[Resolved]  Rustomjee Global City Virar — Delay in construction work

Hello All,

I booked a flat in Global City at Virar in April 2009 and done the agreement in July 2009.
I was promised that I will get possession of my flat by May 2010 at the time of booking.
When I did my agreement they said you can get possession after by July 2011.
I thought it's a big project and might take little longer to complete. So I keep quit then.
And now the problem is during this 2 Years of time they even not completed the First Slab.
They have already taken money for second slab, which is from my Home loan.
I sold my old flat in a hope that I will get the new flat by 2011 and can shift there.
I am thinking for next 2 years they can't give me my flat.

I am paying house rent with home loan interest to my banker. For both the expenses I have to pay around 7 thousand every month for nothing. I don't know what to do now.
I can't go to court for the same because I am a working person and it's very time consuming.
And have no legal idea for the same.

Anyone is there who can help me out for the same.

Hi All,

Just now I had called to Pradnya (Sales Excutive) in Global city. She informed that builder had started giving the posession. They had sent the leeters to cutomers for full and final payment and take the posession.

So Just chill now!!!111

Yes, I also got a call from Rustamjee to complete the formality regarding the possession of my Flat at J Avenue.

Hi...Mess is not yet finish...they are charging interest like anything...which is not at all ethical and acceptable. He is charging interest almost 18% for delay payment. My question is that why did not he mentioned or tell us interest rate in demand lettler itself. After all demand letter is something due money pay to builder. So if he wanted to charge interest...he should mentioned in demand letter. But unfortunately this time also we have to pay interest unwillingly. Now as every middle class we need home earliest possible and because of that builder is is taking undue advantage by charging such interest. He know that after making some noice everyone will pay interest as we need home desperately.

I heard that the builder is charging the 18 % interest on service tax amount. Is this correct or not?
After making payment, have you got the posession or not? Or Still builder is giving any excuses.

I don't live in Mumbai but my parents visited the site last week.

We bought a 2bed-er in Ave H and we were told that because of delays, the unit would not be available before Dec 2013 (original proposed date was Dec 2012 - when we bought it in Dec 2010).

Work has picked up and things are in motion and by the sounds of it we will be getting possession in August 2013.

Since we dont have a pressing need, the delays work for us to lower our borrowing needs, we have taken personal loan and spending savings and thus dodged the home-loan bullet.

Hope things work out for all.

yes they are charging interest @18% for delay in paying service tax.
Hi to every one, just been to site on 28th September, things are moving, but not at the space as they should, For the H-avenue structure for 20 buildings out of 28th has been done, for other 8th some where 3rd, some where 2nd, and some 1st floor has been completed, while some are still at plinth level. At this stage really difficult to say whether we will get possession at least in 2013. But the sales people are really optimistic they keep on saying next year .

One more thing to ask has anyone any update on VAT to be paid.
Any News on Possession. Have Booked flat in 2009 in J7 Avenue...
I have booked a flat in Rustomjee, Virar all procedures hot over in 2009 onlt. POseession was supposed to get in 2012 June but till now nothing.
There is a huge delay in their work i am paying a rent of 6000.00 and also bank installments it is very frustrating.
This is a complaint - Rustomjee Virar very late in the work procedure and hell lot of delay.

To Those who have got possession in Ave J -

1>Have they charged you additional amount as a hike in consturction cost? If so how much is the additional amount charged?Agreement has a clause that says there can be additional charges if construction cost goes up?


2>Are they providing you the parking space if so is it free(I doubt) Or how much are they charging ?Does your agreement paper state anything about the parking space?

3>Regarding 18% interest - Had they told you at time of booking there will be interest for delayed payments in written?

As earlier I said, We all should go together to ask the rustomjee " What exactly is going" before too much delay.

Finally I got possession….and now a days I am going there quite frequently to stay. But water issue is still there as VMC water line is not yet connected.

Please let us know if I can help you in anything before possession as well as after possession too.

I am also one of like you who had face this issue but now lucky one who got possession.

Just can u tell how many Buildings and which avenue they have given possession,

I too have booked flat in h-23 in 2010 but still 2nd floor has not come up waiting my building to come up.

Same problem and even more with me.
Flat possession intimation send in Aug 2012 and the Flat is still not ready. Cracked tiles, painting not completed (forget what was promissed in the Sample flat (painting), that's nowhere near the actual flat.)
Also, possession in Dec 2012 and they talk about charging maintenance from Sept. 2012. Cheques have already been taken in advance (Aug 2012).
