I want to raise a complaint against 2 sales executives from emaar gurgaon. The names of the executives are gaurav shukla and girish thakral.

I have purchased a flat in emaar gurgaon greens in the month of october. These two executives promised me that the flat possession will be done by 31 march 2019. Since the session for my son was starting from april 1, it was imperative for me to move into the flat before that. I went into the deal only because these two gentlemen gave assurance that flat will be delivered before march 31 and worst case scenario if not, then they will help me with a rental accommodation in the same society. I have been trying to contact both of them from last 2 months but they are not responding to my calls now and it is extremely frustrating. It feels as if i have not associated myself with reputed organisation like emaar but a roadside builder who have no ethics.

I guess, this is a generic practice in emaar to lure customers by giving false information and then ignore them once they are onboard. I hope both these guys are confronted and they don't cheat customers, which seems a norm for them.

Dear Mr. Koul, I am in a similar position. I also agree that Emaar purposely stalls and delays matters, which is just not fair to you and me. They think it is ok to make promises and break them. I believe that Emaar is violating Govt rules and Supreme Court and National Consumer Disputes Commission rulings, which say that a developer cannot force a buyer to take possession for properties that have been unreasonably delayed. .     In december, 2011, i purchased a flat (4bhk) in the emerald floors premier, phase-iii, sector – 65, gurgaon, haryana, but as on date, i have not got the possession of the flat. I have taken a loan against this flat and been paying heavy emi every month over the past several years. Now, it has now been seven years but builder emaar mgf is not ready to give possession.

    Dear Saurabh, I am in a similar position.Emaar delayed my flat also, by 3 years, but did not. I asked for a refund due to the delay. They refuse to do that.       We bought three units from emaar each in imperial gardens, gurgaon greens and emerald floor select. Each year, emaar give excuses and new date of possession for each unit. Emaar have 90% of payment against property and i'm paying interest on the amount. I have contacted their officers and spoke to customer care but no replies. Even pictures oon update on my property couldn't be send. I have requested emaar to buy back the properties and give our money back. This delay is unacceptable. They give legal notices after notices if there's a delay from our side for payment and no accountability for delay on their part. I have contacted their sales head, who said will buy back emerald floor select from us but now don't have courtsey to reply to emails and phone calls. I ask emaar to buy all our properties back and refund our money.

      Dear Shiv, I am in a similar position.Emaar delayed my flat also, by 3 years, but did not. I asked for a refund due to the delay. They refuse to do that. Rohit.[protected]@emaar.com promised to reply to my questions about Emaar breaking the law - but its been a month now, and over 10 reminders - so I am sure Emaar must be guilty, that's why they are avoiding.         Upon our requested to clear the outstanding dues a mail was sent to mr. Deepak and we got the statement on 22 may 2018. The outstanding dues were rs. 292, 935.00 as of on 07/05/2018. Also there was another outstanding of penalty as on 07/05/2018 of rs. 33, 721. I discussed with mr. Deepak for the wavier of same and he assured me that presently we need to settle the same and then the same will be adjusted / refunded in future bills.

        We have paid entire amount to emmar as per after taking confirmation from mr deepak till now rs. 33, 721 not refuned in our account multiple mail followup with mr manohar and deepak

          I have purchased a flat in cwg village at akshardham delhi from a seller. I have entire amount to him and he paid his entire balance to emaar mgf ltd two months back. After getting clearance i also borrowd a loan of rs.2.00 crore from bank as well.
          On their website they have transferred the unit but not providing any documents, not doing registry not giving possession and not giving any reply as well. I have sent a legal notice to them as well. Bank has also written a letter to them but surprisingly they are not even bothering about all this and giving any reply.
          I have no choice except to lodge an fir and file a court case against them but it will itself increase my mental harrasment.
          What should i do. I am paying interest of 2.00 crore every month and not even having the property.
          Should i approcah to rera or what.
          Please help.

            I have booked a flat in Emaar Imperial Garden Sector-102 Noida in 2012 @6800/- BPS, Unit Rate with IDC/EDC was Rs 1.54 crore and paid Rs 1.4 crore 90% of flat cost with loan from ICIC HFC..Builder HAS committed to deliver flat in 2016 but delayed by Two years and now committing delivery in 2018 end..i have paid Rs 30 Las interest on loan til date..i want FULL refund from BUILDER due to delay and financial burden..also now in 2017, BUILDER started selling same project in Rs 95 Las and hence i am unable to resale it..i want FULL refund from BUILDER with interest as they are cheaters..and I have lost faith in them..

