[Resolved]  Tata Motor Finance — Not Refunding Excess of Payment received by them

Myself Krishna Arora, had availed fincance from Tata Motors while purchasing their Indica Xeta (petrol) car.
As if my woes were not enough with the v. poor mileage problems of the car (which could not be rectified after so many complaints), on and above had been the irresponsible and attitude of Tata motors finance.staff. My Contract No. [protected].
Disgusted with same I decided to prematurely close the loan account. But to my shock they refuse to refund the excess payments they have received from me. (Amounting to about one thousand). The explanation given by them was that my EMI for one month was delayed so they have adjusted the surplus in my account as penalty. This was questioned by me whether they have any norms/criteria for that or whatever the surplus they are free to usurp. Besides my arguments was that I was not responsible for the delay in EMI as they are the people maintaining my account and also the PDCs (post dated cheques). In case they were going to exhaust or exhausted the PDCs they could have intimated the customer. Which they never bothered to do and upon seeing my bank pass bood and finding not debit entry of the EMI amount, despite my sufficient balance, I had to contact the Tata Motor Finance people. Then I was told that they had exhausted the PDCs, following that I had to make repeated requests to them, the branch manager and also complained to Tata Motors, then alone I was approached to collect the PDCs. Now under the circumstances who will like to continue with Tatas.
This way the usurping my surplus balance is criminal breach of the trust under the contract act. The Tata motors helpline refuse to register the complaints and I have been sending emails to Borivili Branch manager Mr. Ashish Prasad to no avail. God save the customers from Tata Motos............

THIS IS VERY WRONG SERVICE FROM TATA MOTOR FINANCE LTD. MY FATHER MR M.K.UPADHYAY SUBMITED A CHEQUE OF RS 150000/(- CHEQUE HAS BEEN CLEARED )PURPOSE OF PURCHAING A TATA 1109 COMMERCIAL VEHICAL BUT HIS APPLICATION HAS BEEN REJECTED RECEIPT NO -RCT[protected]. I AM SENDING MORE REQUEST TO TATA MOTOR FINANCE & HIS EXECUTIVE MR BHAWANI SHANKER PLEASE RETURN MY PAYMENT BUT HE IS NOT PROPER SERVICE & PROPER FEEDBACK .REQUEST YOU TATA MOTOR FINANCE LTD PLEASE RETURN MY PAYMENT OTHERWISE I AM SUBMITTED A LEGAL CASE IN FABOUR OF TATA MOTOR FINANCE .

failure of electronic unit twice within 3 years

Bought indica dls in jan 11. AP 31 tv305 ELectronic control unit got defective twice. Replacement cost for the same is 20 thousand each. Who should be held resp for bad electronic use?
