Daikin Air Conditioners — Complaint to Daikin against faulty product

TO WHOMSOEVER IT MAY CONCERN. On 28th of March 2015, I bought a Daikin FTF50PRV16 1.5 Ton 5 Star Split Air Conditioner, and installed it in my shop. I made this purchase at Khandelwal Electronics & General Agencies, Akola. And the bill is made under the name of my shop that is IFRA BOUTIQUE. Unfortunately, your AC has not performed well . It is not working as expected. The cooling is negligible even if the AC is kept at the coolest settings. When complained about the same, the service man came and said it required water servicing. He did servicing but it seems that it didn't made any difference. Since then i have complained to Daikin and to Seller almost 4 to 5 times and the service man has only one thing to say "AC needs water servicing". The service provided by the seller as well as by DAIKIN was inadequate and irrelevant. How can a brand new AC needs servicing every week. I am tired of your bad service, and in order to resolve the problem, I would appreciate Daikin to take the product back and refund the sum paid to you. Even the Seller doesn't seem to care about customer service. Daikin customer service is the worst and moreover the seller (Khandelwal Electronics, Akola) is rudest seller i have ever seen. They doesn't seem to care about customer. The Sale of Goods Act 1930 makes it an implied term of the contract that goods be as described, fit for purpose and of satisfactory quality. As you are in breach of contract I am rejecting the product and request that you refund the sum paid to you of INR 42000. I also require you to make arrangements for the AC to be collected from the address mentioned below. If I do not receive your satisfactory proposals for settlement of my claim within seven days of the date of this letter, I intend to issue a claim against you in the court without further reference to you.