              Initially they sell me a plot in the area which was not bought by them. Then they have given me a plot which is 10 feet below the road, forced me to take possession as if not taken, i will be levied with fine. There was water logging in that area which was paritally resolved in 2015. Again there is water logging in 2016 and 2017. I am sharing the pics with you. It a pond rather than a plot area where they want me to start construction. They have charged me edc as well as maintenance charges, despite that i was not given appropriate plot.

                The staff acts as per their whims and fancies. A tds certificate form 16b which is accepted as digitally signed by tdscpc as well as other real estate companies is rejected by emaar staff. All links provided by them do not work. Yet they leave all responsibility to customers for their inefficiency and poor knowledge.
                Interest is charged to customer even in cases where delay is caused by poor and late proper response by them. This has been so for last several years.

                  The palm studios appartments - delivery still far away - builder has already collected the bulk of payment but no deliveries made yet - huge delay (More than 1 year)- issues needing resolution include:
                  A) when will the flats be handed over (Possession)?
                  B) there is a huge delay in handing over - refund is due to the owners. Hoiw does the company intend to settle this??
                  C) refund of service tax is also overdue as ruled by the courts (Each unit which has paid st has to be refunded that amount). Why has the company not sent letters to this effect to all owners.
                  D) has anybody have information/ noticed quality issues related to the construction?

                  Dear Don, I am in a similar position. Each time I go physically to or write to the Emaar customer unhappiness centre, they assure me that the next day itself, they will solve all my concerns. But tomorrow never comes.

                  In my view Emaar is a blood-sucking monster that just does not care about the genuine concerns and breaking its promises to its customers.

                    We have booked the apartment in Palm hill and possession is comited in 2014 but everytime they will be responding you that they are planning to apply for possession next quarter from last 2 year but there is no end of commitment .Can anyone guide me how to deal with them .

                    Project has been delayed without any update of the progress and delivery. Last payment was asked in Sept 2015 and hence since then no progress has been made.

Would it be possible for you to share all the details such as the date on which property was booked, the amount that was paid, and the date on which the possession was supposed to be handed over but was not handed over to you.                     Emaar India worst builder of current times. Beware customers before buying any property and investing with Emaar India. Emaar Dubai Shaikhs and Emaar CEO ([protected]@emaar.com) are sleeping over these issues.

                    Now they have come up of new drama of second staircase construction for fire safety and asking for another 8 months to complete and the again apply for OC (OC is being applied to last three years).
                    They have money, workforce, team to launch new projects with the money of old projects.

                    90% of the new projects are getting unsold and slowly Emaar India would go bankruptcy due to their greed of buying more land, launch new projects.

                    Sometimes company board hires fools like Prashant Gupta as CEO who come up with such lame ideas to bring the company to next level (-1 to -10).

                      I have booked a flat under the project (emerald floors premier phase 2, golf course extn. road, sector 65, gurgaon)in 2010. The due date for possession was 2013 june sometime. Now it is 2015 and there is no sign of further construction. The construction has stopped since last 10 months and i dont know when the construction will start. I have invested a big sum of my hard earned money into this flat. I have been calling them since more than 10 mths and every time the customer service say that the construction will start in 2 months but it does not start. Now when i went to gurgaon to meet their senior officials in their sales office in Sikanderpur office in gurgaon, they gave the same excuse again stating that the construction will start in 2 mths. When i asked for the refund, they said that i can get a refund post deducting 15% and other charges from the total amount i have paid. In fact i should be getting the entire amount i paid along with EDC, IDC charges and also an intrest amount on the sum paid rather than any deduction because it is their fault that the constuction has got delayed by 2 years and there could be a further delay of 2 years if the construction starts now.The total delay is estimated to be 4 years which is unacceptable. i have never seen such unprofessional builders. Pl. help me get my money in full with intrest.

