[Resolved]  Reliance Communications — Non Refund of security Amount

Dear Sir/Madam
On behalf of my client Shri Laxmi Narayan [censored]al, s/o late Shri Murari Lal Sharma, r/o 12, Type-4, Sector-B, Piplani, Bhopal-462 021, I hereby serve upon you the following legal notice:

In the first week of October 2007, after shifting from Dehradun to Bhopal, my client got changed his Reliance FWP number at his Bhopal address-A 56, Siddharth Lake City, Anand Nagar, Raisen Road, Bhopal-462 021. He was given FWP number:[protected].

In the third week of April, 2008 he requested you to permanently disconnect his FWP connection number i.e.[protected] and he surrendered his FWP hand set. At that point of time he was assured that he would get his security amount back within 45 days time period.

In August, 2008, after four months, on failure on your part, he reminded your office for the delay in refund of his security amount. At that point of time your explanation was that since he had not got changed his address while transferring his FWP connection from Dehradun to Bhopal, so, Reliance office at Dehradun was handling this matter. While making this lame excuse, you forgot the fact that in October, 2007, after shifting from Dehradun to Bhopal, he had gotten his FWP number changed and at the same point of time he had gotten registered his changed address in your records, also. It was: A-56, Siddharth Lake City, Anand Nagar, Bhopal-462 021. Later, in December, 2008 he got changed his address in your records. It is: #12, Type-4, Sector-B, Behind Piplani Petrol Pump, Bhopal-462 021.
As he had already got registered his changed address in your records and had Reliance number of Bhopal only, how could Dehradun office of Reliance Communications handle this case?
My client continued with all his efforts to take refund of his security amount. He made several calls, sent many mails and then finally in the1st week of April’09, it was promised by your office that he would get his security amount back within 10 days.
This time also, nothing was done at your part. So, he sent you a last reminder on 12/07/2009 requesting you not to harass him by making this or that excuse.
I regret to mention here that all his requests to refrain from unfair trade practice and to make good the deficiency in your services fell on deaf ears.
Undoubtedly, you must appreciate his point of view that deliberated delay tactics of your office caused a lot of mental torture, harassment, and financial loss to him.
Please note, that he is a COSUMER under The Consumer Protection Act-1986. And, this is a clear case o[censored]NFAIR TRADE PRACTICE under section 2-c (iii) and DEFICIENCY IN SERVICES under section 2-g of the aforesaid act.
As the details of communication, given above, prove that he has reported the matter to you several times, but, despite all his pleadings, you have neither made good the deficiency in your services, nor stop your unfair trade practice, which is indeed regrettable and highly un-business like. On account of your aforesaid dereliction of duty and failure and neglect to rectify the same, he has suffered losses/incurred expenses of Rs. 50,000/= which you are liable to compensate to him.
You are hereby finally called upon to pay compensation for financial loss/mental harassment/interest due to your unfair trade practices, deficiency in services and negligence in the sum of Rs. 50,000/= with interest @15% per annum within 15 days of receipt of this notice failing to which, I shall be constrained to initiate against you for redress of his aforesaid grievances and recovery of the aforesaid amount. Such proceedings, both civil and criminal as are warranted by law, besides filing a complaint under the statutory provisions of The Consumer Protection Act-1986 exclusively at your own risk, cost, responsibility and consequences, which please note.
