[Resolved]  Shanvi Estate / Omaxe — Maintenance Charges

I had purchased a flat in Omaxe NRI City, the possession of which was given in october last year. But, the maintenance agency (Shanvi Estate) appointed by Omaxe on its own discretion has levied the maintenance charges from date earlier than date of possession.

The argument of Shanvi Estate is that they will charge maintenance fee from the date offer is made to the customer, no matter what. But, the delay in possession was due to unaccetable condition of flat, which was brought to some level of satisfaction when the possession was taken. Now, this dispute is hanging between Shanvi and Omaxe and I am getting harassed in their processes.

Moreover, their is least response from Omaxe's end and all of a sudden they get up and demand the outstanding amount.

I registered a complaint with Pehredar as well but to no avail, they followed up the matter couple of times but they neither reply to my mails or pick up the phone these days.

Please advise how this matter can be concluded.

If a flat owner is denied the possession of a property at the time promised by the builder (as per the purchase agreement), then builder has no right to claim any amount of maintenance charges towards that property since its possession has not been handed over to the owner. If the flat buyer is not handed over the possession of the property, demanding any maintenance charges for that property would amount to illegal action.

I HAVE FELT THE BRUNT MYSELF IN MY DEALINGS WITH OMAXE LTD. THEY ARE BIG CHEATERS, NEVER DEAL WITH OMAXE.

Omaxe and their sister concern - Shanvi Estate management are known well enough for their deceiving policies, and cheap tricks & fraudulent techniques to extract money from the buyers. They will first sell the property to the buyers under certain terms and conditions. Eventually, they will demand some payment towards the construction of the property before the stipulated time. In the meanwhile, they will also impose Premium Location Charges for the same property for which they initially promise no PLC.

If the buyers agree to their unethical and illegal demands, it's fine else they start sending demand letters etc. to pursue such payments equivalent to ransom money. Afterward, they start threatening you with legal notices, discontinuation of the housekeeping, electricity, water services. Bunch of dacoits you see. No matter how many times you try to call them up or follow them to discuss such an issue, they will try to hide away from you and keep pursuing the demand for payments through written letters, legal notices.

i am also facing same problem with omaxe in omaxe park plaza indirapuram.
I am also facing a similiar kind of issue with omaxe north avenue in bahadurgarh. I have paid the IFMS charges while booking the flat and not flat is ready for registry purpose but when i enquired for the same, they mentioned that i need to pay one year advance maintaince charges then only property can be registered. I am clueless
i have already paid all the amount towards property and holding up the registry for the maintaince charges is illegal.
I am an owner of shop no 9 third floor omaxe celebration mall(wedding), they r charging me a maintenance of 229000+ interest for last 3 years and 20000 as electricity charges, but here is a catch that mall is not operational in full from last 3 years cause there is no anchor brand in it, so how can they charge me a full maintenace.Now they r not even listning to my calls.Can someone help me in this

Yes you all are true. Same unethical treatments going on in my case too. I am an owner of a shop at omaxe city centre. I purchased the property which is supposed to be at first floor but actually it is on second floor. I sent 4-5 letters and requested them to address my grievances and then I will take possession. No reply to my any concern and occasional demand letters for maintenance and holding charges with interest. Finally sent them a legal notice. Let us see.