                      The buyers of emaar mgf floors have to take stand and fight with the company and the collective efforts of the buyers will be more effective, its a landmark decision of apex consumer commission and on the basis of that order other buyers can also file a complaint before the consumer commission, being an advocate I would suggest every buyer must take action to get compensation as per the said order.                         Dear Sir/ Madam, I gave a cheque of Rs 15Lacs te Emaar Mgf through a broker for booking of a flat in new project Sec-112 Ekaantam in early 2013. The project never came through, however Emaar Mgf banked in the booking amount. I have been asking for refund of my booking amount from Emaar Mgf but no response to my emails. Is pre-sale even ethical? Does that not mean that Emaar took your money even before all approvals were in place. I believe that is what they did to me also. Is that not cheating?                           I have paid in full for an apartment in 2009 and its now 2018, i am having to persue these monkeys through the courts.
                          Only in india does justice seemed to get put on a backburner.
                          The case keeps getting adjourned to allow these thieves to accumulate interest on my money.
                          Only in India can this happen.

                            I came to know about mohali hills by emaar mgf in April 2015. I contacted few dealers and reached mohali hills office in sector 105, met with one girl (don't remember name), she took us to the sight at 108 with every information on paper rather than on the ground and said that property is ready for registration and talked about different payment plans, I asked the relevant questions but she either contradicted herself or just didn't answer convincingly. The day ended with again a bad impression of builder or big companies tends to cheat customer. Again been to 105 at sales office and this time with someone Mr. Palav rai, who sounded extremely good but of again no use with all the same dealer characteristics, anyway met with new sales person Mr. Rajeev sharma and he definitely answered few of my questions and doing so he also contradicted the girl I met last time, anyway he also carried his maps and all to the sight but of no use as he was having no information on the ground like what's the dimension of plot, how much area is going to be left beside my land (as it was presumed to be the last plot of that lane, as the company has not acquired the land after that) he failed to show me the electric terminal in that lane but he maintained that electric work is done ( ridiculous, or he must be presuming customer to be the foolest creature on the earth). He has shown me the approved map after I asked him about the legalities of the project, bit surprising as they are suppose to provide these without asking to be transparent. He asked me of PLC @ 12.5% and that too in cash, without any formal receipt (clearly black money), have to be paid along with booking amount so no time to pay cash component. Infact I am unable to understand why are they charging this much just for 60 feet road. Later on, after enquiry I came to know that they charge 100000/- approx for club membership for which they don't have details of facilities provided by them in written, this fact was suppressed. I just feel that they don't provide any information without asking except for the amount part, they are going to charge. They will make you feel that you already asked so many so let's not negotiate or ask anything (kind of self feeling bad of asking so many Feeling to take this matter to court in the form of PIL .
                            Dear Sir, If you have not invested till date then I would advise you to please do not make any such investment in the Emaar MGF as the peoples like you who have invested years back are coming to consumer courts and are getting refunds of their strucked up money. No doubt the court is awarding interest @12% per annum alongwith further compensation and cost of litigation. Therefore, I am just making you aware about the same.                                 Hi, I booked a flat in Emaar MGF Imperial Gardens sector 102 in Dec-2012, but due to some financial issues, I could not continue with that. So I requested builder that I want to withdraw my booking, but builder said they are not cancelling any flat and asked me to wait and try for resale. Builder send me builder/buyer agreement but I refused to sign as I wanted to withdraw my booking. Now they are sending me further demands for payment, but I have been telling them that I want ti withdraw my booking. Builder is not cancelling this, and not refunding my booking amount (10 Lac Rupees). Please help. Thanks Kuldeep

                                  We have bought a unit in Palm Studio, Golf Course Extension Road, Gurgaon.
                                  The accounting department at Emaar is not clear on the amounts they are charging us. After several weeks, they realized their mistake and one of their Senior Managers (Parag Raj - [protected]), acknowleged that they had charged us incorrectly and the company owed us Rs.17,670 which will be adjusted in the next installment.
                                  However, when the amount was not adjusted in the next installment and I complained to their customer care, they started sending the payment schedules, statement of accounts without explaining the refund. Their statements, clearly, mentioned that they owe us 17,670!
                                  When I got in touch with Parag, he said he will do his own analysis and call back in an hour. When no call came, I tried calling him several times, but he didn't pick up the phone.
                                  Is there someone at Emaar who we can escalate this too?

