[Resolved]  Ebay.in — cheating from ebay

Hi,

It's regarding my experience of purchasing "mi 8 in-ear headphones pro hd earphones with mic & volume control piston hybrid" from this seller ankusgoya23 and ebay. I purchased earplugs from him on 20 mar 18. It was delivered to me on 26 mar 18. Upon receiving it, i checked and found that sound was not coming from one of side of the earplugs. I immediately raised a claim regarding it on ebay (Claim id : 3520768). On ebay it was not showing as delivered, so i confirmed it on ebay that i have received it. Then i got the response from the seller.

The delivered earplugs are not working. Only one side is working other silent

*seller's response 1 : *
We are so sorry for this inconvenience, please return the item in 7 days, if the item is not return in 7 days this claim is canceled. After receive your return item, we will refund it. Return address:-

So seller was having 2 communications with me, in claim communication he was saying that the product will be picked up back within 48 hours and in direct communication he was saying apology for it and saying me to ship back the product.

So i waited for 48 hours and then i contacted ebay regarding it, and after having many discussions rounds and chats and phone conversations, ebay sent me the following response.

For claim id 3520768, you are requested to reship the product to the seller’s address and provide us the proof of shipment (Receipt and declaration letter shared by courier company mentioning amount and contents of package clearly) within 3 days of receiving this email. Ensure that proof of shipment is readable and valid.

Your claim will be rejected if we do not receive the required information within the aforesaid timelines.

Remarks : kindly send the product back to the seller on below mentioned address: ankush goyal email: [protected]@gmail.com phone: [protected] s/o surinder pal, dr. K. P. Wali gali, water works road, ward no-17 mansa, india 151505 please provide the below details from a renowned courier company: receipt of dispatch must contain: 1. Seller name, address, pin code 2. Buyer name, mobile no 3. Courier charges 4. Weight of the shipment 5. Item name & value the declaration letter must contain: 1. Content of the package 2. Value of the product 3. Item name in case you are facing any issue while uploading the proofs of shipment through the link, you can send them from your registered email address to [protected]@ebay.com.

So i was left with no other option to ship back the faulty earplug to the seller. I did the same and sent it through the renowned courier dtdc with tracking number z53227322. I uploaded all the details on ebay's link, and shared the same through email also at [protected]@ebay.co.in also. Even i uploaded all the pictures of product, shipped packet also. Till 2 days i didn't get any acknowledgement from ebay. So i called up ebay to confirm whether they have got the details or not and is there anything else pending at my end. To my surprise first the ebay person said sir we haven't received any details regarding it from your side. But after checking his system, finally he said yes we have got the details and be assured we will look into it.

This i am finding very disappointing experience from ebay. I am being forced to ship back the item with the reasoning that pickup service is not available at my location. This is ridiculous to know that pickup service is not available in tier 1 city of india. I am not living in the remote part of india. But anyways i have shipped the item through dtdc courier at ankush goyal email: [protected]@gmail.com phone: [protected] s/o surinder pal, dr. K. P. Wali gali, water works road, ward no-17 mansa, india 151505. I have uploaded the shipping invoice and images of shipped product. As you can also see from the images that this is not genuine product, it s a cheap replica of the actual product. I think there should be some penalty for the seller also.

And after 2-3 days i got the another following email from ebay that my claim has been rejected.

Pursuant to your claim, we have observed that you have failed to provide documentary proof of return shipment within the prescribed timelines. Hence, we have rejected the claim.

We appreciate your understanding in this matter.

Remarks : we were asking for proof of dispatch copy of reshipped product, unfortunately, we did not receive the necessary information and hence we had to take a decision to close this claim.in this case, our best advice to you is to contact your seller and resolve the matter amicably. We regret of not being able to assist you on this matter. We look forward to your next purchase on our website very soon. Thank you for shopping on ebay!

Action : buyer did not provide proof of return shipment - claim rejected

So i called up ebay and came to know that i missed to send the declaration letter to them, and due to that this claim has been rejected. So as per their customer care, now i am left with 2 options either send declaration letter to them and it should be stamped and signed by courier company, or ask the seller to let ebay know that he has received the product. So my first question to ebay was that, was it mentioned anywhere in the email that the declaration should be stamped and signed by courier company. But anyways i tried both the options

1. Tried to get declaration letter get stamped and signed by courier company. But courier company denied providing it. They said, we never provide such kind of letter.
2. As i was only left with seller's confirmation option. So i sent a mail to him that

I hope you would have received your item back and checked that only one side of earplugs is working. So can you please let ebay know that you have received your item back?

Your claim is rejected, item quality checking failed, item is proper working.

You mean to say that sound is coming from both the earplugs? And its perfectly fine.?

Yes, item is good working, in this case refund is not refundable and claim is rejected.

So here you can clearly see that seller is accepting that he has received the product back in good condition, and also it can be seen that he is completely lying that product is working fine in order to avoid the claim, because as a buyer, am i fool that if the product is fine, then still i will be sending it back to the buyer.

Seller's intention can clearly be seen from all the messages mentioned above. All these messages are available in ebay messages, i haven't modified any of it. So shall i expect anything from ebay now?

After posting it here, ebay Reopened that claim and asked me to provide declaration letter as proof of delivery, signed and stamped by courier company. I tried to approach the courier company regarding it, and finally was able to get declaration letter signed and stamped by them. I posted the same on ebay, and ebay resolved the matter and refunded my money. Ebay has also assured me to provide the shipping charges bourne by me.
eBay.in customer support has been notified about the posted complaint.
