My house on June 05, 2010 was demolished on the order from the Dy. Collector, Mr. Yeshwant B. Tidke as I was not ready to vacate the place on the ground that my house where I was staying is a private land and I had paid rent to my landlord till March 2009 (Staying since last 44 years). I had filed with RTI and even got a reply from RTI that CTS No. 708, 729(pt.), 732 & 732 1 to5 is not yet approved under SRA. I had even written to the Dy. Collector with enough supporting’s to prove that this land is a private land and copy of RTI filing was also submitted. My son had even met the Dy. Collector alongwith the other tenant whose house was also demolished.

Our house was demolished and we were forced to vacate (My family consisting of 9 members – including 3 senior citizens & 2 children). The demolition squad entered our house from the front & back door as if we had committed a crime and they took all our belongings and loaded them into a truck without our permission. Our house was demolished with the help of a Bulldozer and our belongings were dumped into a small house provided by the builder which could not even accommodate half of our belongings and they dumped the rest into another room which was provided to another tenant whose room was also demolished. We had even approached the Police Station to give a complaint regarding the cruel demolition of our house; they also refused to take a complaint.

We have still not got any documents in writing from the Dy. Collector, Builder or Landord on this cruel act of demolition. We do not have any agreements signed with the builder till date. We had visited the Builder’s office on several occasions and even written to the Dy. Collector but we are still to get any reply.

On October 4, 2011, I received a call from one of the tenants in this Society at around 9:30 pm. He had called to inform me that the builder (Himmatlal Kacchara) had given him a call regarding allotment of flats on a draw system. I was completely stunned to hear this as I have still not received any document / agreement signed yet and builder was going for a draw on (October 5, 2011). Of 30 member society, 15 members are not eligible. How is it possible to form a society with only 15 member’s eligibility? This building has 12 floors what does it mean?

During end of December 2011, I received a call from builder’s office to come and collect the keys of the newly constructed building (under SRA name) as the house where my belongings were dumped need to be vacated. The builder said he will get my household belongings shifted with the help of Dy. Collector advice to the house allotted in the building under SRA and then I will have to collect the keys from the Dy. Collector.

I had visited builder’s office during 1st week of January 2012 and had a long discussion with the builder (Himmatlal Kacchara) but with no results. He is only ready to give an area of 269 sq.ft. as per the SRA rule.

The builder has started his construction work on the plot facing the roadside where my house was demolished. I am fighting for my right which I am not going to give up. I am absolutely clear that this plot is a Private land and they are developing it under SRA for their benefit. I demand a house with an equivalent area in the Private building for my house which was demolished which I believe is right and should get it. Require support from everyone in this regard

Now it is also being heard that the builder and the landlord & builder is having a tussle among themselves and the landlord has filed a case for claiming that this land is Private land and not an SRA. This will now be like another case of Adarsh Housing Scam which we need government to interfere and resolve the issue.

Dear Sir,
Please refer to my communications since last 2 years. You have still not given any reply to my communications after my house been demolished.

I am still confused what is happening on the allotment of my house which was demolished on the order from Dy. Collector, Goregaon. My entire family is houseless and still waiting for a positive reply from your side. The builder has even made me vacate from the temporary accommodation provided and he is also not paying any rent since then. This is really an injustice done to me and my family.

The builder is now trying to accommodate the tenants from the adjoining plot, even before giving possession / settlement done for the original society members. He has even started selling off flats to outsiders. It has come to our knowledge that 2 flats are already sold out, how is this possible. Are you not aware of these illegal happenings?

Now I am really worried what is happening on this project. I really need your intervention on this matter as I still have some hope that you will look into this matter seriously and find justice for my rights.

I am fighting for my right which I am not going to give up. I am absolutely clear that this plot is a Private land and they have developed it under SRA for their benefit. I am only demanding a house with an equivalent area in the Private building for my house which was under a Private land and was demolished for their benefit, the house where I had been staying since last 44 years.

If you still feel that I am wrong and the builder is correct, please provide me a go ahead letter to accept the keys from the builder.

Meanwhile, I request you to instruct the builder to pay rent for my accommodation from the day I have been made to vacate from the temporary accommodation.

Same situation is with us
We had a land in kurla east near station
Today 1/4/13 the builder landloard dy collecter sent and order to dimmolish the shop

We 19 tanent all shop owener couldnt do any thing and kept watch the dimolish
The sra rules are useless builder landloard and dy collecter
Are useless and just intersted to put all money on pocket

We poor people hav no place to earn money now

Draft a proper letter and take all the 19 members signature and send the copy to the Dy. Collector who has given the order for demolition and mark the copy to the SRA office.

Also, send a copy of the letter to the SRA office with Court Fee stamp affixed.

Send the copy of the letter to the Consumer complaints and keep on updating on the same regularly.

Do not give up.

In our case I have still not given up. I am alone still fighting and believe that I will get my rights done.