                                    Calling all owners of Emaar-MGF- The Palm Springs, Gurgaon - COME join hands with us in fight against the company on pretext of a fictitious super area increase!
                                    At the eleventh hour of this much delayed flagship project, Emaar-MGF has slapped an outrageous demand of Rs.10-34/- lacs to all owners on pretext of a fictitious super area increase. The basis they give is that there is a clause in the agreement which says that for upto 10% increase in the super area, the company needn't ask the clients and can demand them for payment against such increase when required. But the fact is that as per physical verification, the covered area is even less than that in the agreement!
                                    A group o[censored]s Palm Springs owners have already got together and are fighting against this unfair demand from the company. There are already about 140 owners in this group and its growing by the day. We had meeting with their top management and so far they don't have any answers to any of the queries that we put in and asked for proving us the increase in super area and support it with on ground verification.
                                    We have also roped in a top legal firm and have already sent them clubbed notices. United we are a group of HNI's and high profile corporate heads and have a very strong case and have already lined up a strategy to fight this unfair demand.
                                    The formation of a formal Association of the owners is already underway.

                                    There is a lot of ambiguity in how superarea is to be calculated any varies from company to company. The agreements are one sided and the ambiguity works in the favour of the Developer. However some key questions are :
                                    1. EDC and IDC are levied on the plot area and therefore the cost is distributed on the built up area, at the time of the launch of the project. Since the land area has not increased, there is no additional charge to Emaar MGF. Hence it is illegal to demand additional charges from the Owners.
                                    2. Superarea calculations must be transparent and calculations certified by an Architect.
                                    3. Emaar MGF must also provide a statement of the change in superarea. What is the increase in the area of the apartment, and how much outside.
                                    For example if you increase the balcony width, no additional FAR is lost, so the additional cost to the Developer is negligible. Or if you increase the shaft size for pipes, to demand a pro rata increase in superarea which is based on an airc conditioned space is unfair.
                                    has this been resolved?
                                    This issue has now been resolved as a settlement was reached between the owner's association and the builder.

                                      I purchased an apartment from emaar-Mgf in 2007.
                                      I was given a 7% discount if i paid upfront. The completion date given was 2009.
                                      We are now coming up to 2011 and there is very little progress on the site and on top of this i ventured in as a new client on my recent trip and was offered 13% discount if i bought a flat.
                                      i then explained that i have already purchased one and how come they are offering further discounts to new purchasers whilst the old ones have been left to rot.
                                      a Mr M Kaura said he will look into it and come back to me.
                                      It has been some 3 months and some 15 emails and the net result is that they can give me a further discount if i buy a new flat but cant upgrade me to a larger flat.
                                      I explained that if i had kept some 50 lakh in my account for three years then i cound have now bought 2 apartments rather than sqabble over gaining an extra bathroom.

                                      The customer service is frankly appalling.
                                      I wonder if anybody else has had a similar experiance and if they have managed to get anything out of them.
                                      I would never buy anything from them if i had known this is how they would behave.

                                      Surely callous..
                                      Emaar is the worst company to invest money in. They are selling new plots but don't have land to give possession to people who have payed the full payment 2 years back.

                                      Moreover they commit something and run away from it in few hrs. Don't Invest a single penny there and I am also trying to find more people who have suffered the same and then planning to approach relevant court for justice.

                                        I have booked a flat in EMMAR MGF Palm Hills at sec 77, NH-8 in the month of August 10. the booking of 5 lacs is already paid to them. till now i have not got any allotemnt letter or any other official letter from EMMAR MGF on my booking. i have got the reciepts for payments and it has my flat number alloted as tower 31 flat no 101. I am following up with EMMAR MGF and their authorised booking agent D C Jain company for the paper from last 3 months but not even i single response. I would like to request to EMMAR and D C Jain to take ownership of this issue and release my documents ASAP.
                                        I would aslo like to share that Emmar MGF and D C Jain both are not at all proffesional companies and do not care about customers. Customer care and customer satisfaction terms doesnt exsists in these companies..

                                        I would advise you to initiate action against them in consumer forum gurgaon and you will be compensated for your mental harrassment also. The consumer forums in these days will not take much time in this as there are guidelines of the National Commission to decide a matter within 90 days. You also no need to engage any lawyer you can draft your case yoursel[censored]der section 12 of the consumer protection act, 1986 and plead against them.
