[Resolved]  Shreya Developwell P Ltd. — Non-refund of booking amount

I have booked a flat at Hindon Hieghts NH-58, Ghaziabad. I was promised refund of the Booking amount as soon as the loan amount is disbursed to be repaid to the builder at the time of possession. However, the loan was disbursed on 31st of May'08 and today on 2nd of July I am still following up and waiting for my money.

I am also suffrer, I had applied for a 200 sq yard plot in Hindan Hights & the refund cheques are still unpaid due to the stop payment by Shreya Developwell.After going through with all the comments, I feel that there is NO other way to get the money back except legal actions.Can anybody tell me that the association is also fighting the legal battle for plots OR only for apartments applicants.If yes then let me know the contact details(mail ID & cell no.) of the concern person to whom I may contact, egerly waiting for response, my best-A.P.Singh ([protected])
Dear friend,
Another blast from builder side. Recently this builder is sending an EDC( External development charge) letter demanding payment of EDC charge. This charge is Rs.100 per sq.ft. Is anybody get this letter. If yes pls let me know that this 100 per sq. ft. is right or they demand me more than others. B'coz earleir in my contract letter this EDC is not mentioned at all. This is extra burden on me as this is not in my contract paper. And also if anyone know the current status os this project (Hindon Heights, Rajnagar ext.).

I am also facing the same issue, every time I call up Shreya Developer, no one picks up the phone, in case the phone is picked, operator asks to hold and the hold is so long that the caller has to disconnect by himself/herself.
Here is one more victim. I was unaware until today that an association has been formed. There is a complete nexus of the various financial institutions and this guy himself is a big cheat.

We should bring a winding up petition against the company so that the land can be sold and money recovered and also move against financial institutions to refrain from from troubling us. They have not given the money to us but to the builder and while disbursing have assessed the delivery capabilities of the builder. If their officers have been bribed into clearing the project let the Bank recover the money from those officers.

I would request all the victims to atleast filed the Police Complaint if not done yet in Anand Vihar, Police Station followed by notice through your lawyer/advocate. High Court/SC change the rules recently where in, if any complaint filed against the builder by the victims then builder has to deposit the 10% amount of the Property in Court in order to start the proceedings for every case.

Scenario
1) 20 cases by different victims
2) Each victim holds 1200 sqft flat @35 Lakhs each
3) Against every case, builder has to deposit, 3.5 lakhs in court (non-refundable).
4) 70 Lakhs to be deposited by the builder

Just think of the scenario, I am sure he will try to settle the matter out of court and if you agree to will at least get the Principle amount and then it depends on your negotiation skills to get the interest on the principle amount. I understand the whole process will take some time but I am sure you will see some progress.

I did the same in January 2013 and based on my complaint, Shreya representative called me up and asked me to come to the office to sign an agreement. As per agreement, he confirmed to refund the entire Principal Amount by May 2013.

And till date(18-July-13), I received 3 Lakhs out of 4.65 Lakhs. But again, they stopped the refund of balance amount. I am planning to go to Police Station to file another complaint for harassment, Extortion and cheating against Rajeev Gupta and team. Also planning to send another letter to Shreya to inform that this agreement stands cancel and now I want Interest part along with the remaining principal amount.

Overall, I am happy with the progress I made without the help of association.

Positives:
1) Recovered 65% of Principle amount.
2) Saved one time fees which people are paying to form the association and small amount against each hearing to Lawyers.( I am 100% sure that the lawyers are in touch with Rajeev Gupta and his team and giving them vital information.
3) Direct meetings/dealing with Shreya representatives

Negatives:
1) Lose Interest part
2) Still 1.65 Lakh balance pending with Shreya ( I am sure they will refund without getting into the complexities of another Court case).

Hello All,

Any update of current status of Construction?

I visited there before then 15 Aug'13.

Jasmine III almost ready. Lift installation to be start. The Parts for Lift already arrived and the Machine Room in the top of tower build.

in other tower (First row) the finishing work (outer plaster etc) was

Visit there and see the Quality Construction work. I am happy to it.

But no one can recover the delay in construction.

I hope the hand over of Jasmine III in Dec'13 or Jan'14.

If any one visit there, Kindly Post the photographs.

I am too victim of the same builder.I also had booked a plot from this builder in 2006 on NH-58 and waited till long time, but when till June, 2008 nothing positive came out .now all phone are not working . i dont know what to do. can any body guide me for getting back my money. dr s. k. jain

Either u r a shreya guy or u have been attached to them.as I am visiting the site almost weekly .I am also a shreya victim. I entered in so called(only in paper) hindon valley. And then transferred to a flat in jasmine 3 as there was 2 plot so almost 9 laks parked with them. Since last 4 month nothing is there .i mean 4 months back some name sake work was there. But now nothing is going on.lift part bull . Nothing is there...

Let it make clear that I am not a employee of Shreya Developer and not a booking agent or property dialler.

I also have my flat in Jasmine-III and my case is almost same as yours. I was booked a Plot in Shreya Developwell project and later transfer it in Flat. So we both are having flats in same tower. You are lucky to have paid 9L only. I have almost completed.

Jasmine-III is tower which is in advance stage comparative to all other towers. The flats in this tower almost in ready condition. Room tiles, electricity feelings, paint and sanitary fittings was pending. I think it is 40-50 days work only. It will damage if done in advance, this must be done just before handover.

I was visited there on August'13. That time the tiling work in Ladder and corridors was completed in Jasmine-III. The construction of machine room (Top of the tower) for lift was going on with finishing work for lift shaft. The main is start off lift installation. Which may be will take 3 months for completion after start.

I have seen the lift spare parts there in ground floor. The person of Shreya Developer confirmed me the other machine items are locked in a room. I was in hurry so not checked the parts available in room by my self. After seen all I was hoping to get the delivery up to Dec'13 or Jan'14 max.

From that time the work at Shreya site was moved. Last week I got information that the site was locked out. I don't know the reason but this happens several times, not a new case.

I am getting the information that Shreya has sold its project and shut down the AGCR enclave office. Can any body has updated information. I am really very worried. Also if any body can let me know as to how can i stop paying my Bnak Loan EMIs as i am still continuing payment.
More over I heard Rajiv & Sanjeev have also left their residence and are no more in their original residence [ not sure only heard]
I have booked a plot with Shreya Developers. The project was discontinued but am struggling to get my money back.
