL.

But today I received the "Settlement letter" which clearly says that I am a defaulter for the past two months and that because of my individual circumstances the bank has waived of certain amount and come for settlement. It even states that my name is updated in CIBIL as a
defaulter. I don't want to make any settlement. I am ready to pay whatever is Liable to me.

When spoke to the collection head regarding this he reacts very rudely. He has actually done a Settlement instead of Foreclosure. He has done it so that he can gain some name that he has recovered some money from a defaulter. He has used me.

I got the information from bank that the reason for settlement has been that I have met with an accident an am unemployed.All these are false statements. I have not signed any settlement letter then how can the settlement be initiated.

I have a doubt that even my signature has been forged.

Later I sent mail twice to the nodal officer in Chennai, but still I did not get a good response. And in November I went to Chennai personally, at that time they told that the remaining balance should be paid and then they can foreclose it. But the remaining balance was high due to the interest charges (for which they where responsible).

But still I agreed to pay. They asked me to contact the Pune HSBC (customer Service) person Mr. NITIN RAO. They asked me to meet him and collect the foreclosure letter and make the payment. When I went and met him,he says that my account has been sent for write off.

I got my cheques back. My name has been updated in CIBIL. Now every one says no one can do anything.

Pune people say I have to talk to Chennai and vice-versa.

Questions need to be answered:

1) Am I responsible if the ECS facility is cancelled? How can the executive go and threaten my parents when the mistake is in your side?

2) Am I responsible if the loan amount paid is not updated in the banks
systems since Sep, 08?

3) Don't the bank people know how to handle customers!

4) How can the bank write anything in the letter? I am not in any poor position. I am well settled and no longer needed to continue the loan.






Things I need:

1) I need a letter from the bank stating that it was their mistake and it was nothing from my side.

2) I want a letter from CIBIL that my name is not in the defaulters list.

3) I need a letter that FORECLOSURE has been done, I don't need any settlement letter. (NO dues Letter)


I can name each and every culprit who is involved in it.

I have the bank slip and track record of all payments.



I have the following documents with me.

1) EMI payment receipt for August 2008.

2) EMI payment receipt for September 2008.

3) Total outstanding payment receipt.

4) Letter received from the bank dated 13 Oct 2008.


5) Letter received from the bank dated 24 Oct 2008.

6) Closure Letter


But I am helpless now. None of the bank people are taking responsibility.

They behave rudely. Kindly do help me.

Even contacted Nodal Officer but to no avail.

This is my final try. If I do not get a resolution for this, the last option for me would be to go to the Banking Ombudsman Scheme(RBI).
