Ebay.in — Failure to approve for refund, Partial refund or item replacement

I am Prajwal B V, an engineering student from NMAMIT, nitte. My email id is [protected]@gmail.com. I opened a "Item not working/broken" claim (claim=complaing in ebay terms) by asking for refund for the item I had purchased on Jan 30 2015 from ebay which was delivered on Feb 04 2015. The reason for opening the claim is because the item delivered was defective, and when I powered it on (by connecting vcc and ground) it didn't give a backlight which it is supposed to have given. Details of the claim are as follows Claim ID: 872615 PaisaPay ID: [protected] Item number: [protected] Seller ID: 14electronicbay Date claim opened: [protected] The claim was made before 15 days of delivery. It was made after 6 days. After opening the claim I had to send the "proof of item not as described" via email, for which I sent the pics of the item taken. I got a call from ebay on 16th Feb 2015 at 11:18 am and they had inquired me the reason for applying for refund, and they connected me directly to the seller and they inquired us both. The seller was complaining that it is not the module that was sent by him because it didn't have the pin names printed on backside of the module, he was saying that the item that I gave in the pics is different from what he had sent me. I said that there is no way for the misplace of the item because I had got a sealed package from ebay and while opening it I had made the video record for the proof. The ebay guy responded to this by asking the seller to send the pics of the item that the seller was talking about (the pics of the module which according to seller is the pic of the actual module sent). Ebay guy said that once he gets these pics from the seller he will resolve the issue. I got a call from ebay again on 19th feb 2015 2:39 pm. This time they told me that the claim is resolved and I will not be getting the refund because the claim I have made is not elligible for refund. They didnot approve for the request for refund or replacement, at the least partial refund. When I tried to remind them about the ebay policy according to which they are supposed to approve the refund claim, they were not ready to listen because they said that they have already taken the decision. As far as the ebay guidelines is concerned they are liable to approve for a refund or replacement because according to the seller eventhough the pin names is not printed on the back, it falls under the category "item not as described". I feel extremely sad because of this injustice. They usually keep a record of the call for training purposes which can be verified for the proof of my complaint. In the photo proof I have given the photos of the items delivered, proof of the call timings I mentioned, and their ebay policy according to which I can get a refund or replacement.

Its been 9 days and still waiting for a solution. The ebay is not contacting me they are just giving a front that they are showing the response but each time this is all they send:

"Dear Customer, Thank you for sharing your concern with us.
We are checking with the team regarding this issue. Kindly allow us some time, will update you soon on the same."

No matter how many times I ask them they send me back the same thing. Its been more than a week. Please take some strict action against ebay, so that they really take this issue seriously.

AND ITS SO ANNOYING when I finally realised it that it is the system generated message they keep sending me and not the one sent by ebay ppl.

Now a days ebay people do not listen to the buyer as far as of the refund is concerned. Their customer care people try more to hush up the case by not agreeing to any refund. If refund is approved, it will increase their work and also more questioning from their management. I also suffered loss of money as my claim, item defective / non-functional, was NOT agreed to by their customer care executive, and all my money went into GKG. Today's ebay is NOT what it used to be few years back. So, be very careful while buying on ebay.
I tooo lost money on ebay as they were not ready to approve refund for the wrong item that was delivered to me. Don't trust ebay.. even their product quality is bad now days.
The ebay have infact contacted me through messages, but they didnot mail me to my gmail nor they contacted me through phone.
They sent me Dear Customer, We have taken a note of your details and will get back to you with a resolution at the earliest. Thank you. on 22 feb 2015. and till now they havent done anything,

If I ask them on updates regarding this issue all they say is Dear Customer, Thank you for sharing your concern with us.
We are checking with the team regarding this issue. Kindly allow us some time, will update you soon on the same.

and then practically do nothing at all. Its been 8 days since they first sent me a message. No actions have been taken till now, I am begining to doubt whether they will really resolve the issue! or just keep pushing things forward.
